Malloy v. Hogan (1964)

Malloy v. Hogan was a case dealing with the 5th Amendment. William Malloy was arrested in 1959 for pool selling, which is an illegal form of gambling on pool, a misdemeanor. He plead guilty and was sentenced to one year in jail. After 90 days in jail, his sentence was ended and he was placed on probation for two years. About a year and a half later, a superior court ordered Malloy to testify about his gambling. Malloy refused, thinking doing so would incriminate him. He was held in contempt of court and so he filed a habeas corpus petition. This petition eventually made it all the way up to the Supreme Court on Appeal.
