Case Comm v Anderson
In the case of Commissioner of Internal Revenue v Charles N. Anderson, the court sought to review the decision upheld by the tax court regarding the exclusion of meal and lodging services from gross income provided by employers to compensate employees. The tax court had initially decided that the meals and lodging services would be excluded from the taxpayer gross income because the meals furnished and lodging provided were primarily because it occurred on the “business premises of the employer” so it would be excludible from gross income. However further details appeared as the lodging services were not on business premises but actually were two blocks away at a location where the employer built for the taxpayer to stay close proximity within his employment location. The court had to review the decision and come to a new agreement.
The relevant facts of the case were that the location and primary residence of the taxpayer was furnished by the employer for the sole reason of being in close proximity with his employment location which was two short blocks away from the residential property. The acceptance of the residential property of the employee was mandatory and a part of his condition of employment. The meals furnished by the employer consisted of groceries to be given to the employee’s family. The court agreed that they had come to a consensus upon the agreement that the employer business premises was in fact by definition, a residence owned by an employer which qualified the taxpayer’s (Charles Anderson) residence to fall under, thus qualifying the taxpayer from excluding the meals and lodging from his gross income.
The issue arising is not the mandatory agreement that the meals and lodging must be furnished by the employers on his business premises; the court had agreed that the taxpayer and employer fulfilled that argument. However the

This Essay offers a strategy for regulating financial markets to better prevent the kind of disaster we saw during the Financial Crisis of 2008. By developing a model of risk-manager decisionmaking, this Essay illustrates how even “good people” acting in utterly rational and expected ways brought us into economic turmoil. The assertion of this Essay is that the root cause of the Financial Crisis was systemic moral hazard. Systemic moral hazard poses a unique challenge in crafting a regulatory response. The challenge lies in that the best response to systemic moral hazard is “predictive prevention.” It is inherently difficult to reward individuals for producing predictive prevention. Unsurprisingly, markets fail to produce it at optimal levels and thus cannot prevent systemic moral hazard and the kind of crises that ensue. The difficulty in valuing predictive prevention is seen when we model how risk managers make decisions regarding the prevention of excessive risk. The model reveals how the balance can be tipped in favor of risk taking that leads to systemic failure and broad social harm. The model also reveals how regulation might work to reset the balance to one that is superior for society. MADISON* ABSTRACT More than 150 years into development of the doctrineof "fairuse" in American copyright law, there is no end to legislative,judicial, and academic efforts to rationalizethe doctrine. Its codification in the 1976 CopyrightAct appearsto have contributedto its fragmentation, rather than to its coherence. As did much of copyright law, fair use originated as a judicially unacknowledged effort via the law to validate certain favored practicesand patterns.In the main, it has continued to be applied as such, though too often courts mask their implicit validation of these patterns in the now-conventional "caseby-case" application of the statutoryfair use "factors"to the defendant's use of the copyrighted work in question. A more explicit acknowledgment of the role of these patterns in fair use analysis would be consistent with fair use, copyright policy, and tradition. Importantly, such an acknowledgment would help to bridge the often difficult conceptual gap between fair use claims asserted by individual defendants and the social and cultural implications of accepting or rejecting those claims.
