Guy Paul Morin, David Milgarrd, and Donald Marshal Jr, were all victims of inaccurate prosecutions. These three cases represent a failure in the Canadian criminal justice system due to many factors. So why does the criminal justice system fail to prosecute the correct victims? This is because the system fails to utilize their resources efficiently and the techniques in prosecuting a victim are used carelessly. Many cases that have wrongfully convicted victims usually occur because of the misuse of evidence, how the evidence was obtained and how the evidence was handled. Guy Paul Morin, David Milgarrd, and Donald Marshal Jr, all of these names have all been wrongfully convicted due to the poor use of evidence and lack of proper police work.…show more content… David Milgarrd was convicted of the murder of Gail Miller. The police were contacted by David's friend, Albert Cadrien, who had become suspicious of the David's behaviour and also seen blood on his shirt. Albert Cadrien was later revealed that he was a payed informant to provide statements towards David. This statement was conflicted with the other two friends of David, Nichol and Ron, which they had said that David was with them the morning Gail had been murdered. Police did not believe their stories and eventually kept bringing them back until one interview where both Nichol and Ron had changed their stories revealing evidence of David being involved in the murder of Gail. During David's trial, it was hard for David to win because the evidence that was used had convinced the judge that David did commit the murder. The statements of his friends were used and also an event of David reenacting actions of the crime, this was seen to have been a terrible joke. After his trial he was found guilty and spent 23 years in prison. On August 28, 1980, Larry Fisher's ex wife, Linda, had suspected Larry to have convicted the murder of Gail, Linda reported that she was suspicious of Larry's reaction toward her assumption that he did commit the murder, she also noticed a knife missing from her kitchen. Roy Ebsary, the murderer, was also at the park who was drunk and violent at the time. The police officers that were called to the scene handled the crime scene poorly, when they arrived at the area they did not enclose the crime scene, they did not search the area for evidence, and did not question any witnesses. After seale was proceeded to a near by hospital, none of the officers had stayed to preserve the area. Not a lot of evidence was gained throughout the investigation, it concluded with two witnesses pressured into approve of the polices story which was that Donald had murdered Sandy. One of the witnesses was on probation and the other one seemed to have delusions. Donald's defence team did not conduct any investigation or ask the crown for disclosure. Ten days after the conviction James Mcneil, had came forward in telling that Ebsary did stab Seale. This evidence was not used and the police refused to investigate. A decade later, Donald had found about this evidence and hired a lawyer to investigate. Later the RCMP investigated and found enough evidence to prove that Ebsary stabbed Seale. The RCMP had Donald lie about him trying to rob Ebsary. Instead of the law owning up to their own mistake it made Donald look like he “had it coming” and that it was his own fault.
