1.2 Miranda Warning and Waiver of Rights
1.2.1 Miranda Warning A. Definition 1. Miranda warning/rights- The Miranda warning or the Miranda rights as it is also known as is a right to a suspect that they can or may remain silent and is given by a police officer in the United States to a criminal suspect when they are in custody (or in a custodial interrogation). Furthermore, these rights or warning is done prior to them being interrogated in order to preserve the admissibility of their statement against them in criminal court or a court of law (mirandawarning.org. n.d.). 2. Waiver of Rights- A waiver of rights is when a suspect waives his or her Miranda warning or rights. Fortunately, in order for a suspect to be able to waive …show more content…
Investigators rely highly on verbal communication during an interview in order to determine if the suspect is telling the truth. Therefore, the often use their verbal communication skills with visual aids such as videos of the suspect as well as audio to determine these factors. B. An interrogator has to determine at what point he or she will start to record the interrogation which is normally done as soon as the suspect enters the room because they want to watch how they react when they enter the room as well as leave the room. Furthermore, all cases are not always videoed but they are recorded by audio and the most serious cases are videoed such as murder. C. Unfortunately, once the recording starts it cannot be stopped because it can be ruled that minutes or even seconds are missing which could mean someone is trying to hide something. Therefore, the entire video could be ruled inadmissible in court. Furthermore, they don’t have to tell you that they are actually recording the interview or interrogation.
1.2.3 Note Taking A. Taking notes during an interview or interrogation can help an interrogator out with any questions they may have because if they use a video recording they can compare their notes with the videoed interview to determine if the suspect was lying during any part of the …show more content…
Furthermore, it is very important to try to write everything you can down because when questions are asked rapidly. The suspect does not have time to think and get their lies in order. Therefore, it is easy to catch them in a lie because they don’t have time to detect that they have told a lie and that the investigator has caught on to their lie. Furthermore, it is also at time very important to have someone else in the room with a good hand writing to take notes for you while you conduct the interview.
1.2.4 Developing a Plan A. An interrogator must always develop a good plan of action before they start their interrogation or interview. This is important because without a plan they are walking into the interrogation room unprepared. B. Always have the question you want to ask written down in order to keep a study flow going this will eliminate the suspect from having anytime to lie and if they do you will be able to catch on to it. C. Ensure that if you are working with a partner that your partner is aware of your plan and follows your plan to the limit so that there is no misinterpretation of what questions are to be ask and how they should be
