Following the succession of testimony on behalf of both the defense and the prosecution, the court denied Mr. Fernandez’s call for the suppression of all evidence found in the apartment, due to the fact that the court believed that the police acted appropriately. The court also found that Ms. Rojas was not coerced, maybe pressured, but not forced to give consent to the police. The jury found Mr. Fernandez guilty of all counts and he was subsequently sentenced to 14 years. Mr. Fernandez, believing that his 4th amendment rights had been violated, appealed to the court, citing the decision in Georgia V. Randolph which states that “the police may not make a warrantless entry of a home despite an occupant’s consent to search where a physically present co-occupant objects to the search.” Fernandez petitioned for review to the California Supreme Court, which denied his petition. Fernandez and his attorneys have somehow gotten around the lower courts, however, and now we are here at the supreme court. Constitutional Issue: The Supreme Court will have to decide whether it is constitutional for the Police to conduct a search on a home if an objecting party is no longer present, and a co-tenant gives consent. Can a cohabitant of a home give police consent to enter if the other owner objected previously, but is no longer present?
