scene 1: nagaaway si awiyao at lumnay sa bahay.

L: why can’t you just forget about the disgrace that you keep talking about and for once just focus yourself on loving me! I don’t accept this because I did everything to keep you happy with me! I have done my best. I have prayed to kabunyan and sacrificed many chickens and pigs just so that we can be blessed with a child.
A: What do you want me to do??! I don't feel like a man and you just let me feel that way??!
L: I don’t know but there must be some way…..
A: (sighs) I love you lumnay but if we can’t bear a child then I have to…..
L: you have to what?!
A: (does not speak)
L: you have to what awiyao?? Tell me!

PS: after this scene magshoshoot kayo ng scene na nakaupo lang sa isang tabi si lumnay nakatulala tas magflaflasback sa kanila ni awiyao na pinagluluto niya si awiyao pero hindi na kinakain ni awiyao yung luto niya. Niyayaya niya magsex si awiyao pero ayaw na din niya. Basically nawawalan na ng gana si awiyao kay lumnay. After ng flashback iiyak ng malalim si lumnay. yung nageedit na bahala sa lahat ng kelangan niyang gawin I assume.

Scene 2: yung magpapaalam si awiyao na lalakbay siya sa malayo at matatagalan siya makauwi.
A: lumnay. I will be going to a far place. I won’t be back for a long time.
L: why awiyao? Where are you going?
A: I will be going to the next barrio. I will work there to expand more our land so that we can have more harvests for the coming years.
L: but we have plenty of lands here in the barrio. Why do you need to expand more?
A: I want to keep myself busy so that the pain of us not bearing a child might go away.
L: so what is this? Are you trying to leave me because of that reason?
A: I just want to get my mind straight. And the only way to do that is to work even harder to keep myself busy.
L: but that will not change the fact that we cannot still bear a child.

Scene 3: lalakbay si awiyao papuntang ibang barrio para magtanim at mangaso at dun niya makikilala si madulimay.
PS: yung arte ditto is habang nagtatrabaho si awiyao makikita niya si madulimay nagtatrabaho din (kayo na bahala kung anong tabaho ginagawa ni madulimay dito). So biglang lalapit si awiyao para magpakilala.
A: hi miss. I’m awiyao of bondoc province. I came here to this barrio to expand my land and to work.
M: hi mister. I’m madulimay. I am a resident of this barrio. How are you?
A: (nakatulala lang kay madulimay ng matagal)
M: is there a problem awiyao?
A: oh! There is no problem. May I just say that you are a very beautiful woman madulimay.
M: thank you awiyao. Do you want a glass of water? I will fetch some in my house for you.
A: I would love that madulimay. I’ll walk you to your house.
After nun maglalakad hanggang papunta sa bahay ni madulimay.

M: awiyao. I have something to tell you.
A: (while working) what is that madulimay?
M: I am pregnant.
A: really that’s great! (It means that I was not the one who has he problem in not bearing a child. pabulong.) Then let us get married madulimay. I want to make you my wife and raise many children with you. I love you.

Scene 3: yung hahanapin na ni lumnay si awiyao at eventually mahuhuli na niya sa awiyao at madulimay.
L: have you seen awiyao? It’s been 2 months and he has not yet come home. I’m starting to get worry.

So si lumnay pumunta sa barrio nay un at dun niya nakita na kasama ni awiyao si madulimay. Yung arte nila awiyao nagtatrabaho si awiyao habang pinupunasan siya ng pawis ni madulimay. So lalapit si lumnay sakanila at magwawala at magagalit kay awiyao.
L: how dare you! You said your purpose of leaving was only to expand the land you own! How could do this to me?
L: and you! (points at madulimay) you snake! Why are you flirting with my husband? Did he not tell you that he has a wife??
Si lumnay susubukan niyang saktan si madulimay pero pipigilan ni awiyao si lumnay.
A: Stop hurting her!
L: why? Why are you stopping me? What is your relation to her? What awiyao???
A: she is my wife! And she will give a child soon. Something that you can never give to me!
L: what? So something happened to you both? How? How could you do this to me! I love you and you decided to hurt me why?
A: like I said. As a man I am a disgrace if I do not bear a child. I need to bear a child. And now I do. Unfortunately not with you.
L: so what will happen to me?
A: find someone else. Find a man that will love you more than I did. I’m sorry lumnay but between us is no more. I love madulimay and we will bear many children and be a happy family.
L: I will not find another man! But this is not over awiyao. I will not accept this!

Mock trial: clerk: All rise. [Wait for everyone-except the judge- to stand. Department one of the Superior Court is now in session. Judge (first name) presiding. Please be seated.
Judge: Good morning, ladies and gentlemen. Calling the case of the Lumnay mangayao versus awiyao malumay Are both sides ready?
Lawyer ni lumnay (LL): yes your honor
Lawyer ni awiyao (LA): yes your honor
Clerk: Will the jury please stand and raise your right hand? [Wait for everyone to stand.] Do each of you swear that you will fairly try the case before this court, and that you will return a true verdict according to the evidence and the instructions of the court, so help you, God? Please say “I do”.
Awiyao, Lumnay, Madulimay: You may be seated.
LL: [Stand up and talk to the judge.] Your Honor and ladies and gentlemen of the jury: Awiyao has been charged with the crime of concubinage which refers to sexual acts between a married person and someone who is not that person's spouse and bigamy which is the act of entering into a marriage with one person while still legally married to another against his wife lumnay. these facts that I will present further will prove to all of you that he is guilty of such crimes.
LA: [Stand up and talk to the jury.] Your Honor and ladies and gentlemen of the jury: under the law my client is presumed innocent until proven guilty. During this trial, you will hear no real evidence against my client. You will come to know the truth: that my client is innocent from the said crimes that he is accused of.
Judge: The prosecution may call its first witness.
LL: we call for Awiyao Malumay to the witness stand. [awiyao takes the witness to the witness stand.]
Clerk: Please stand. Raise your right hand. Do you promise that the testimony you shall give in the case before this court shall be the truth, the whole truth, and nothing but the truth, so help you God?
A: I do.
Clerk: Please state your first and last name.
A: I am Awiyao malumay
Clerk: You may be seated.
LL: [Stand up.] where are you from?
A: I am from bondoc province.
LL: it is where lumnay’s from. Am I right?
A: yes sir.
LL: so is it true that you and lumnay are married in your tribe?
A: Yes.
LL: is it true that you had a conflict with lumnay, what was that all about?
A: Yes. It was all about us not have a child. As a man in our tribe it was a disgrace for us to not have a child. It’s been 7 years and not a single child was born. We were arguing about that because we needed to have a child so that the child can be the successor for all the ands we owned.
LL: did you hurt lumnay physically while having that argument?
A: no sir. I would never hurt her physically.
LL: so after that argument. What happened next?
A: after the argument. I went outside and did a lot of thinking and decided to just work harder so that I can forget my frustration about not having a child.
LL: and that is why you left to go to another barrio?
A: yes sir. I have said to lumnay that I wanted to expand my land and work so that I can forget about our problem and that it will take a long time for to come back.
LL: and then what happened after you went to the lam – ang barrio?
A: I work in the fields and tried to own some land for my expansion.
LL: and when did you meet madulimay?
A: when I saw her working also in the field sir.
LL: so you don’t deny that.
A: no sir.
LL: so what happened next?
A: I introduced myself to her and we got to know each other. She we very caring towards me at the time I was working in the fields of their barrio. Shee took care of me like a good wife even though she was not yet my wife. That is why I fell inlove with her and thank god she also fell inlove with me also.
LL: so after that, you made to her right? And after that you got her pregnant?
A: yes sir, when I got her pregnant I learned that I was not the problem for me and lumnay bearing a child but in fact lumnay was the problem.
LL: so after that, what did you do?
A: I asked madulimay to marry me because she bear our child and I could now start a new life with her.
LL: so you married another person and made love with her without thinking about what lumnay might feel?
A: no sir. But for me the important thing right now is that my child to be born because that child will be my successor in all the lands I own.
LL: I have no further questions your honor.

LA: Not at this time, Your Honor.

LA: we would like to call lumnay to the witnees stand. [lumnay takes the witness to the witness stand.]

LA: because of you not bearing child that will cause awiyao so much digrace by the elders in the tribe because I heard that your tribe required men to have a child for the succession of their owned land. Am I right?

LA: so you could not blame awiyao for re-marrying to madulimay because it is required by your tribe that a man in the said tribe should have a child. And that action itself may justify the actions of of my client.
LA: I have no more further questions your honor.

Article 349 of the Revised Penal Code states:
The penalty of prision mayor shall be imposed upon any person who shall contract a second or subsequent marriage before the former marriage has been legally dissolved, or before the absent spouse has been declared presumptively dead by means of a judgment rendered in the proper proceedings.
The elements of this crime are as follows:
1. That the offender has been legally married;
2. That the marriage has not been legally dissolved or, in case his or her spouse is absent, the absent spouse could not yet be presumed dead according to the Civil Code;
3. That he contracts a second or subsequent marriage; and
4. That the second or subsequent marriage has all the essential requisites for validity
Awiyao is guilty under this crime because he was still married to lumnay when he asks for madulimay to marry him. Thus their marriage is null and void from the very beginning.
Also, the law provides:
Art. 334. Concubinage. — Any husband who shall keep a mistress in the conjugal dwelling, or shall have sexual intercourse, under scandalous circumstances, with a woman who is not his wife, or shall cohabit with her in any other place, shall be punished by prision correccional in its minimum and medium periods the concubine shall suffer the penalty of destierro.
Judge: after further and thorough investigation of this case. We find the defendant, awiyao malumay guilty of vote charges and shall pay damages to lumnay amounting to P1, 000,000. The jury is thanked and excused. Court is adjourned.
