While mental illness and insanity are both considered an illness, mental illness refers to a wide range of mental health conditions — disorders that affect your mood, thinking and behavior. Examples of mental illness include depression, anxiety disorders, schizophrenia, eating disorders and addictive behaviors. Insanity is a mental illness of such a severe nature that a person cannot distinguish fantasy from reality, cannot conduct her/his affairs due to psychosis, or is subject to uncontrollable impulsive behavior. The second prong of the M’Naghten rule is “knowledge of right and wrong”. Rational and guilty - Rational and Guilty had the mental capacity to understand that what he was doing was wrong and was convicted of his crime. Guilty but insane – this is when a person is guilty but pleads insanity. At the time of the incident, the person knew what they were doing was wrong, and made the concise decision to do it anyway. However that same person can be determined insane. Not guilty by reason of insanity – this is when a person did commit a crime, but they done it while they were not in their right state of mind.
