California Proposition 184: The Three Strike Initiative

The 1910 California gubernatorial election of Governor Hiram Johnson brought direct democracy to the California after the initiative, referendum and recall were introduced to the California Constitution in 1911. Initiatives are proposal for new statures of constitutional provision that is drafted by a citizen, which can be later voted on by the state electorate.
Reform arrived to California after years of political corruption and career politicians that monopolized public policy influence.

Initiatives enhance the democratic process, it allows citizens to propose solutions to problems. It can pass laws that would otherwise not pass through the legislature. For example, California Proposition 184: the Three Strike Initiative, was passed by the voters in 1994 after failing to become a law through the legislature a few years before. This law has been critical to how California has dealt with repeat criminal offenders. The legislature does not always pass the laws that the people want, as seen with the Three Strike Law, the initiative process gives the people an alternative to influence policy.

After circulation, the initiative must gather support from the electorate. This support is gathered by signatures, the number of signatures required is determined by the number of voter in the last gubernatorial race. For an initiative statute it will need about 5% of the number of people that voted, just about half a million signature. A constitutional amendment requires 8% of the number of people that voted,, about 810,000 signatures. After the initiative makes its way to the ballot a simple majority wins. If it is voted into law, an initiative cannot be amended. It can only be undone by another

...Law Hearing the words “three strikes, you’re out” probably invoke thoughts of umpires, baseballs, and pitchers in the minds of most. In California, if you are familiar with the legal system, “three strikes, you’re out” will likely give you a vision of thousands of inmates dressed in orange, sleeping on bunk beds inside overcrowded gyms. In November 1994, California legislators and voters made a major change to the California sentencing laws with Proposition 184. This proposition better known as the “3 Strikes Law” has long been a controversial topic in California. It has spurred debates as to whether it is considered cruel and unusual punishment for the thousands of repeat offenders sentenced every year. Proposition 184 is a cruel punishment for the thousands of inmates packed into state prisons, and the taxpayers spending billions to keep them there. Over the years legislators have sought a way to reform the 3 strikes law. In November of 2012, Proposition 36 was enacted as an initiative designed to preserve the original idea. The idea was to impose life sentences on serious and violent offenders without imposing excessive sentences on non-violent offenders. As California searches for ways to decrease the recidivism rate of serious and violent offenders, we have to consider the current laws and the impact these laws have on the state of California. Alternative Solution Proposal

...after too many incidents have occurred. Some policies protect victims, witnesses, subjects, and the officers that enforce them. Not every criminal justice policy becomes a strong policy out of the gate. A lot of them were created as some alternative solution and then gradually made its way to becoming a policy. This paper will take a peek at the California’s three-strike law. In 1993, the first three-strikes policy was adopted through a ballot initiative, and it was until 1997 that the policy was enacted. Since then approximately half of the country and the federal court system have adopted this policy. Since a lot of offenders are repeat offenders, the three-strikes law is based on an increase in sentencing severity as to reduce recidivism through incapacitation and deterrence. The idea is that the most unreformed criminals deserve the most punishing of sentences. Each of state that practices the three-strike laws only shares it in name as the laws vary from state to state.
