Case Overview
Acme Corporation is working on a technical breakthrough for a new high tech product in the marketplace. The project appears to be in the development stage. If the product can be launched within the next four months, Acme expects to dominate the market for at least a year.

Acme Corporation uses a project management methodology for all multifunctional projects that includes six life cycle phases. Each life cycle ends with a phase exit review meeting with the appropriate stakeholders and project sponsor.

The project manager and project sponsor held a meeting at the end of the second life cycle phase to review the detailed plan and identify any future problems. Their discussion circled around a ‘Risk Management Plan’ presented by the project manager to the project sponsor.

The project sponsor expressed concerns about the large quantity of risk events that were uncategorized, lack of probabilities and expected outcomes, the time and money spent thus far in generating the risk events, and future budgetary issues to support the ongoing effort. In addition, the project sponsor inquired as to what type of guidance was provided, if any, by a project management methodology. The project manager responded to the project sponsor’s inquires and as such the core issue became apparent from their short exchange.

Detailed Solutions to Zeus Opticals Acme Corporation

We first compute the total number of hours as [(16,000 eyepieces × 1.5 hours/unit) + (20,000 binoculars × 1.9 hours/unit) + (3,000 lens× 2.1 hours/unit)] = 68,300 hours. We then find the overhead rate by dividing the total overhead of $1,161,100 by the 68,300 total hours. In turn, the amount allocated to each eyepiece is 1.5 hours × $17/hour = $25.50, and so forth. b. Business Law Final Paper

...Final Paper – Acme Fireworks As the manager for Acme Fireworks, I have been asked to determine if common law or the Uniform Commercial Code (UCC) will govern the contracts entered into by Acme Fireworks. In addition, I am to analyze whether the five essential elements of a contract have been met. Acme Fireworks is currently licensed as a sole proprietorship. As such, I will examine any potential personal liability they may have if a spectator was to get injured during a firework display. Further, I will compare the different employment types available to Acme Fireworks. Lastly, I will analyze and recommend a new business entity that would fit the needs of Acme Fireworks going into the future. Governed by Common Law or UCC Common law “emphasizes the making of rules through court decisions” (Rogers, 2012). The court will base their decisions on prior cases with similar legal issues. The Uniform Commercial Code (UCC) is “a summary of traditional common law rules governing commercial transactions” (Rogers, 2012). Since the UCC governs contracts between businesses, I believe that the UCC would be the organization that would enforce the contracts between Acme Fireworks and the other large businesses. Five Essential Elements of a Contract A contract is formed when two or more parties come to a mutual agreement regarding the terms of the sale of goods, services rendered or any other legal transaction (Rogers, 2012). The first required element of the contract is that it is...

Acme Fireworks Analysis

...Acme Fireworks Analysis When the determination has been made to change a business’s entity it is important to understand what entity would be best suited for their business needs. Acme Fireworks is a sole proprietorship that is growing fast, the owner is considering changing the business entity. The decision that needs to be made is which entity will best suit their advancing needs. Acme Fireworks can choose between three entities: a partnership, corporation, and limited liability company (LLC). There are pros and cons for each of the different entities. When taking into account the current personal liability, if the contracts already in place are valid, employment needs to fulfill the large orders, and defining the different types of entities, my recommendation for Acme Fireworks would be to become a corporation. Just about everyone in the United States has some personal experience with fireworks, either from Fourth of July or New Year's Eve celebrations. Fireworks have always been dangerous and have caused, and continue to cause, serious and tragic accidents. Every year injuries both minor and major are caused by fireworks. Potential personal liability for injuries to consumers caused by the firework products is inevitable. When the firework explodes, it can send out many burning hot embers, or if it is positioned in the wrong place it can set houses or nature on fire. Fireworks can even be a dangerous weapons in the hands of vandals. However, not all mishaps due to fireworks...

Bus311 Keys to a Successful Business

...starting and running a fireworks business, one of the most often asked question is “What tools are required to run a successful business”. Fireworks themselves are serious business and to start and successfully run a fireworks business is not as inherently easy as it seems. This paper will attempt to explain potential personal liability for injuries sustained by consumers when using this product incorrectly. It will also analyze the formation of a contract between Acme fireworks and several large retailers inquiring about Acme Firework’s Company’s ability to fill large orders on a regular basis. Along with that, it will also analyze the different employment types and finally recommend a new business entity based on the facts provided. Being personally liable for injuries to consumers who use Acme’s products can be best summarized as in the event a consumer is injured while utilizing Acme’s products, should they win the case in court , the judgment or settlement can be satisfied out of the personal assets of the owner of Acme Firework’s Company. “Strict liability, called liability without fault, means that manufacturers, distributors, wholesalers, retailers and others in the chain of distribution can be held liable for damages caused by a defect-regardless of whether or not they are at fault” (Buckley, S. , Monaco, F. , 2009). Fireworks have long been an American tradition. From New Year’s Eve to the 4th of July, fireworks continue to captivate audience members with their dazzling...

Bus 311 Final Paper

...Final Paper Jason Rhone BUS311: Business Law I Professor Timory Naples 11 Aug 2014 Final Paper Acme Fireworks has came a long ways in the past 15 years and thus has accepted some changes that will be challenging. If the large orders do not continue, the company will not have the funds to pay the new employees. Acme Fireworks should expand to a larger business entity because expanding to a larger business entity will allow the company to negotiate larger contracts with other companies, and the company will never reach its full potential until it has expanded to a larger business entity. Consumers are commonly the victims of mishandled fireworks. There are various ways that fireworks can be mishandled, such as: lighting fireworks improperly, lighting fireworks too close to others, or lighting the fireworks while still holding them. Fireworks can have dangerous affects, whether handled properly or improperly. Fireworks are also capable of being manufactured improperly. Acme Fireworks seeks desperately for consumers to avoid risk while handling fireworks. There are warnings and directions attached to every firework package that is available for purchase. Acme Fireworks requests that all consumers to read the warnings and precautions before use. Never allow children to use fireworks without adult supervision. Only use fireworks outdoors, away from houses and fire hazards. Never try to reignite used or malfunctioning fireworks. Always keep a bucket of water nearby for...

I will help him do so by explaining each entity and how they relate to his business situation. I am the manager of Acme Fireworks, a fireworks retailer who sells fireworks, puts on ground display fireworks, and large aerial display fireworks. The company started in the owner’s garage two years ago and now has 15 employees that you manage. The company started as a sole proprietorship, and the owner has never changed the entity. The owner has informed me that the company has received inquiries from several large businesses wondering if the company could create several fireworks displays on a regular basis. The owner told the inquirers that the company could fill such display orders, and a price per display was agreed upon. It was discussed that most of the cost for a fireworks display is for skilled labor, insurance, and the actual service of setting off the fireworks. No other details were discussed. The owner is anticipating that new employees will need to be hired, but he is worried that if the large orders for fireworks displays do not continue, the company will not have the funds to pay the new employees. The owner is now considering changing the business entity, but he...

Acme Fireworks

...Acme Fireworks Name Course Instructor Institution Date of Submission Acme Fireworks Business Contracts The business contract is considered as the common legal transactions most business people get involved to ensure the activities run smoothly. When a person understands the contract law, he/she is good to create a sound business agreement. However, the agreement would be legally enforceable in case something bad happens. As the manager of Acme Fireworks, I was requested by the owner to determine which law between common law and the Uniform Commercial Code (UCC) will govern the business. According to Sheleff, (2013), the common law controls the majority of contracts that include intangible assets, employment, real estate, services, and insurance. On the other hand, the Uniform Commercial Code (UCC) governs contracts for the securities and sale of goods (Meiklejohn, 2008). Therefore, the contract between Acme Fireworks and the retailers would be governed by Uniform Commercial Code (UCC). There are various articles in the UCC and specifically, Article 2 deals with the transaction of goods. The statute in the article stipulates precisely the regulation of sales to consumers and other classes of buyers. Acme firework is a retail outlet that deals with the sale of fireworks and also displaying them. It will enter into a contract with other large businesses to produce large quantity on a regular basis, and it would...

During expansion, it must evaluate its position and its future potential and make decisions as to the structure and operations of the company, current and future obligations, its risks, the kind of workforce that is necessary, and how to implement this body of people for maximum effectiveness and profits. Acme Fireworks is no different. Acme Fireworks is a fireworks retailer and display company that has grown from humble beginnings in a garage to 15 employees in the last two years. It is a sole proprietorship. But the company is experiencing an increase in sales and interest. The company is also exploring the option of expanding into fireworks displays for venues as several local businesses have made inquiries about supplying such a service. This may facilitate future growth, but how? The owner is asking the manager to explore and recommend options. Of particular importance, the owner of Acme Fireworks has been in preliminary negotiations with business customers inquiring about large fireworks displays.
