During this week’s written assignment, I will share three different scenarios. Then, I will discuss which of the three concepts: litigation, ADR, or criminal prosecution is the appropriate plan of action for the predescribed scenarios. First, this is the most appropriate plan of action largely because there is surely an incident of crime here. This is a white-collar crime known as embezzlement. Although it’s a crime and that involves injury to her employer it can be considered to be a violation of civil law. This is because the injury is relatively private and almost gone unnoticed. So for the plaintiff and defendant are required to obtain their own attorneys to argue the case made on behalf of the employer. With Alternative Dispute Resolution, it will be more practical for Robert to present a case and demand a claim from the multinational doll manufacturer. A big support to this argument is because after Robert has been billed with all these medical bills for his daughter, hiring an attorney is probably unlikely. However, if Robert contacted the manufacturer and demand a settlement for the damages done to this daughter from a defective product, the company would most likely want to settle the matters in private to prevent this from releasing to the public. The company would not want that case to leak into the public arena and ruin their reputation. Robert has evidence to present a case with the business, he has the damaged product, daughter's testimony, doctor’s eyewitness account, a paper trail of many medical bills, any pictures or other support documents that he can prove the manufacturer that they may peacefully settle the matter outside of court.
