The study investigates the cyber café rules around Bangladesh: law and reality. It evaluates whether the guideline for cyber café owners’ and users are properly maintained or not. This study also reveal how crime occurred on the cyber café and why and it also investigate whether the guidelines are sufficient or not. At last this study recommend some point by which we can maintain our cyber café institution properly and by how we can reduce crime occurred on the cyber café.

Abstract
The study investigates the cyber café rules around Bangladesh: law and reality. It evaluates whether the guideline for cyber café owners’ and users are properly maintained or not. This study also reveal how crime occurred on the cyber café and why and it also investigate whether the guidelines are sufficient or not. At last this study recommend some point by which we can maintain our cyber café institution properly and by how we can reduce crime occurred on the cyber café.
Introductory part
1. Aim The aims are to study what are the rules for the Cyber café and whether they are properly maintained or not. Present situation of the cyber café in Bangladesh. Besides those how crime are occurred by cyber café and why. 2. Objectives The objectives of the study are the following a. To investigate the rules related cyber café b. To investigate the guideline for the cyber café owner’s and for the internet users in cyber café c. To investigate the crime occurred for cyber café d. To investigate why such crimes occurred e. Make recommendation to reduce crime in cyber café 3. Methodology This research was based on the cyber café around the Bangladesh. The methods adopted for this research work include; rules related cyber café for it owners and users, proper use, reality of the uses of those guidelines and case study and the implementation of the rules etc.
Definition
1. Cyber café defined An internet café or cybercafé is a place which provides internet access to the public, usually for a fee. The fee for using a computer is usually charged as a time-based rate. Now-a day this place is well-known for all usually for internet users. 2. It necessity Cyber café is a place where people can able to use internet easily and with a very small charge. Now we are called modern, on these modern age with the development of technology the thinking of people are changed. Now-a-days people use e-mail to

communicate their relatives, friends whether they stay on the abroad or nation, facebook becomes a most well-known social network to communicate people. At present by the use of internet people can get any international and national news easily and with a short time. Besides, we can get any results of exam; appoint form to get a job, even students are getting admitted to their school, collage or universities by using internet. For the using of internet computer is must. On the developing countries like ours it is so expensive to buy a computer individually. So for its alternative the cyber café, where at a small charge we able to use internet, is essential.

Statistics in Bangladesh So by the above statistics we can see that in the year 2000 in our country there was only 3% users who are uses cyber case but now the cyber café users are about 45%. So the establishing of cyber café is necessary.
Amounts of Cyber café in Bangladesh
The first Cyber Cafe in the world opened in 1984. In the early 1990′s there were less than 200 Cyber Cafés. Today there is more than 30000 Cyber Café in 113 countries. The number of cyber café in our country in the year 2005 was 800. The figure remained the same in 2009. 1 At present there are around 2,000 cyber cafes across the country.2

1. BTRC Bangladesh Telecommunication Regulatory Commission which determine the rules and regulation for a better telecommunication system. As now-a-day cyber café becomes a most well-known business which provides easy access on computer, BTRC made some rules for the cyber café owner’s and for its users. According to the rules first of all for a cyber café there must a licence. Besides the rules made for owner there are some guidelines made by BTRC for its users. Beside those, there are BTRC and/or Law Enforcing Agencies which have the right to inspect any cyber cafe at any time. 2. CCOAB For maintain a cybercafé we need proper rules for both owner of the institution and users. For this reason in the year 2003 established CCOAB (Cyber Café Owner’s Association in Bangladesh) for safeguarding rights and interest of its members and made guideline for the owner’s and for the users. It also established for the development of ICT. This association is recognized by and registered with Department of Trade Organization of Ministry of Commerce. This association was established with some objectives like preservation of rights and interest of its members, advise concerned government agency /department(s) in formulating necessary rules/instruments for smooth running of the Cyber Cafes in Bangladesh, help all the members of the association to get suitable and expert worker, monitoring activities of the cyber café, arrange to import modern technology for distribution among the members of the association. 3. Guidelines
Guidelines for owners of the cyber café are following
1. The minimum rate for the first 20 minutes is 10 tk. And after then 0.50 tk for every minute. If it necessary then they increase the rate but it must be accepted with the association. 2. They can claim extra charge for voice and video chat. 3. Must register the name and address of the users 4. If they use partition for the privacy of the monitor, it will not be more than 4 miter height from the floor level and cannot be use any door for the partition 5. It is prohibited to use any types of CD room on the user’s computer 6. Prohibited to keep any unusual file on the hard disk. 7. Prohibited to use the cyber café for the nearest school students except educational reasons 8. It must be concerned by the supervisor of the cyber café that the users cannot be harassed 9. They must maintain all regulation of the CCOAB 10. Must be protected from smoking

11. It must have trade license and the certificate of the membership of CCOAB and it publish in a noticeable place in front of the cyber café. 12. There must be a complain box for the users.
Guidelines for the users are following

4. Law and it’s reality The Cyber Cafes in our country were totally unregulated till February 2008. A new cyber cafe is no longer a profitable business and the sector witnessed slow growth over the last four years due to a lack of discipline and increasing price charge. Ashfaquddin Mamun, senior vice president of CCOAB said due to the increasing charge of cyber café and lack of discipline is the main cause for the deteriorating of the business. There are around 2,000 cyber cafes across the country4, while a majority does not operate with commercial purposes. Several entrepreneurs operate with two to three computers in their home or alongside another business, which should not be counted as a commercial cyber cafes business as such. The problem with non-commercial cyber cafes operators is that they charge low prices, and it becomes difficult for the commercial cyber cafes to compete in the market. Presently, cyber cafes owners charge Tk 20 to Tk 25 for half an hour to browse the worldwide web, whereas it is the guideline that the minimum rate for the first 20 minutes is 10 tk. and after then 0.50 tk for every minute. If it necessary then they increase the rate but it must be accepted with the association5. The Bangladesh Telecommunication Regulatory Commission (BTRC) designed a guideline for cyber cafes owners last year, under which, cafes owners were mandated to be licensed. As of today, only 70 owners took the license 6. There is rule that Cyber Cafe must have an office with valid address and there must be at least two contact phone numbers and one e-mail address7. But in reality we see that most of the cyber café in local area has no valid address and even in the local area cyber café is established without maintain any such

rules. Cyber Cafe has to keep the record of the browser's name and address or National ID Card No. in a register8, though at present in the big city this is maintained but amount is very low and not regular.
Cyber café established without the guidelines of CCOAB and BTRC The guideline provided by the CCOAB and BTRC that to provide privacy, only for monitor, a partition is used, but we see on the above picture that for privacy there is no partition. On school time uniformed students are not allowed to browse. If they have any recommendation from the school authority or guardian only then they will be allowed to browse for educational needs9, but in reality without educational reasons or without the permission of school authority the students are used cyber café frequently and they are not prohibited by the owner of the cyber café. It is prohibited to use any types of CD room on the user’s computer; Prohibited to keep any unusual file on the hard disk 10 , but the reality is totally opposite. Must be protected from smoking 11 , in reality in almost all cyber café this rules is maintained. Theoretically it is prohibited to use internet below the age 18 except educational reason but practically it is not maintained properly. According to the BTRC guideline there must be a complain box for the users but it is not provided by most of the cyber café. 4.1 Reality in Dhaka As we know most of the cyber café are found in Dhaka city. They reality of the rules on this city is satisfactory. Most of the cyber café existed here are established only for commercial purpose. But we see even in Dhaka city few of the cyber café has licenced it’s about only 20%. Besides most of the cyber café has their valid address, two contact numbers and one e-mail address which are essential according to the BTRC rules. Though in some place the charge is high as for example, in the Farmgate area the rate for every half an hour is 20 taka, in Mirpur area it is 15 take, in Khilkhat it about the same as Farmgate, in old Dhaka

city are in some place it’s about 15 take or 20 take. Cyber café owner provides
sufficient facilities for their users like almost all cyber café has the facility of partition for individual users and the height of the partition is also made according to the BTRC and CCOAB guideline. In some cyber café on Dhaka like some Cyber café at the Farmgate are provide water facility for their users. Above all the position of the cyber café in Dhaka city is satisfactory. 4.2 On other areas Though in Dhaka maintain of cyber café rules is satisfactory but others area of the country is totally opposite. Like in my own area, Tangail, Madhupur, cyber café established not for only commercial purpose. There are 4 to 5 cyber café on my local area, but they don’t maintain the rules made by BTRC or CCOAB, even they don’t know about the association of CCOAB. Besides cyber café they establish photo studio, stationary shop. There is no privacy for the individual users. CD rooms are not separated from the user’s computer which is prohibited by the guideline of CCOAB. Charge rate are very high, 30 take for every half an hour. Besides those there are many computers in my local area where people uses internet by giving taka, but they cannot maintain any rules or guidelines. The situation of another area in our country is same as my local area. Like on the Rajshahi local area one of my friends Rikta inform me that most of the cyber café established not for only commercial purpose alongside they have another business and most of the cyber café owner and users not maintained rules or guidelines. The situation is same is the same in Chittagong, Noakhali, Shirajgonj local area informed by Limon, Tairin, Fahim.
Crime in cyber café
If we want to know the crime occurred in cyber café than first of all we have to know about the cyber crime because cyber café established with many computer and cyber crime defined as any criminal activity that uses a computer either as an instrumentality, target or means of perpetrating further crime. 12 Following are defined as cyber crime 1. 2. 3. 4. 5. 6.

Data diddling The parliament of Bangladesh has enacted information and Communication Technology Act, 2006 and which defines certain activities as cyber crime. So, we can say that the activities which made punishable under the Information Communication and Technology Act, 2006 shall be the cyber crimes for the territory of Bangladesh. So, what is the relation between cyber café and cyber crime, why cyber crime increased due to the increase of cyber café and why crime occurred on cyber café those are explained in detail by the following case study regarding crime in cyber café 1. On the above statistics we see that in the year 2000 cyber café was 1% and the cyber crime rate was only 2%, in the year 2003 cyber café was 2.5% and crime rate was 3.2%. We see that with the increase of the amount of cyber café the cyber crime rate also increasing. And now the cyber crime rate is 25% and the amount of cyber café 14% 14. Now we see some cyber crime occurred in our country. No notable cyber crime has yet been committed in Bangladesh. The gradual dependence and extensive use of computer and information technology by the financial institute on like bank, insurance company and others non Governmental organization increase of fear of commission of cyber crime here. In Bangladesh through incident of targeting computer or computer system is very usual. Some of the incidents that bring the notice of the public are – 1. e-mail threatening to the Prime Minister Shekh Hasina 2. hacking the mail of BRAC BD 3. staling the transaction report of Dhaka Stock Exchange through Hacking 4. inserting porno movies to the web site of Bangladesh National Parliament 5. inserting the porno movies to the web site of Jamate Islami Bangladesh 6. E-mail threatening to World Bank Dhaka Office and the President of the United States Gerge Bush. 7. Hacking the website of RAB by for student of computer sciencenamed Tawhid, Jayed, Shahi Mirza and Istiak.
From the above notable cyber crime e-mail threatening to the Prime Minister, staling the transaction report of the Dhaka Stock exchange, inserting porno movies, e-mail threating to World Bank Office are occurred from cyber café.

Besides this, e-mail spoofing is another way. An e-mail spoofing may be said to be one which misrepresents its origin. That is, its shows its origin to be different from which it actually originates. For example where A sends a threating e-mail to the President of the students union threating to detonate a nuclear device in the college campus and this e-mail was sent from the account of some other student, A would be guilty of e-mail spoofing. E-mail is an inexpensive and popular device for distributing fraudulent messages to potential victims. This technique not only helps to assume someone else’s identity, but also helps to hide one’s own. Now the question is why such types of email spoofing and email fraud increased due to increase of cyber café. We know that cyber café is a place where people can get easy access to internet with nominal charge and though cyber café owner register the address of the users but it is not sure that the address is true, for this reason they can easily hide their true address and committees such types of cyber crime without fear of capture. Pornography is another serious crime occurred by the internet.
On the above statistics15 we see that the pornography victims are increasing day by day main reason behind this is the increasing rate of cyber café. Because cyber café is the safe place where people able to hosting of website containing some obscene or prohibited images without any fear of indentify. There is a rule, if any person uses any device of telecommunication for the purpose of giving or uploading any offensive, unnecessary or unusual material or news then he will be punished with 2 years imprisonment or 5 corers TK or both16. But it is impossible to indentify who uploaded such offensive picture or videos, if he uploads it by using the computer in cyber café.

On the above statistics17 we see that the cyber crime rate is very high and also cyber café in Dhaka city but on the other side the crime rate is low on the other part of Bangladesh and the amount of cyber café is also low. The reasons for cyber crime occurred on the cyber café are following a. It is the safest place where people can able to committee cyber crime without any fear of identification b. Most of the cyber café in our country are not registered according to the rules of BTRC c. In cyber café computers are easy to access and therefore unauthorized access by the use of complex cyber space technology is easily possible by-passing security system. d. Most of the cyber café does not maintain any rules or guidelines of the BTRC and CCOAB and the people concern about that. Case study
Now-a-days cyber café is the well-known and a new business around the Bangladesh. In our country the cyber café is increased day by day. At present in our country there are approximately two thousand cyber cafes. There are guidelines created by CCOAB and BTRC for establishing cyber café and also have guidelines for the users. According to the BTRC rules the licence for a cyber café is mandatory but most of the cyber café do not have licence. In Dhaka maintain of the guidelines is satisfactory but on the other part of the country is very bad. On this case study I investigate the cyber café whether it is established according to the guideline or not. Also investigate whether the owner are concerned about the guidelines or not and also try to investigate how occurred crime in cyber café. Dhaka In Dhaka city present condition of the cyber café is satisfactory. Here almost one third cyber café are existed there. Though there are some cyber café do not maintain the guidelines properly but the amount is few. Most of the cyber café here are established according to the guidelines but cyber crime rate in Dhaka city is very high.
Mr. Aziz who has a cyber café business
Mr. Aziz who is the proprietor of the Tetra cyber café situated in Farmgate, Green road, Room#19 at Al-Farid Super Market, Dhaka. He started his business in the year 2007 and get licence in the year 2008. His cyber cafe has also the membership certificate of CCOAB. His cyber café is properly maintaining almost all guidelines of CCOAB and BTRC. By the opinion of Mr. Aziz the existing guidelines are sufficient but the authorities have to make more strict guidelines for cyber café in order to prevent crime occurred in cyber café. His cyber café maintain a digital register book for the users. Mr. Aziz said that still now no crime occurred in his cyber café but if the crime will be occurred than first of all they find the address of the person who is responsible for that as we know they collect every users address on their register book. Than complain nearest police station.

A crime occurred in a cyber café named ‘Grameenphone computer training and
cyber café’
Grameenphone computer training and cyber café situated in 4th floor, Popular Hospital building, Rai Shahab Bazar, old Dhaka. This cyber café is started in the year 2008. Besides their cyber café they have also computer teaching institution. They maintain the register book according to the guidelines of CCOAB but they keep CD room for each computer which is prohibited by the BTRC guidelines. They have an experience of a crime which was occurred in their cyber café. It was like that as we know during the hot season electricity supply stopped at each one hour. During that time a man was using his facebook and unfortunately the electricity was gone and he could not log-out his facebook and leaved the cyber café. When electricity supply started, on that computer another young boy used this and he found the facebook open. The young boy did not log-out that facebook Id and by using that he uploaded offensive image. But after a few minutes when the original owner came and saw that the young boy used his facebook then complain to them and they caught him and complain about this to his parents but they did not complaint about this incidence to police authority as they think it is a matter of their reputation of business.
A miserable story about Shakil who is the victim of cyber crime
Shakil is a student of Jagannath University on the Department of Law. He is 20 years old lived in Dulaikhal, Old Dhaka. In the year 2011 he suffered harassment by the cyber café. It was like that during that time he was using his facebook in a cyber café. After a few minutes he leaved the cyber café and forgot to log-out his ID. After an hour one of his friends informed to him that offensive writings and image posted from his (Shakil) ID. Then immediately he run to the cyber café and caught the person who was using his ID without log-out this. After that the cyber café authority inform to the parents of the person who was responsible as a punishment. When Shakil try to inform to the police authority the cyber café owner request to him not to inform to the police authority as it hampers their reputation of the business. Actually it was a fault of him that he was not concern about to log-out his facebook ID. After then when he use computer on any cyber café than first of all he concerned to log-in and log-out of his e-mail and facebook.
A cyber café furnished by all guidelines
Cyber café name : Dynasty Address: Elephant Road, Katabon.
This is the cyber café which have all facilities and it established according to the guideline of CCOAB. They started their cyber café in the year 2007 and they got licenced February 2010. They have the membership certificate of the CCOAB. Their charge for using cyber café is 15 taka/half an hour and it is approved. They don’t use any CD room on the user’s computer and also have partition on the each computer for users. They have one mobile phone number and two e-mail address for communicating with them. There is also complaining box for the users.

A cyber café whose owner has many expectation
Digital cyber café situated in Nilkhat, Dhaka. They started their cyber café business in the year 20o3 and got the licence in the year 2011. They maintain digital register book for the users as well as all the guidelines of CCOAB. But they have many expectations to the CCOAB authority. The expectations are following 1. Electricity charge should be reduced 2. Charge for the users should be increased 3. Loan should be distributed without interest for the cyber café business 4. Give permission to open the cyber café everyday in a week and also 24 hours. Besides above three case study I also investigate more cyber café in Farmgate, Dhanmondi, Khilkhat and old Dhaka city are like, Win Cyber Café (51/A, Rois Bhaban, Farmgate), Click World Cyber Café (House #1, Road #10, khilkhat), Broadband Cyber Café (Road #8, House #3, Sector #6, Uttara), Blueplanet Cyber Cafe Ltd.(Dhanmondi Plaza, House #8/A, Road #6, Dhanmondi). There condition is same. Main problem is that though they established their cyber café according to the guideline but the cyber crime rate is increased day by day. By the investigation of this cyber café it is found that they have no licence or membership certificate of the CCOAB. Even they don’t know that there is an association in our country for the cyber café owners. They do not maintain any guideline of the CCOAB and BTRC. They have only three computers with no partition and besides these they have another business. And the charge is also very low 20 take only for one hour. Users can easily use CD room that is prohibited. It is also found that there are many offensive materials on the user’s computer’s hard disk that is also strictly prohibited.
The condition of cyber café on the other district of the country is almost same. Like by the investigation of the cyber café in Shirajgonj; Chondrokhotha and Shishir cyber café and in Rongpur district; Mamoni cyber café, lalbagh Railghat, cyber café in Ghopto para, Rangpur; it is found that besides their cyber café they have another business. different. They do not maintain the guideline of the CCOAB; even they have no register book for the users. For those reasons cyber crime in those areas are very high like uploading pornography on the website, e-mail frauds of another, e-mail threat to other users, Hacking etc. Users A study is also made by the students of Jagannath University, some of employee and some of my friends in different universities. They gave their opinion individually. Most of them are the daily users of internet in cyber café and most of them are well-know about the guidelines of users. Most of them are agree with the same fact that due to the cyber café cyber crimes are increased day by day. They make responsible the cyber café itself as well as users for the crime occurred in cyber café and according to them few possibility to capture is the main reason to occur cyber crime in the cyber café.
Romana Rosy, her opinion about the cyber café
Romana Rosy is a student of Jagannath University on the Department of law. She is well-known about the guidelines of Cyber café and according to her E-mail threating, watching offensive material, cyber pornography and e-mail fraud are such types of crime which are occurred in cyber café. Few possibilities to capture and few users charge are the reason behind the crimes occurred in the cyber café. She told that both the cyber café institution itself and users are responsible for such crimes.
Tanvir Arafat and Sharmin Aktar Rikta, their opinion regarding the responsibility of cyber café users
Tanvir Arafat and Sharmin Aktar Rikta who are the students of Jagannath University on the Department of Law. Normally watching offensive material, Cyber pornography and e-mail fraud are the crimes which are occurred in cyber café, according to their view. Upon their view cyber café users are responsible for occurring such crimes. According to them this is the responsibility of the users- they should not perform offensively in the cyber café. Some users abuse the modern technology by doing such crimes in cyber café and this is their low mentality.
Recommendation
We have some guideline for establishing cyber café and for users and laws for cyber crime but day to day cyber café increased without maintain guidelines and the also the cyber crime increased day by day. If we don’t take proper steps for this than in future we face on heavy danger by cyber crime. So on my recommendation point I want to recommend following views__________

3. Take strict steps if cyber café don’t get licence. 4. At least once in a month investigate the cyber café by the concerned authority. 5. To identify the criminal we can use CCTV camera on the cyber café, besides taking clients IDs and details to tackle cyber crimes emanating from the cafes. 6. Besides those, if you are not carrying a photo-ID card, you will have to get your photograph taken by web cam in the cafe and enter your details on the computer and your photograph will be stored in the computer. Besides above recommendation, All the Internet cafes have rules users must comply with in order to use the facilities. These rules are decided by the Cyber cafe Owners Association of Bangladesh (COAB). Members of the COAB are required to abide by these rules, which include maintaining customer privacy and limiting use by school students. They are also urged to cooperate fully with law enforcement agencies. They are also required to collect identifying information on all users. Many of the suspects arrested for cybercrimes are apprehended as a result of their activities in cyber cafes. Cyber cafe owners are accordingly extra-vigilant about new customers and are known to monitor anyone who looks suspicious.

Conclusion
Net extortion, credit card fraud, hacking, virus dissemination, harassment via email - all this was unheard of a few years ago but now have become common names in the area of cyber crime. The nature of cyber crimes that have been reported lately have left us shocked. Internet is being used as a medium by many people to make fast money or to indulge in criminal acts. There is no limit to the way a human mind can think but it is in our hands to take precautions to prevent falling prey to such insidious acts. And cyber café is the place where anybody can able to use internet with very low charge and it is the place where anybody can be able to commit cyber crime without fear of indentify. So if we want to decrease the rate of cyber crime than as must concern about the guideline for the cyber café owners and users and take proper steps if anybody break those guidelines.
