The purpose and plan of this essay I will start this essay with a first review of the background of maritime liens and their definition. After this, I will examine why there exist conflicts of law in maritime law. My purpose of this essay is to compare two states that are very different in their domestic maritime law in respect of maritime liens and the differences in recognizing foreign maritime liens. I have chosen to compare the domestic law in the United Kingdom with the United States because I feel that they are managing conflicts of law very differently from one another and I want to get a deeper knowledge in these states law. The American court recognizes foreign maritime liens while the United Kingdom do not; they apply the lex fori (i.e. their own law). This had caused a huge uncertainty in the right of the international ship suppliers. Because the states is so in-cohesive in this area of law I thought it would be interesting to compare these and see how they handle conflicts of law. I will bring out the weaknesses in the different systems and also the positive things. Finally, after this comparison I will...

...We have decided to discuss the basis for conflict in the on-going Libyan civil war. The three bases for conflict in Libya have been identified as political, social and economic. Political Politics in Libya has been dominated by the figure of Muammar Gaddafi since the late 1960’s. Gaddafi's government has responded explosively in relation to attacks against them from the Rebel government. He has established himself as a powerful military dictator with control over nearly all aspects of Libyan life (Asser, 2011). The first signs of action from Libyan rebels attempting to bring down Gaddafi appeared to the world on television in February 2011. By re capturing key oil facilities and by resisting to accept partition, the war is escalading and going against the choice of the people (TIME, 2011). Social There constant extreme fighting is occurring in the western part of Libya, Misrata, corrupting people’s lives every day. air strikes and on gong fighting in Lybia means there is a big increase in the number of casualties in hospitals, putting great stress on the health system. Soldiers loyal to Gaddafi along with African mercenaries have been terrorising the people of Libya. Gaddafi continues to insist that al-Qaeda is behind the uprising and has used heavily artillery against the lightly-armed civilian rebels. (Butters, 2011) Economic The authoritarian regime of Colonel Gaddafi is reflected in corruption and bribery throughout Libya’s oil rich economy. Libya was made a very...

...Ghraib was a symbol of death and torture. That same prison became a symbol of disgraceful conduct by a few American Troops” (Asser). With the fall of Saddam’s regime, the United States gained control of the prison because they needed a protected area to keep Iraqi’s who were suspected of assisting Saddam from hiding during the American occupation. Outside the walls of this prison, it seemed to have an acceptable reputation; however, many did not know what happened behind the walls. People that were put in charge of running the prison were not well prepared to serve that position which lead to many problems throughout the prison, including failure of leadership, failing to ensure that officers were properly...

...The Theory Why and When Companies Should Diversify Christine Porter Financial Management Dr. Morrison February 24, 2015 What is Diversification? It’s a technique that reduces risk by allocating investments among various financial instruments, industries and other categories. It aims to maximize return by investing in different areas that would each react differently to the same event. Although diversification does not guarantee against loss it is the most important component of reaching long-range financial goals while minimizing risk (investopia.com). Simply put, diversification can reduce risk. Using diversification as a strategy will help to develop a business in entering new production lines, or markets, and reduce the risk by spreading investments. However, can a business reduce its risk with the appropriate diversification techniques, and when is the right time to diversify, or not. We will begin to explore the ideology of diversification. Through diversification some risks can be eliminated, however no matter how much you implement diversification, businesses never reduce their risk down to zero. (Financial Management, Principles and Applications, Chapter. 8, pg. 221). Looking closer at the concept of diversification, the idea for a business, or investors is to create a portfolio that will include multiple investments in order to reduce risk. For example, Everything But Water sells swimwear, during...

...Match-Fixing: the Culprit of the Loss of Integrity in Italy’s Football Leagues Roxanne Teacher: Dee Submission Date: 31/08/2015 Abstract The purpose of this report is to reveal that match-fixing has occurred in Italy over the past decade and to explain whether the measures taken by Italian government reduce football corruption. Resulting from high profitability and domestic-owned football structure, match-fixing has become an enormous problem. This report also demonstrates two match-fixing scandals in 2006 and 2011, which mechanisms are pursuing sportive and economic results, respectively. According to the European code of conduct, the manipulation of match-fixing is unethical. To protect the integrity of the sport, the Italian government punish the perpetrators heavily and investigate the criminal organisations privately. Owing to this contribution, corruption decreases significantly. Therefore, a conclusion that under the government’s help, Italy football matches achieve its integrity can be made. It is recommended that by increasing the punishment level for the perpetrators, educating football players and founding a well-sourced security department, match-fixing can be tackled. ...Beirut-based Al Mayadeed TV.” The PLO would reject their recognition of the states of Israel they had previously acknowledged in the Oslo Accords. (Class notes) . The authority over the region, Palestinian self-determination and future negotiations was granted to the PLO. The summits motives are questioned by some people who claim Abbas, the PNC leader, is just trying to lead the PLOs future plans before he dies as he is old. The failure of the Oslo peace Accords to establish a Palestinian state along with the U.S cutting foreign aid to the region, food aid may have led to violence along the Israeli border in Gaza . The second source I will look at is, My Life in the PLO: The Inside Story of the Palestinian Struggle, by Ḥūt, Shafīq, Asser, Martin, Makdisi, Jean Said. Shafiq is former PLO member who gives a unique perspective on PLO actions from 1964 to 1993 when he resigned from the organization. His analysis of the international conflicts and perspectives gives context to the global view of the U.N on the overall PLO decision making process. His inclusion of the international perspective gives a fuller context than Caplan’s mostly two sided narrative on the Israel Palestine conflict. He argues that the main goal of the PLO was to achieve a just peace in the Arab-Israeli conflict, and to build a democratic state in Palestine for all its citizens. The author uses himself as a primary source and his memory and experiences within the PLO. The author recounts how the Israeli’s...

...Essay 1 Muammar Gaddafi, President of Libya, has been praised and blamed for many of his actions throughout history. One incident in particular occurred on 15 February 2011 when peaceful protests began by the Libyan people for the removal of their longtime dictator, Muammar Gaddafi. These protests were met by extreme brutal and lethal force from Gaddafi’s regime. In rage, protesters took to the streets in the thousands, eventually causing an uprising and civil war. In response to his people, Gaddafi claimed that the protesters were under the influence of hallucinogenic drugs and alcohol supplied by foreign countries who were trying to get ahold of the abundance of oil in Libya. He ordered his army to murder anyone who did not “love” him and urged civilian supporters to take to the streets and attack protesters. The Libyan government deployed planes, helicopters, artillery forces, and snipers to eliminate protesters further angering the people of Libya. As time wore on, members of Gaddafi’s government and army were also beginning to turn against the Dictator and his views realizing what he was ordering was unjust. Gaddafi, beginning to feel cornered, hired mercenaries to attempt to halt the protests by executing his own soldiers and people while taking control of hospitals to refuse treating the wounded who were protesting...

...CAN TAKE - OUT FINANCING TAKE OFF IN INDIA?? A Banking Perspective of Take-Out Financing Submitted By: Misha Tyagi, MBA (2010-2012), NMIMS, Mumbai mishatyagi@gmail.com 9970286854 Aditi Kaikini, MBA (2010-2012), NMIMS, Mumbai aditi.kaikini@gmail.com 9833265671 The Infrastructure Sector is of strategic importance to any Country… Because it drives Economic Growth!!! A robust infrastructure not only facilitates expansion of industry & trade, but also directly leads to job creation and a better standard of living. This in turns attracts further investment and growth. However, infrastructure projects are characterized by unique risk profiles that add to the complexity in planning & execution. These risks are --------: Long gestation period Huge financial requirements necessitating loan syndication Contractually Driven, Regulatory & Legal Framework Revenues tied to economic variables Environmental Concerns Infrastructure has these inherent risks which lead to time overruns and increase project costs, but real challenge lies in mobilizing funds for projects. Government had allocated 8.33% of GDP to this sector in 11th Five Year plan, and is likely to increase it to 10% of GDP in 12th Plan. This displays Government’s commitment to augment infrastructure capabilities in India. An increase in project order inflows indicates “demand”, but a paucity of long term funds has come in the way of execution. Thus, RBI has taken...

...RISE OF GADDAFI AND HIS RULE: Muammar Muhammad Abu Minyar al-Gaddafiwas the longest-serving leader in the Arab world. He ruled Libya after he took it over from King Idris I in 1969.Gaddafi was born on 7th June, 1942 in Qasr Abu Hadi located outside the town of Sirte in western Libya. He attended a Muslim elementary school in Sabha. During his schooling, he was profoundly influenced by major events in the Arab world especially the Arab nationalist movement. Egyptian President Gamal Abdel Nasser became his idol. Gaddafi joined the army in the 1960s as a supporter of Arab nationalism. In 1959, significant oil reserves were discovered in Libya. Revenue from petroleum exports moved Libya from being one of the poorest nations, to becoming a wealthy state. However, people began to resent the increased concentration of wealth in the hands of King Idris. This discontent grew with the rise of Nasserism and Arab nationalism throughout North Africa and the Middle East. In August 1969, King Idris was in Turkey for medical treatment. On September 1, 1969 a group of 70 junior Libyan military officers led by Muammar Gaddafi took the opportunity to stage a bloodless overthrow (coup d’état). The coup started in Benghazi, by members of Libyan Signal Corps. They placed the crown prince, Sayyid as-Sanussi under house arrest The coup leaders were referred to as the Free Officers’ Movement. They declared an end to monarchy in Libya and renamed the country the Libyan Arab Republic. The movement...

...INTRODUCTION All through the ages human societies have been plagued with tyranny and the abuse of power. Perhaps since the dawn of civilization and government, because long before democracy existed there were only absolute monarchies. People worked together to form the soundest methods of government. Eventually it would lead us to democracy. This cooperation is in our nature and a key factor that separates us from animals that rely solely on primal instinct. It is also human nature to yearn for absolute power and control. Suffice to say we are all greedy, prideful and envious of those above us in the social hierarchy (i.e. kings, presidents, and bosses). But once a member of the populace is exposed to this power over his fellow man, his senses and values have the potential to mutate and become tyrannical. Both male and females of any ethnic or cultural backgrounds are vulnerable to this anomaly and once affected are capable of inciting atrocities. Muammar Ghadafi was born into squalor to illiterate parents in a country dominated by European powers. He died in his palace at the hands of his own people. He gained and lost power during revolutions. The following documents Muammar Ghadafi’s decent into control, madness and the metaphorical abyss. EARLY LIFE Muammar al-Qaddafi was born in 1942 in the town of Surt , in western Libya . Raised in a Bedouin tent in the Libyan desert, he came from a tribal family called the al-Qadhafah. Both parents were nomadic Bedouin, and being...
