The purpose of a CLETS Temporary Restraining Order, against a party accused to be the abuser, like any restraining order it is done for the purpose to make or help the abuser to stop the form of abuse that is being inflicted upon another person. Courts have guidelines that they do require, to be followed when issuing one of these orders. The purpose of a CLETS order is when evidencie is shown that violence and abuse is of a more serious criminal nature has occurred and still is occurring, then the court may issue a CLETS restraining order. This is also more severe as it will include criminal penalties, prosecution, and or fines or both if the restrained person violates the order in any way once the CLETS order has been issued. The State system known as the CLETS system links up to multiple law enforcement agencies all over California and will allow these agencies, to pull the same information right away if needed, even if the order was issued in another jurisdiction. If an accusing party can show they or their children are a victim of any abuse and harm has taken place or is imminent then a CLETS TRO may be appropriate (Waller). For example, if someone has threatened to kill their spouse and it is documented then a CLETS TRO is absolutely needed and should be issued even if it needs to be issued on an emergency basis and issued by a peace officer on site. Another instant where a CLETS TRO should be issued is when a parent threatens to take a child out of the state that is not necessary but for the instance of a possible parental kidnapping occurrence. In my opinion, I believe a CLETS TRO, might be unfair to a party is if there is not enough proof to show the court documentation to warrant such a CLETS TRO should be issued and it is issued
