...Assignment: Final Project: Appeals Process Paper Tony Thomas CJS/220 Jerri Mauldin August 21, 2011 An appeal is when a person who is convicted of a crime or is told they can’t do a certain thing and the person submits questions in writing why this decision was made and wants the verdict and the case to be looked at another time. Most causes for an appeal is from people thinking they are innocent or have the right to do what they want where they want to do it. The way an appeals process can affect the overall criminal procedures or process is if the appeal gets looked at and the ruling from the previous judgment gets overturned. The reason the system is affected is it can set an innocent man free or let whoever continue on doing what they want to do. If someone is put in jail or prison for a crime they didn’t commit and they send up an appeal and it gets the ruling reversed it can mean that the case would be reopened because the person who actually committed the crime is still on the loose. It also interrupts the process of the system because everything that has been put in writing saying that this person was guilty has now got to be withdrawn from record. It also means that the person who is behind bars goes free. A good way to improve the appeals process is not letting them sit so long before being looked at. This is a big problem in some states and needs to be corrected. Even though forensic science has brought a lot of people to the surface that we would...

...Law Opinion January 19, 2014 CJS/220 The United States is not controlled by a king and Queen, but instead is governed by a president, senate, and the house of legislature. The United States is a democracy (Meyer & Grant, 2003). As a democracy the United States is governed by laws enacted by public officials. Citizens are the ones who vote for the public officials such as the President of the United States and the representatives of each state. Laws are created to protect individuals and their property, and are enforced in the United States throughout every community. The Bill of rights of the United States Constitution describes procedural laws that dictate how laws should be administered. The legislative branch of the government creates, reviews, and vote on laws then place them into effect. Once the laws take effect, they are enforced by the executive branch which is in control of all the law enforcement agencies. The judicial branch determines if the laws passed are valid according to the U.S. Constitution and will act as an arbitrator if needed. According to Meyer & Grant no one branch can govern the U.S citizens alone, that is why the United States needs these branches in order to work effectively. The American Common Law system originated from the medieval English legal practices where judges decided both criminal and civil cases based on their individual cases (Bakken, n.d). Laws were based on judge’s opinions and how they viewed the existing...

...Most commonwealth member states as well as the US adopted the common laws used legally by the English. However, certain practices previously accepted by the English laws are outlawed by the current US constitution. Common law courts in the US have over the time become stater desicis. This means that common law judges are not only mandated to apply the law but they also create laws. In this context, court decisions become precedents for future case rulings. English law was formally applied in the US through various ways. With the exclusion of Louisiana, all states in the US applied the reception statue that states that the English law is the state law. Another way that the English law became applicable in the US is that most states in the US reenacted the important British statues during the Revolution. One of the statues commonly adapted from the Revolution period is the statue of fraud still commonly used by that name in the US. During early times, American courts hardly cited contemporary English laws. This was as a result of appellate decisions from most American courts not being regularly reported. However with time, English legal decisions disappeared in the 19th century which was as a result of American courts becoming more independent in solving legal problems. According to Carp, today in US courts, foreign laws are never cited as precedent but may be cited as a reflection with regards to western civilization (Carp & Stidham, 2001). There are various types of law...

...Week 2 Assignment: Law as a “Living Body” CJS/220 The U.S. Constitution provided the structure and framework for the American rule of law that was based from the structure of England. The U.S. Constitution, which was written and accepted in 1787, has influenced the American legal system giving the American people a structure to live by, law and order. Although all American laws are constitutional, when the Constitution was written in 1787 the American culture was very new and it only catered to the majority and nobody else that was brought to the United States. As time passed the comprehension of the Constitution was changed to integrate minorities like African Americans, women, Asian Americans and others to have the same rights as White Americans. The world has changed dramatically and the U.S. has made history since the creation of the U.S. Constitution having added to it in order for the land of the free actually be the land of the free. The term “laws on the books” refers to the actual written laws passed through legislation being by state or federal and recorded in the codified law books. “Law in action” refers to how the law is actually interpreted, carried out, and applied in the courts. As far as it being fair in the justice system, well it has its pros and cons. It’s not fair when a person is singled out by police because he looks different or out of place. It’s not fair when a person gets a ticket when going to speed of traffic. It is fair that we do...

...Juvenile Court Process CJS/220 February 28, 2014 Harvey Smith Juvenile Court Process The juvenile court system was put in place for people that commit crimes or have disciplinary problems that are under the age of eighteen. After the age of eighteen a person must be tried in adult court or depending upon the severity of the crime. Initially juvenile court was put in place as a form of rehabilitation for youth. The Juvenile Court System is managed under the theory of rehabilitation rather than punishment in which acts as parens patriae. (Meyer & Grant, 2003). Parens patriae is when a parent is reluctant or incapable to control a child, the state has the power to step in and act in the child’s and society’s best interest (Meyer & Grant, 2003). Juveniles do not succumb to the same rules as adults when being taken into custody. The juvenile justice system is directed toward protecting a youth’s privacy, protecting the youth from harm, and providing treatment or support services rather than punishment (CJI, ch.14). Once a juvenile is found guilty of a crime they are sent a juvenile detention center opposed to being sent to a jail or prison. I believe the juvenile process should differ from the adult process depending on the crime. At a certain age you are able to think logically and understand right from wrong and if you commit a crime you should be able to understand the severity of it. If you steal from a store and you’re under the age of eighteen...

...Write a 200- to 300-word response comparing the court system of the state in which you live and the federal court system. If you are not a resident of the United States, choose any state’s court system to compare with the federal court system. Compare these two systems by structure, source of laws, and the types of cases that are heard. I live in the state of Florida in the court system is so different from the federal system. I think that Florida is a strict state when it comes to certain crimes that are committed and the court system gets involved. In Florida the structure of the state court is setup in 20 judicial circuits which there is a state attorney that represents the state in the prosecution of state law violations in either county or circuit courts. In Florida the highest court system which would be the court the Supreme Court for the state is located in Tallahassee and there is also a District Court of Appeals. There is five districts which they are located in Tallahassee, Lakeland, Miami, West Palm Beach, and Daytona Beach. Cases are reviewed by three judge panels. In with the state court you have the option to ask the highest state court to hear the case. When it comes to a case only certain ones are eligible for review by the US Supreme Court. When you compare the state with federal court system it is basically set up for congress that has the power to establish the 13 US courts of appeals, the 94 US District courts, the US courts of claims...

...Jeep, people would not continue to purchase them. Jeeps have been the backbone of America since they were first made. Jeeps have evolved in so many ways from the past to the present and are continuing to evolve into the future. The Cj’s series started back in the 40s, but the one Jeep covered in this paper will be the Cj-7. The Cj-7 came about in 1976 and roughly 379,000 were produced. This was the start of the Jeep that the public could actually use because it had better drivability and more space. The Cj-7 was just like the Cj-5 except the Cj-7 was extended to give more space. The drivability was improved by the addition of anti-swat bars. Another addition to the Cj-7 was a steering stabilizer allowing the Jeep to have a less probability to go into the death wobble. The death wobble is where the front tires whip back and forth making the driver lose control. Another option was the Quadra-Trac, which was an automatic four-wheel drive system. With this type of four-wheel drive system, it allowed for an automatic transmission. This was another way the Cj-7 was made to be more of a civilian vehicle. There were many different types of packages that the Cj-7 came in. The 3 packages were the Renegade, Laredo, and Golden Eagle. The packages included different options including chrome packages, different four-wheel drive systems, and different engines. There were even options of locking differentials and a winch. The engines offered was the 232 inline six and the 304 V8...

...Well here is the story of a few jeeps... In the short time between school, homework, and Target, my free time is most enjoyed off-road in my Jeep. Chandler, Clayton, and the bass pond will keep me occupied for years to come. As long as I have a Jeep I will continue my quest to explore more trails such as The Rubicon, or Moab. The first Jeep I purchased was a 1986 Cherokee Laredo. At the time the four-wheel drive didn’t work and I didn’t care much. Weeks later I could be found cutting through the occasional field or going through a little mud. I soon learned the need for four wheel drive after a few scary situations last summer. It was about 1 A.M. and I was driving in a ditch with slippery grass from morning dew. In the ditch there was a tall grassy hill that I was thinking about driving up. With a little encouragement from my friend, I charged up the hill and as I reached the crest, my tires started slipping, as did obscenities. We slowly descended backwards down the hill, because the brakes weren’t doing their job. The pace picked up, and fear and uncertainty were riding shotgun as we turned 90 degrees on the hill. I thought a roll was inevitable as we were sliding sideways, so I hit the throttle and we slid around and then the Jeep were facing the bottom of the hill. A few weeks later I got the four wheel drive working, and since then I’ve put my passengers through more fear and fun. Ignorance and adrenalin had got me high centered in the cold raining boonies, up to my...

...Hick Day A slight drizzle was falling from the sky as my huge knobby tires slingshot baseball size chunks of mud over twenty feet in the air. It was now October and the day I had been waiting for a long time had finally arrived; it was hick day. This is the one day out of the year I get to show my true colors to the school, because I am only one out of a handful of real hicks at Bob Jones High School. Now, because of my four past accidents that were all linked directly to mud riding, I had sworn to my parents that I would never put my Jeep Wrangler back in the mud. However, what would just one last time hurt? “This was it”, I told myself, “this is the final time I will go off-road in my Jeep and after this I will fully respect what my father and mother worked so hard to get me.” My near death wreck that almost took four of my friends lives and my life in the blink of an eye completely turned my life around, I now cherish and respect everything that I am granted. To begin with it was 7:30 in the morning and I had just finished making my rounds picking up all my friends for school. My buddy Caleb and I were in the front and we had been planning this day for months. He and I went all out dressing up for hick day. We both wore full camouflage attires from head to toe. I even had on my enormously thick camo hunting boots; they were so thick I could not even feel the gas or brake pedal through them. In the rear of my Jeep were three girls all crammed together in that tiny, two...
