This is a rebuttal to an article written by Marlena Baldacci on August 14, 2013 titled Baby 'Messiah' needs a new name, Tennessee judge rules. Earlier this month a Tennessee judge took it upon herself to order a young mother to change her baby boy’s name from Messiah to Martin. Jaleesa Martin and her son’s father were having a difficult time agreeing on a last name for Messiah, which is the reason they were in Cocke County Chancery Court on August 12, 2013, for a child support hearing.
Lu Ann Ballew a Child Support Magistrate who serves the 4th Judicial District of Tennessee and other counties nearby was presiding over the hearing. Messiah’s name change was part of the Judge’s case; however, the parents did not expect the first name to be changed. Judge Ballew ordered the name of the 7-month-old baby to be "Martin DeShawn McCullough" (Baldacci, 2013). The judge included the last names of both parents however, she left out Messiah. "The word Messiah is a title and it's a title that has only been earned by one person and that one person is Jesus Christ" Judge Ballew said (Baldacci, 2013). Jaleesa responded by saying, "I was shocked. I never intended on naming my son Messiah because it means God and I didn't think a judge could make me change my baby's name because of her religious beliefs" (Baldacci, 2013). When reporters asked the judge about common used name Jesus, she replied “that was not relevant” (Baldacci, 2013). The reliability, credibility and validity of the data.
Judges of the United States take oath or affirmation before performing his or hers duties in office. They promise to faithfully and impartially discharge and perform all the duties under the Constitution and laws of the United States. They also, instruct juries to decide cases without "prejudice, sympathy, fear, favor or public opinion" (Lavin & DiMichele 2013). In this case Magistrate Ballew missed the mark. The Judge used her religious beliefs instead of facts, which allowed her personnel opinions to persuade her decision including, breaking her oath to up hold the Constitution by denying the parents the right to name their child. In one’s opinion diminish her reliability and credibility. Her validity of the data I destroyed by assuming the child will be at odd with an entire county because of the Messiah. Well in fact, according to U.S. Social Security Administration statistics, Messiah was the fourth-fastest growing name for boys in the United States from 2011 to 2012. It ranks at Number 387, between the decidedly traditional names Scott and Jay. The logical fallacies in the argument
The Judge remarked that she had his best interest in mind was clearly untrue. Her ruling was basis on personal interest and bias rather than on the well-being of the child. The fact that she believes the word Messiah can only be a title whereas the name Jesus share no relevancy demonstrates flaws in her reasoning.
