The guest speaker was Sharon Haynes a retired City Attorney and an Arizona Native. Ms. Haynes went to University of Arizona and major in English and had a minor in Political Science and Science. After Ms. Haynes graduated she decided to go law school in which she had to read and take notes for an extended period of time. Ms. Haynes started at the City of Phoenix Attorney for thirty-three years. In those thirty-three years Ms., Haynes represented a variety of cases that ranged from personal injuries, parks departments and police departments and she would recommend settlements depending on the case. Throughout her presentation, she touched on a variety of topics such as land acquisition and use, liability and first amendment. Something that caught my attention was the subject of eminent domain which describes that the "government has the power to take private property it deems necessary for public use" (Edginton, 2015). The case that Ms. Haynes used as an example would be the City of Phoenix V. Harnish, in which the city wanted to acquire land for the Sonoran Preserve. This was a case that ended with a monetary settlement that allowed the City of Phoenix to keep the …show more content…
Haynes continued, another interesting topic was about lability of individuals, which focuses on personal injury issues. Before the presentation, I was unaware of the Recreational Use Statute, in which premises is not liable to a recreational or educational user except in gross negligent. Ms. Haynes describes that when someone decides to file a lawsuit they must investigate in detail to see which party was "actually" responsible and see if it can actually form a case. Another thing that organizations implement would be liability contracts known as "transaction in which involves the transferring of goods and services from one party to another" (Edginton, 2015). This is important because it allows parties to be accountable to the contract in which can be turned into a court trial if not

Is Community Engagement a Solution to the Ethical Problems Associated with ‘Spin’? or Does It Just Create a New Set of Problems?

...speak, to challenge, to provoke awareness through participation in public debate. ‘Democracy’ is the conceptual provenance of ‘community engagement’ (Demetrious, 2012). In other words, community engagement plays an important role in our democracy system. As Birch and Glazebrook (2000, p.41) state that corporate is under a great pressure to increase its profit, to keep a good relationship with its investors. Without doubt that ‘spin’ is a strategy for corporate in common use to frame information in a way that can be easily accepted by public who are related tosw. Gare also state that ‘The business community is becoming more isolated from the community at large and looking after its own interests’ (cited in Birch and Glazebrook 2000, p.41). Using the theories of the citizenship (Hudson & Kane 2000) and the communication (Habermas 1989) this essay will discuss the role and relationship of ‘community engagement’ to society and how ‘community engagement’ can be a solution to ethical problems associated with spin. The case study “The Wrribee toxic dump” will be used to demonstrate the arguments. Community engagement is a big theory that included both citizenship theory and communication theory. Hudson and kane (cited in Demetrious 2012, p.2) define citizenship theory as member who belongs to the community and are required to fulfill the community responsibilities, “belonging brings responsibility and fulfillment of responsibility promotes a sense of belonging”. Citizenship offers the...

Case Study Presentation

...Case Study Presentation (Chapter 4 Page 104) Corey Airport Services Inc. versus Clear Channel Outdoor Inc. The deciding court was the United States Court of Appeals for the Eleventh Circuit Case decided on June 4, 2012 The events of this case began when the City of Atlanta issued a request for proposal for a five-year contract at Hartsfield-Jackson Atlanta International Airport in 2002. The lease arrangement envisioned in the request for proposal involved the winning bidder managing hundreds of advertising displays at one of the world’s busiest airports with a guaranteed portion of the revenue remitted to the city. Before the 2002 proposal, Defendant Clear Channel Outdoor in partnership with Defendant Barbara Fouch held the advertising concession through a month-to-month contract. Fouch had been awarded the contract by the City without entering into a competitive bidding process, and Clear Channel became Fouch’s partner by purchasing the ownership interest of Fouch’s previous business partner. The existing month-to-month contract guaranteed fifty percent of advertising revenue to the City, but the request for proposal required bid proponents to commit to paying at least sixty percent of their advertising revenue to the City. Three companies submitted proposals to the City as part of the bid process, the obligatory team of Clear Channel and Fouch was the top finisher. Plaintiff Corey Airport Services, Inc. finished in second place. After Corey failed to secure the contract...

...Developing Negotiation Skills in the Classroom: A Case Simulation Maureen Hannay Troy University ABSTRACT Effective negotiation skills are required in all positions and at all levels of modern organizations. Employees in the human resources department utilize these skills on a daily basis when they deal with such items as new hire packages, salary increases, performance issues, labor contracts, and terminations. Research indicates that by using practical, real-life simulated negotiation scenarios, learners can develop more effective negotiating skills. This paper introduces a case where students can be assigned to a management team or a union team to negotiate a mock collective bargaining agreement. Guidance is provided on how to apply the case in the classroom and facilitate the discussion at the conclusion of the exercise. INTRODUCTION Employees in every organization utilize negotiating skills on a daily basis. From negotiating deadlines and workloads to prices of supplies and contracts with unions, negotiations range from the small and mundane to the large and exceptional. A company with effective negotiating capabilities can gain a competitive advantage, reduce costs, increase profits and improve relationships (Masters, Albright & Irr, 2003). When identifying the ten managerial roles that leaders perform to accomplish organizational objectives, Mintzberg (1973) classified the role of “Negotiator” as one of the essential decisional roles that must be executed by managers...

International Law

... For example, Lugano convention harmonized rules in order to determine competence of jurisdiction, or the Convention of Vienna on international sales of goods determines competence of jurisdiction and the law applicable. In order to explain which criterion is more important in the construction of private international law concerned with international commercial litigation, it will be relevant to focus this study on the rules of competence of jurisdiction. Besides the general system of conventions, as explained above, judicial traditions of countries can explain debates around the best ways to enact rules on international trade, and especially international litigations arise from commercial relationships between actors. Indeed, on one hand, common law countries focus on the role of the judge for the creation, the interpretation and the application of law rules. Some authors argue that the predominance of the judge in common law judicial system translates a pragmatism to resolve disputes related to civil and commercial matters. Moreover, certain procedures in the common law system will provide flexibility that economics and commercials actors need in order to conduct their businesses. On the other hand, parties can agree on competence of jurisdiction. Indeed, this competence will be determined by their choice. For practical reasons,...

Management by Consensus: a Rationale by Technique

...Term paper Management by Consensus: A rationale by technique. Submitted By: HasanuzzamanRahib ID: 3-09-17-031 EMBA Program, Summer- 2012 Course title: Advanced Management Department of Management Studies University of Dhaka Dhaka, Bangladesh 2012. Introduction: The working worlds of our businesses and organizations are becoming increasingly more complex. One of the immediate consequences is the acceleration of change processes. Sensible error tolerance, on the one hand, as well as quick and constructive problem solving procedures on the other will thus be indispensable for forward looking management. The old-fashioned autocratic manager who ruled with an iron hand and controlled everything from the top has pretty much vanished from the management scene. There is no doubt that today's enterprises operate far more humanely than did their old school predecessors, at least on the surface. Consensus management is gaining ever more recognition in business as a success factor in dealing with conflicts and creating personal responsibility. Here the selective application of external moderation, individual and group discussions enhances the dialogue, cooperation and structuring capacities of the conflicting partners. The direct recourse to moderated methods makes for surprisingly quick and long term stable agreements and transfer. Consensus Management: Consensus management means that when a decision is reached by the group, there is total commitment to it by all...

...1. Introduction/background: this section should include objectives and scope of your study as well as background information on global financial markets. You may highlight what happened in the global economy in recent past (say April- early August 2011) and that would set your platform for undertaking this study (business research report). Allow 1-1.5 pages for this section. Post GFC the global economy in my opinion is still reverberating with the ramifications of this tragic event. The tipping point of consumer and business credit has left the global economy “cooling down” by policies and recommendations of FDIC the federal deposit insurance corporation and TARP Troubled Asset Relief Program. The growth for the two largest economies is decelerating (R.Miller 2011) as finance ministers and central bankers arrive at the semi-annual meeting of the International Monetary Fund and World Bank. The increasing price of petrol has lowered consumer and business disposable income worldwide, and in the U.S budget cuts and a tighter monetary policy has limited the demand in China. The third largest economy Japan is recovering from the aftermath of the recent earthquake. While in Europe the possibility of a divided European Union becomes a probability for some members of the trading block as the debt crisis has claimed its third victim Portugal The objective of the study is to somehow interpret and create a better understanding of global and economic events and how these events affect...

If this ground becomes shaky, both structures are in danger.” (Fassbender, 2004, p.884) Different scholars have found that Europe only has two decades left – at best – to have an important impact on global political developments (Mayer, 2008, p.64; Schnabel, 2005, p.75). Therefore, European political conduct in the domain of foreign policy finds itself in a decisive time. On the one hand, the Lisbon Treaty has just been adopted about one and a half years ago and was too contested to make further large-scale changes likely in the near future. On the other hand, it appears that especially now the EU needs coherent action to shape the environment according to...

Using a qualitative multi-method study of the role of procurement in sourcing consultancy knowledge, we demonstrate how intermediaries also commodify management knowledge, thereby limiting the exchange value of that knowledge. Through our analysis we develop a more sophisticated model of the processes and consequences of knowledge commodification. This model clarifies and extends prior research by highlighting the role of commensuration, comparison and valuation, as well as the related tactics that consultants and client managers use to resist procurement’s attempts to commodify management knowledge. Keywords: commodification, consumers, intermediaries, management consultancies, management knowledge, procurement INTRODUCTION The growth of the management knowledge industry over the last 50 years has resulted in increased research attention paid to the activities and impact of knowledge producers such as business schools, management gurus, publishers, and consultancies (see...

Both companies should present their side of the case. The dilemma is the president of Capital Mortgage Insurance Corporation, Frank Randall and his senior vice president and treasurer Jim Dolan are planning a strategy in order to compete and successfully receive the acquisition of Corporate Transfer Services. In order for Capital Mortgage Insurance Corp to accomplish this, they must understand the interest and position of Corporate Transfer Services. Once this is accomplished, Randall and Dolan must come into the negotiation with a clear idea of what the conflict is and what they would like to gain from the negotiation. If the Corporate Transfer Services is unwilling to agree or reach an impasse, then CMIC should ask questions such as, what are you concerns and ultimately, what would you like to see happen with this transition? CMIC must be willing to actively listen to the concerns of CTS and be willing to explore other solutions in order to fulfill the agreement. The bulk of the negotiation process is a continuous back and forth of ideas, options, and even arguments...
