...The following paper will examine the elements of procedural fairness apparent in tribunals and compare this to that of the court system, ultimately coming to a tentative conclusion on the efficacy of each. A broad spectrum of academic literature, case law and legislation has been considered to evaluate the role that tribunals have in the Australian legal system. In light of Kerr J’s remark (above), find and critically analyse a case which considers issues of procedural fairness in a tribunal hearing. The case of Ashmore v Commissioner for Superannuation primarily concerned the decisions to not recognise late election and to not grant an extension of time relating to the preservation of the applicant’s superannuation benefit. At the initial hearing in which the applicant (Carolyn Ashmore) gave oral evidence, only one senior member was present, contrary to the stipulations of the Superannuation Act that the Tribunal be constituted of three members, one of whom is an eligible employee or pensioner. The hearing was then reconstituted with three members, and a transcript of the applicant’s oral evidence was used to ascertain her credibility. Ultimately the Tribunal formed a negative opinion of the applicant’s evidence, leading them to rule against her. By relying on a transcript of Ashmore’s evidence, it was determined by Justice Moore that the other two tribunal members could have been influenced, albeit unintentionally, by the negative bias from the senior member present at the...

...1.0 Introduction In accordance with the Personal Development Planning (PDP) Plan I have made in the first assignment, there are three goals I have established in this PDP Plan, which are Goal 1- Academic development, Goal 2 – Personal development and Goal 3 – Career development. In order to set these goals achievable, I have pre-determined some measurement methods named “how will I measure goal success?” in the form of PDP Plan. Indispensible, I have also planned some activities to assist and ensure the achievement of these goals. After two months development in practice, I would like to express my goals achievement in this reflection essay. By doing so, I will add-on unplanned activities which I have performed into my PDP, and then make comments to all activities either planned or unplanned. In further, I will also state reflections on goal attainment. By the end of this reflection essay, I will expand these three goals into a further step, which for me to achieve in future. 2.0 Personal Development Planning 3.1 Explanation of PDP I am all the way talking about PDP, I feel it’s necessary to explain what is PDP based on my own understanding. If the evidence is admitted, the jury must be given an explanation giving details of the factors that could contribute to misidentification. Two articles discuss this decision, “Court Raises Bar for IDs by Witnesses” written by Caitlin Dineen for The Press of Atlantic City (October 8, 2011) and “In New Jersey, Rules Are Changed on Witness IDs” by Benjamin Weiser for The New York Times (August 24, 2011), and offer interesting viewpoints on the issue. This paper will discuss those viewpoints. The Press of Atlantic City article did not go into extensive detail as to what the new ruling entailed, instead, it chose to interview local attorneys to get their views. James Leonard Jr. states, “I think it’s going to be a valuable tool for defense attorneys.” While on the surface this new guideline would appear to make prosecution more difficult, Ocean County executive assistant prosecutor Michael Paulhus states that, “It gives both sides an opportunity to address a critical factor in their case…. Anything that’s well-grounded, as this appears to be, enhances the confidence of the eyewitness identification.” Attorney Leonard agrees, thinking that the ruling would not unfairly favor either the defense or the prosecution, that it would benefit both sides....
