The Learning Contract

The academic credit internship program (Mgt 4801) is designed to contribute to your intellectual and ethical growth by providing a reflective opportunity to apply classroom knowledge and a practical perspective from which to evaluate past and future classroom learning. The learning contract sets for the academic expectations of the internship and guides the internship experience. The school, experience provider (host) and the student develop the learning contract goals to ensure that the student receives an appropriately rigorous learning experience. The learning contract protects the student from serving as an unpaid office assistant, and insures that experience provider will work with the student who takes the experience seriously and conducts him or herself professionally. As you complete the learning contact please pay close attention to the instructions regarding alignment of the objectives. The first objective supports the School of Business learning goals; the second objective related to discipline-specific knowledge you seek to gain from the internship and the third objective addresses your personal aspirations for the internship. You are required to detail the specific learning activities that will assist you in meeting your objectives. Learning contracts that reference “observation or exposure” as learning activities are likely to be sent back for further development. Avoid generalities such as the following: “I would like to become very comfortable calling clients and working with people to accomplish my goals”. The learning contract needs to be specific. For example, “Develop as an effective communicator”.

Learning Contract Reflection

...internship at Wright County Health and Human Services, I participated in a multitude of activities to enhance my learning experience. Per the learning contract, there are five activities that I chose to discuss throughout this paper. I chose to write about these five activities because they were insightful, and I learned a lot from doing them. Agency’s Confidentiality Policy One activity I chose to complete in my learning contract was to read and follow Wright County’s confidentiality policy within the first week of my internship. This activity falls under objective one in my learning contract: Demonstrate Ethical and Professional Behavior. This activity connects to objective one because it helped me to better understand the expectations at Wright County. Additionally, this activity made me engage in professional behaviors. By understanding their confidentiality policy, I am engaging in professional behavior because I am following the agency’s policy. Social workers must understand their roles and responsibilities in not only the social work profession, but also their role at the agency. To complete this activity, I did the training on the Health Insurance Portability and Accountability Act (HIPPA). This training taught me the importance of confidentiality. In addition, my supervisor and I discussed...

...Formation of Contracts McGraw-Hill/Irwin Copyright © 2011 by The McGraw-Hill Companies, Inc. All rights reserved. Written versus Oral Contracts n  While the word “contract” is often used to describe a written document, many contracts are not in writing and yet are enforceable. 6-2 Bilateral Contracts versus Unilateral Contracts n  A bilateral contract involves two promises and two performances. A unilateral contract involves one promise, followed by one performance, which then triggers a second performance. n  6-3 Express Contracts versus Implied Contracts versus Quasi-Contracts n  An express contract is created when the parties have expressly agreed on the terms. An implied contract is one in which the agreement is reached by the parties actions. The law permits quasi-contracts to be enforceable where one party suffers losses as a result of another party’s unjust enrichment. n  n  6-4 Valid versus Void Contracts n  When a contract has the necessary elements, it is said to be a valid contract. Void contracts are agreements that have not been formed in conformance with the law from the outset of the agreement and, thus, cannot be enforced by either party. n  6-5 Voidable versus Unenforceable Contracts n  An unenforceable contract is one that meets the elements required by law for an otherwise binding agreement, but is subject to a legal defense. Example-the statutory requirement that certain contracts be in...

Nature of Agency

... 2013 Thane J. Messinger, MBA, JD, ALM Abstract This paper will present an analysis of the issues contained in the Nature of Agency video. Quick Takes Video is the defendant in a lawsuit brought on by Non-Linear Pro for breach of contract. Quick Takes Video agreed to a three-month trial of Non-Linear Pro’s editing system that did not meet the expectations of the Quick Takes team or management and did not work how the salesman described it. Hal, the owner of Quick Takes Video returned the system after only one month as it did not perform as guaranteed and therefore did not meet the terms of the lease. Agency “The Restatement (Second) of Agency defines agency as a fiduciary relationship ‘which results from the manifestation of consent by one person to another that the other shall act in his behalf and subject to his control, and consent by the other so to act’” (Cheeseman, p. 459, 2010). The common law theory of one person acting on the behalf of another is represented by the Latin phrase qui facit per alium, facit per se, translated as the one who acts through another, acts in his or her own interests. Contract agency can have multiple players, including the primary, or the person with authority relating to the contract, and agents. Agency can be implied or express. Implied agents draw their powers through implied means. This is usually a power provided through position. This authority is drawn from industry custom, past customer encounters, requirements...

...Commodities Futures Trading Commission on the other hand was created in 1974 to protect individuals, the public and industry players from manipulation, fraud, and potentially abusive practices while at the same time fostering competitiveness, openness and creating markets that are sound (Teall, 2012). There are four basic elements of a contract as Miller (2012) writes. The first important requirement in the formation of a contract is an agreement. In an agreement there should be a party that offers to enter into the legal agreement and another one that accepts the terms of the offer placed. The terms of the contract should contain wording that allows meeting of the minds of both parties that allows them to consciously read and or understand what is in store for them before they can agree mutually to proceed with the agreement. Secondly, a consideration should be made in the value of the actual cost of what is being agreed upon. This consideration can be in the form of love and affection, money (legal tender), goods, services, or any form that the law has a capacity to recognize as a legal way of executing this contract.
