Classify goals of punishment
Now that you are familiar with deterrence write a 2 to 3 page paper discussing how deterrence relates to humiliation. This is a form of deterrence gaining popularity among law makers. Ohio uses deterrence in to the oldest form, which is humiliation. Ohio requires all first time DUI offenders to wear a yellow license plate while on suspension with driving privileges. To understand how deterrence relates to humiliation you first have to know the meaning of both. Deterrence in law is the use of punishment as a threat to deter people from offending. Deterrence is also contrasted with retributivism, which holds that punishment is a necessary consequence of a crime and should be calculated based on the gravity of the wrong done. Deterrence has two key assumptions: specific punishments imposed on offenders will “deter” or prevent them from committing further crimes is the first; fear of punishment will prevent others from committing similar crimes is the second.
The notion of deterrence is to underline the criminal justice systems in most democratic societies. Deterrence is divided into three separate categories; Specific deterrence, General or indirect deterrence, and Marginal deterrence.
On the other hand humiliation is the abasement of pride, which creates mortification or leads to a state of being humbled or reduced to lowliness or submission. It’s an emotion that a person fells when social status has decreased. It can be caused by intimidation, physical and mental mistreatment or trickery, to de-emphasis the ego. Humiliation of one person by another is mostly used as a way of asserting power over them, and is a common form of oppression or deliberately designed to be humiliating. Do I agree with this law? Why or why not? Yes, I agree with this law the reason why is because no one likes to be humiliated. It’s like telling the world that you did something wrong. I believe that deterrence relates to humiliation because humiliating a person for what they did wrong in front of everyone such as family, friends, classmates, neighbors, and etc., and showing the punishment for what they did wrong would hopeful stop them from doing it again. What humiliation practice does your state use? In the state of Georgia last year, Judge Sidney Nation suspended almost Brenton Jay Raffernsperger’s entire seven-year sentence for cocaine possession and driving under the influence in exchange for his promise to buy a casket and keep it in his home to remind him of the costs of drug addiction.
