...Case Study A: What concerns would you have about operating this business as a sole proprietorship if you were Stan? What alternative form of business organization would you recommend and why? In this case Stan is thinking about starting a toxic waste disposal business. He is considering operating this business as a sole proprietorship. Although this is a valid business organization it also carries numerous disadvantages, if not all aspects of the company are taken into account. I will explain some possible conflicts Stan can encounter as a sole proprietorship, and I will recommend an alternative form of business organization that may become more beneficial. After taking into consideration the two different operations I will come to a conclusion of which business organization may be more preferable in Stan’s situation. A sole proprietorship is ideal for individuals operating a low risk and small business organization since there are many disadvantages with certain risks, or when the company begins to grow. Starting a toxic waste disposal with transportation raises many concerns. This operation is highly at risk for an incident and a sole proprietorship may not be the best business organization. As a sole proprietorship Stan would carry the business on his own without adopting any other form of business organization. Stan would have unlimited personal liability with any incident being fully responsible. One of the major issues is the environmental impact if there happens...

...Assignment 2 Part (a): Issue: Whether Robin has contractual rights in relation to the window coverings? Rules/ Applications: 1. Signature rule: The law states that a term is promissory and can be made expressly or impliedly. In this case, the term made between Robin and Sarah was in the written form and according to law, it is classified as express terms. In addition, Robin also signed the contract made by Sarah. Therefore signature rule applied and Robin was bound by the contents of the documents even though she did not read and understand the contract (Case from L’Estrange v Graucob). 2. Parol Evidence Rule Written contract contains all the terms and conditions of the agreements, and Sarah cannot subtract form, add to, vary or contradict the language of the written instrument. 3. Whether the Oral statement made by Sarah is a term of contract? In this case, at one of Robin and Sarah’s meetings, Robin asked Sarah whether the price of the house included curtains, blinds and window coverings. Sarah explained that all window coverings were provided for in the contract. Before Robin purchase the house, she concerning about whether the house price include the window coverings...

...Lost with werewolves It was a bright sunny morning; I was on my way to the pet store to get my cat more food. As I was looking around the store I heard a faint cry, I followed the cry and all I heard was “ help me!” I tried to figure out where the cry came from so I went in the middle to look down all the aisles. I couldn’t see anyone I knew so I went down the aisles and finally stopped in front of a fish tank full of guppies. A tiny guppy stuck its head out of the water and stared at me saying “ help me”, it was my friend Kasey she was turned into a guppy and the other guppies didn’t like her so they beat her up. She had a huge swollen black eye and tiny cuts on her body so I told her to jump in my hands but she told me she couldn’t because she obviously wouldn’t be able to survive without water. I assured her I would come back with something to put her in and I ran to find a bowl. I frantically searched all over the store and couldn’t seem to find any bags, bowls, or any sales associate to help me. I didn’t know what to do so I tried to find Kasey again, I called out her name and looked in every fish tank but she was nowhere to be found. I sadly left the pet store and walked home. While walking home I looked around and the streets were deserted houses were empty and I was alone. I kept making my way home and a strange feeling came over me like there was something very wrong, I felt the ground tremble and ran into a house for safety. Once I got inside the ground shook more...

...Updated 2006 Overview In the United States, three federal laws are critical in protecting children with viral hepatitis against discrimination in schools, daycare centers, athletic programs, camps and other areas of daily life. The Americans with Disabilities Act (ADA) is the most powerful law safeguarding the rights of children in public and private schools and daycare centers. The law also prevents any organization or business from discriminating against a person because of a real or perceived disability, such as an infectious disease. A second law, Section 504 of the Rehabilitation Act, bars schools, colleges and other organizations receiving federal funding from discriminating against children with disabilities. Section 504 identifies chronic liver disease as a “hidden disability.” Most advocates say hepatitis B and C are disabilities that are protected by ADA and Section 504—even though these chronic liver diseases are relatively asymptomatic in children. A third law, the Family Educational Rights and Privacy Act (commonly called FERPA or the Buckley Amendment) prevents school officials from divulging medical information about a student to anyone beyond essential school personnel. ADA also has provisions that protect student medical records. Many states also have civil rights laws that, similar to ADA, protect people with infectious diseases and other disabilities against discrimination. Of all these laws, ADA extends the most far-reaching protections for families...

...Windshield Survey Summary and Reflection There are many definition that define the community. The World Health Organization (WHO) refers to the community as “ a group of people, often living in a defined geographical area, who may share a common culture, values and norms, and are arranged in a social structure according to relationships which the community has developed over a period of time” (Stanhope & Lancaster, 2012, p.397). The healthy level of the community is called public health, and the responsibilities of public health include assessment, policy development, and assurance (Stanhope & Lancaster, 2012). Goals for public health are to promoting healthy status of the community as well as maintaining the community in a balanced healthy environment. The nurses who are employed by either private agencies or government departments to promote community health are the public health nurse. The public health nurse is to serve the community as the client by using the population-centered practice to seek beneficial health changes for the whole community (Stanhope & Lancaster, 2012). While working in a community-oriented nursing practice, it is important to work with the community partnerships like professional groups or non-medical groups to help promoting community health. ...Lowe’s By You April 21st, 2014 University of Phoenix ECO-365 Introduction In the United States there are two major players in the home improvement industry. The biggest in The Home Depot. The other, while smaller having 502 less stores, is still a giant of the industry (Cramer, 2013). Through the recession Lowe’s stood while well The Home Depot fumbled. Lowe’s faces competition from opponents other than just The Home Depot as it expands beyond America. As Lowe’s seeks to enter the Canadian and Australian markets it will encounter more diversity than it has experiences so far. The complexities of doing business abroad and opening stores afar will become even more apparent as their international tactics change. Despite the challenges Lowe’s should expand further to become an even bigger player both nationally and globally. Global Competition’s Impact on Lowes In 2009, Lowes had 1,710 stores found throughout Canada and United States, 16 of these found outside the United States, with three stores in Mexico that opened in 2010, allowing for their exposure to bring them to a new level of sales internationally. (“Lowes Companies”, 2012) After much research it is found five competitors could impact Lowes, the #2 home improvement dealer in the world (Racine, 2012), but on different levels. The first competition is the main competition of Lowes, Home Depot, #1 in the world since 2005, (“Lowes Companies”, 2012) is expanding its sales by bringing in more Hispanics...

...HEPATITIS B August 25, 2014 The definition of hepatitis is the inflammation of the liver. The liver is the largest organ in the body and functions to digest food, store energy and remove toxins. Hepatitis is caused by a variety of factors such as toxins, certain drugs, heavy alcohol use and bacterial or viral infections. The three most common types of viral infections that affect the liver are Hepatitis A, B and C. (CDC). This paper will focus on hepatitis B. Hepatitis B is a highly contagious infection of the liver caused by the Hepatitis B virus (HBV). Infection can be acute or chronic. Acute Hepatitis B is short term and occurs within the first 6 months after exposure. Chronic Hepatitis is long term and the virus remains in a person’s body. (CDC) Hepatitis B is spread through contact with an infected person’s blood, semen or body fluids via activities that involve skin puncture or mucosal tissue contact. Examples of such activities include sex, exposure to sharp objects, needle sticks, sharing razors, toothbrushes with an infected person, intravenous drug use etc. A mother can also pass the disease on to her child during delivery. (Caple) The average incubation period of the virus in adults is about 3 months, after which symptoms begin to appear and may last several weeks to months. Symptoms of acute hepatitis include jaundice, fatigue, abdominal pain, nausea, vomiting, fever, loss of appetite, dark urine and joint pain. Complications that...

...“War on Drugs” was initiated. Federal law in the US dictates that possession of “Schedule 1 Drugs” (heroin, LSD, etc.) is a criminal offense, which often leads directly to a prison sentence 5. While some steps have been made recently to mediate this hardnosed policy, drug laws in the United States remain as some of the most strict in the world. Since they were passed, these laws have always been a topic of debate. Although severe penalties may deter a large number of people from involving themselves in the drug world, opponents of the current US laws are quick to mention that the United States holds the largest prison population in the world and has the second highest incarceration rate per-capita 7. Additionally, many argue that current drug policies in the US do little to rehabilitate offenders, often leading them to repeat criminal offenses and fall further out of a productive societal role (making it increasingly difficult for drug addicts to recover and find purpose beyond their addictions) 8. Programs that effectively rehabilitate injection drug users most often refrain from harsh penalizations and instead focus on the prevention of recurring problems. Portugal, for instance, implemented an innovative policy change in 2001 where they became the only European Union nation to decriminalize drugs. This law, known as Law 30/2000, states that drug usage is still illegal (satisfying the United Nation conventions), but violations of this law are considered “exclusively administrative...
