Abstract Affirmative action has been deemed as one of the most ground breaking accomplishments of the Civil Right Movement. Affirmative action has allowed a lot of children to be able to pursue dreams that they never thought would permissible. Racial discrimination has been an ever going trend here in the United States and in other countries for hundreds of years. Women and minorities are some of the leading people in this world who suffer the most from racial discrimination. By implementing affirmative action in all areas of our lives this world would come together and allow people to get to know people they wouldn’t have known because of the color division in this country. Students who are start at a disadvantage in school are given a boost to succeed with affirmative action. Affirmative action creates diversity in the workplace and in society. Affirmative action is needed to break stereotypes. Affirmative action is not reverse discrimination.
A society can be color blind if they would learn how to base their decisions on character and not on color or gender. Affirmative action does not help a disqualified person move up in life if they do not have the skills need for the job they are doing.

Introduction Racial discrimination has been around for thousands of years and the time came for some changes to be made in the United States. Affirmative Action was one of the plans set in place to help level the playing field for all Americans who had been discriminated against and give them an equal break in the work place and in colleges. Affirmative actions does not guarantee equal results for everyone but it was put in place by the American People, and it helped to uphold the laws that government tried to put in place regarding civil rights. Although some people argue that affirmative action is no longer necessary, the statics shown today present something totally different. The Newser (2013) reported that for every dollar that a man makes a woman only make 76.5 cents, African American women only make 64 cents, and Hispanics females make 57 cents.
Background of Affirmative Action
Affirmative Action is the set of public policies that were put in place to help eliminate past and future discrimination that was suffered by minorities based on race, religion, color, sex, and national origin. These public policies were already set in place by the Civil Rights Act of (1964), but were expanded by the Executive Order 10925 (1961). This order was first brought in place by John F. Kennedy in 1961 and the word “affirmative action”, was geared towards federal contractors to “take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, creed, color, or national origin (Leadership, n.d).
Why Affirmative Action was introduced This new form of policy allowed people of color, white women and working class women and men of all races who previously were excluded from jobs and educational opportunities to be able to pursue their goals. The decision laid down by the Supreme Court on the case of Brown v. Board of Education (1954) help to establish that the separation of schools for African Americans and Caucasians was unconstitutional. Lyndon Johnson was the President to actually make this Affirmative Action order come full circle in 1965. The Equal Opportunity Commission was also established to help protect the rights of minorities and women in their pursuit of being able to work and make livable wages. Women and minorities have been able to advance more in the workplace due to the implementation of Affirmative Action. African American women have increased in federal contractor jobs, by 3.9 percent and Caucasian women have advanced more than African American women by 7.3 percent due to the implementation of this policy. Affirmative Action has allowed for a more diverse workforce and allowed these minorities to obtain more management, professional, and technical positions.
Where Affirmative Action is applied
Affirmative Action has helped many women and minorities attend colleges and institutions that they normally would not be able to get into. On January 1997, the University of California adopted the Regents Resolution which deemed this institution would not use race, color, ethnicity, national origin, or sex as criteria for the admission to any of their programs of study. It is great to see that strides are still being made to help all people to be able to attend the colleges of their choices in spite of the discrimination that still exists in the world today. Federal government agencies lead the way in making sure that minorities and women are given the equal chances of employment that men are given in the workplace. The United States Department of Labor is a stickler for making sure that all of the laws regarding affirmative action are being carried out by any agencies receiving any type of government money. The Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) enforces the Executive Order 11246 (1965) “which bans discrimination and requires contractors and subcontractors to take affirmative action to ensure that that all individuals have an equal opportunity for employment.” Many minorities have been able to gain access to large construction contracts because of implementation of this order and many women have gotten off of welfare due to the outreach programs that the Department of Labor implemented.
Who has implemented Affirmative Action? Even though quotas have been outlawed in the United States, they are still being used in some countries to help further the playing fields of job opportunity. In Europe, women are moving up quickly in the male dominated society, there is legislation that allows women to hold 40% of the non-executive board director jobs. In Asia there is Affirmative Action for minorities which has helped to lower the entrance exams requirement and set quotas for ethnic minorities and some students pay no tuition and are provided scholarships. In Africa since Apartheid has been abolished affirmative legislation has been on a very slow trek. African children are still going to school in poor townships, jobs are still dominated by whites, and those jobs that Africans do get are held by the black elite (Vongs, 2003). Israel has had made strides that have allowed minority students to be able to enter the most selective schools regardless of their class status or their ethnic origins.
Who is for and against Affirmative Action? There have been many arguments for and against affirmative action which has made it difficult to be able to overcome the effects of past discrimination and eradicating the effects of this fatal view. Justice Clarence Thomas has gone on record to say that affirmative action is on the same level as the Jim Crow laws of the south. One of the pioneer civil rights groups who have fought for democracy for all people has been The Leadership Conference. This civil rights group was founded in 1950 has been the back bone of helping to get congress to pass The Civil Rights Act of (1957), The Civil Rights Act of (1964), The Voting Rights Act of (1965) and The Fair Housing Act of (1968) (Civil Rights, n.d., p.1) There have also been several states to be against affirmative action, these states are California, Washington, Nebraska, and Michigan, these states have set about systematically to put in propositions that would allow colleges to admit students based on color, sex, and national origin. The Association for Affirmative Action is a non-profit organization founded in 1974 to help its member be more productive and successful in their careers. This organization helps to its members by working with state, city and local agency’s to help foster more effective affirmative action programs.
The Advantages of Affirmative Action Affirmative action puts in place the laws that will help to eliminate prejudice in the workplace and in schools. When people are made to eliminate prejudice in their society then they are able to learn tolerance for other cultures and ideas that are not like their own. Affirmative action also helps disadvantaged people who travel across the country to other places they normally wouldn’t be able to get employment and schooling and succeed. Affirmative action helps to level the playing field due to the years of oppression brought about in this bigoted society. When minorities are allowed to prosper in areas that they were not able to before it helps to bring them and their families out of poverty.
Disadvantages of Affirmative Action
Affirmative action can at some point bring about stereotyping and racism because of the history of how it was established. People are sometimes put in jobs they cannot do and are not qualified for because of affirmative action. When people are given an opportunity because of the color of their skin or gender they are looked at as being of a lower class of people. Affirmative action can also be seen as reverse discrimination, because, no minorities are not included in this action. All people are looked upon in the United States Constitution as being equal and should be treated as such. When people are put into jobs that they are not capable of doing or handling it lowers the standard of accountability.
The Current Status of Affirmative Action The current status of affirmative action is still in debate in the legal system all over the country. The U.S. Supreme court recently heard a case Fisher v. University at Austin, where a white female student was denied admissions based on her race. Courts are skeptical today about affirmative action being used as reason why one is not admitted into a college or university. Those who favor affirmative action programs say that race divisions still exist in this country, 45 years after the civil right movement. One big disadvantage for affirmative action today is that The Supreme Court case law is still unclear, there are no bright lines or clear guidance on how to deal with this ever growing problem. We would like to think that there is an equal playing field in the job market today, but look at the present condition of the United States and one can tell that affirmative action still has not helped people of color or non-minorities. Affirmative action gave us an African American President, but if you go into Wall Street today, you wouldn’t see a lot of African Americans, or women working there.

Recommendations
Proper leadership in a country is one of the best things that will help to level the playing field for all Americans today whether they are minorities, or non-minorities. Race being used as the foundation for affirmative action has been an inadequate weapon in fighting against inequality. We must as a people heal our society as a whole before we able to see past color and gender in order for people to be treated right equally. Self-segregation takes away the educational benefits needed for our children in learning how to live and deal with children of different cultures. I highly recommend that people be judged by their character and not their status or color in this society. In the court systems, law makers should be able to tell the difference when injustices are being put upon people based on who they are and not what they have done. Learning starts at home and we should be teaching our children the right things in life so that affirmative action never has to come to play in their lives in order for them to survive.

...“To what extent are Affirmative Action programs no longer needed in the United States?” Affirmative Action is a policy in the United States that “aims to enhance educational and career opportunities for minorities and women by granting them preferences in college and graduate school admissions, promotions, and contract awards.” (Boxill) Such programs are designed to ensure that qualified individuals in America have equal access to opportunity in areas such as education and employment, and receive a fair chance to contribute all their abilities. As T.H. Andersen points out: “Supporters declare themselves the champions of racial justice, protectors of Martin Lurher King’s Dream, while the opponents see themselves as the defenders of merit, of colorblind equal protection enshrined by the U.S. Constitution.” (Anderson Preface X) Therefore, although at first these programs were considered a huge success, many argue that Affirmative Action has been out dated and is not working anymore. Affirmative Action has served its purpose, and is no longer needed and should be abolished or reformed, as it will no longer be useful in helping eliminate the racial gaps in the United States.
