1. In State X, persons must be at least eighteen years old before they can purchase alcoholic beverages. The state also has passed a law requiring that persons who prepare and serve liquor in the form of drinks in commercial establishments be licensed. The only requirement for obtaining a yearly license is that the person be at least eighteen years old. Moffitt, aged thirty-five, is hired as a bartender for Lone Star Restaurant. Bekins, a staunch alumunus of a nearby university, brings twenty of his friends to the restaurant to celebrate a football victory. Bekins has ordered four rounds of drinks, and the bar bill exceeds $200. Bekins learns that Moffitt has failed to renew his bartender's license, and Bekins refuses to pay, claiming the contract is unenforceable. Is Bekins correct?

There are five elements to a contract that make them valid or enforceable. This includes legality. The contract, according to the text, must be formed for a legal purpose. Essentially, a contract that includes clauses that is prohibited by federal or state law is illegal and is therefore unenforceable. Technically it is illegal for Moffitt to sell drinks and thus the contract between him and Bekins party is unenforceable. However, if the case is brought in court the contract could be deemed enforceable. The only requirement necessary to update the license to serve drinks is that the person acquiring the license be eighteen years old; Moffitt is above the legal age (35). Although Moffitt has not renewed his license it does not hinder his ability to uphold his part of the contract of serving adequate drinks to Bekins and guest.
