...How the Framing of the Constitution Shaped Work in America The Constitution of the United States of America is the overall supreme law for the US Government. The constitution was adopted on September 17th, 1787 by the Constitutional Convention in Philadelphia Pennsylvania and is considered the framework for our government and its relationship between the states and its people (Wikipedia). The Constitution is called the “Sheet Anchor” or “Lighthouse” and ensures Life, Liberty, and Pursuit of Happiness and also serves to protect property rights as well (Beard C. A., The Living Constitution, 1936). With that being said, how did the framing of this document shape the working life in America? Working life in America was shaped by the framing of this document by shifting how work is defined in the colonies based upon need the need for workers to establish more rights and further independence. Since the Constitution was framed and certain amendments were added there have been many disagreements to the actual meaning of the document. There was a widespread perception in the 20th century that the Constitution was framed to represent American Society. That our Founding Fathers acted out of idealism and the laws were established with the best interest of the colonies in mind. It wasn’t until 1913 when Economist, Charles Beard proposed a different scenario. Beard suggested that the Constitution was and economic document that was established for the reorganization of the claim of...

...After entering my food intake for a full day into the WileyPLUS iProfile, I discovered that while my diet appears to be healthy, there are a few dietary habits that could be quite harmful if not addressed. The first step in completing my iProfile Journal was filling out exactly which foods were consumed for breakfast, lunch, dinner, and snacks. A crucial aspect of listing this information is specifying the actual amount of each food consumed. It is important to be thorough when completing this Journal, paying particular attention to anything that may be overlooked, such as mayonnaise on a sandwich, or butter on bread. Upon completion of the Journal, I discovered that my diet was relatively healthful. My calorie intake for the day was 2324 kcal, and with the Daily Reference Intakes (DRI) at 2918 kcal, I consumed 79% of the calories recommended. Although the calories that I ingested from fat fall within the upper ranges of my DRI, it would be a good idea to reduce the amount of fat in my diet, particularly the amount of saturated fat. It is also worth noting that my Omega-6 and Omega-3 fatty acid levels are at 97%, which is important because they can reduce the risk of heart disease. According to my iProfile, I am consuming the appropriate amount of carbohydrates, which is important for energy. The amount of cholesterol that I have in my diet is lower than my DRI suggests, which will hopefully lower my risk for clogged arteries, which can eventually lead to cardiovascular...

...Danielle Murray Saint Leo University MBA 530 – Conflict Resolution Dr. Cecile T. Massé, Ph.D. April 10, 2014 Assignment #2 Abstract Conflict is something that comes up every day whether at home, work, school, or out running errands. There is no way to escape conflict. We must find ways to resolve the conflict; otherwise, life will be miserable and stressful. In this paper, I will be discussing the types of conflict, approaches to conflict resolution, and how to deal with conflict. Introduction We resolve conflicts every day without even realizing it. It can be something as small as arguing over what color the sky is to something as major as a car accident. Everyone deals with issues that come up in different ways. Nelson & Quick (2013) defined conflict as “any situation in which incompatible goals, attitudes, emotions, or behaviors lead to disagreement or opposition for two or more parties” (p. 472). Resolution was then defined as “a decision or determination; the act determining an action or course of action, method, procedure, etc” (“Resolution, 2014). In 2013, Ome summed up conflict resolution as “a variety of approaches aimed at terminating conflicts through the constructive solving of problems” (p. 5512). Types of Conflict Nelson & Quick (2013) broke down the types of conflicts for us to better understand and distinguish. Functional conflict is a healthy, constructive disagreement between two or more people (p. 472). It can produce more ideas and build...

...Superior Supermarkets Memo Memorandum To: James Ellis, President of Superior Supermarkets CC: Randall Johnson, District III Manager of Superior Supermarkets From: Matthew Clemente RE: Potential Everyday Low Pricing Strategy Date: April 9, 2010 The challenge presented to the President of Superior Supermarkets James Ellis and his district manager Randall Johnson is whether or not to implement an everyday low pricing strategy to the Superior Supermarkets stores in Centralia, MO. Superior Supermarkets’ current pricing strategy is a high-end branding strategy, giving them the highest prices in Centralia. With their declining market share the past seven years (they currently have 23% market share in 2002, down from 31% just three years ago; see Exhibit 2) Superior Supermarkets looks to increase their rising revenues from the past three years (Exhibit 4), regain their past successful market share and maintain their already successful contribution margin. To accomplish these three goals, there are several alternatives that Superior Supermarkets could employ to help them retake the market in Centralia. The three locations of Superior Supermarkets in Centralia certainly give them precedence in location, but their market share should certainly be higher with the various options of location they give their customers. However, customers in Centralia are certainly price-sensitive and a new pricing strategy must certainly be considered to give Superior Supermarkets the...

...a) On this part, Arturo would want to argue that he had the right to remain in UK as a worker (Art 45 TFEU). Since Arturo has been in UK in 2009 and Romania joined EU in 2009, he would then fall under Directive 2004/38, which entered into forced on 30 April 2006. Throughout the time Arturo in UK, he had worked as a rowing trainer for two years (assume started from 2009 -2010) which he had now been taken off and be a part time fitness trainer. By adopting the rule laid by the judge in Case 66/85 Lawrie-Blum, as long as Arturo satisfy the essential characteristic of a worker, namely that he is performed a service for or under the direction of another in return for remuneration during certain period, there is a great possibility that Arturo would fall under the concept of the worker. The concept of worker had been defined widely. Arturo would still be consider as a worker, irrespective that he received less than the minimum wage (Case 53/81 Levin and Case 139/85 Kempf), or that is was a part time job), or even he received social benefit (the case of Kempf) provided that he had conduct an effective and genuine” work (Case 53/81 Levin). Arturo would also need to consider the case C-10/05 Cynthia Mattern and Hajrudin Cikotic v Ministre du Travail er d, arguing that the his training period by becoming a rowing trainer since 2009 may be regarded as practical preparation directly to his actual pursuit of a professional rower, and should not be consider as a bar of his application of...
