INTRODUCTION

India as is seen during present days has changed its conscience towards a new penal jurisprudence in abolishing the capital punishment. This is to counter the plenary provisions of Article 5 of International Covenant on Civil and Political Rights, 1966 and its protocol in 1989 where the State parties believed that abolition of death penalty should be in the scale of enhancement of human dignity and progressive development of human rights and recalling Article 3 of Universal Declaration of Human Rights adopted on 10th December, 1948 as well as Article 21 of our Constitution.1

It can be judicially said “I don’t punish you for killing the man but so that the other cannot be killed.” That is, the chief aim of capital punishment is to make deterrent to others for same crime . Now this concept is having a new direction. The Supreme Court and High Courts in India interpret the cases before giving the death sentence as rarest of rare cases. The Court moves its eye also for other aspects of society. The landmark cases where death sentences were awarded in India are Ranga Billa case2, Indira Gandhi and Rajiv Gandhi Assassination case, Laxman Nayak case 3 and the lastly, it was awarded to Dhananjoy Chatterjee on 14th August, 2004 in connection with Hetal Parikh case of West Bengal after the Supreme Court affirmed the death sentence awarded by lower courts and President also refused to grant him pardon.

In the year 2003, Government laid a bill in the Parliament which proposed to add a provision of the punishment, like death sentence in the Drugs and Cosmetics Act as also it was

...What is something I feel strongly about? I took about five minutes after reading the prompt for this writing assignment before I knew exactly what I wanted to write about. I am going to write about how I think the death penalty should be abolished. There are many reasons behind the idea of myself wanting it to be eradicated. I personally believe that the death penalty is just unfair. The saying “Don’t fight fire with fire” is a perfect example to be incorporated with my thoughts and feelings. Just because someone kills someone doesn’t mean that we should retaliate with the gesture that got them in trouble to begin with. What kind of example is that giving the community, or the whole state for that matter, to handle their problems? Another reason that I feel so strongly against the death penalty has to do with the judicial process that has to be gone through just too even began the execution process. There has to be so much extensive research done to make sure those innocent men and women do not get executed for a crime that did not even commit. Even with going through all these precautions, the risk of executing an innocent person is still there. While this process is happening the guilty party just has to sit and hesitantly wait to have their destiny pronounced. Imagine how the innocent people feel after they wait and then find out that are declared guilty, they were not only accused of something they did not do but then they almost got killed because of it. According to Spickler and Oberleitner (2011), Choriocarcinoma develops from genetically deformed germ cells which usually produce sperm or eggs (pp.1012-1014). There are no known means of prevention for this disease. ...William Wordsworth's piece, "The Rainbow," offers an intriguing look into the human soul. Standing at only ten lines, the poem details a journey through Wordsworth's philosophical beliefs. The subject of the poem “the rainbow” simply answers the question as it implies, through metaphorically expressing the abstract idea, “ the love of nature” creating the theme for the poem. The imagery of the rainbow creates feelings which help Wordsworth communicate his ideas and feelings. Which in this case are his contemplative ideas of growing up but never changing, like the rainbow never changes. The register of the poem is very simplistic, with short simple lexis which creates a stead pace. Also the gentle soft lexis ‘life’ ‘heart’ ‘sky’ creates a great contrast to the hard harsh word ‘die!’ which is where Wordsworth is at the climax of expressing his emotion towards the thought of not feeling the same way about nature. The majority of the poem is monosyllabic which suggests simplicity but the verbal constructs “was it/is it/be it/could wish” along with the lexis “piety” modifies the simplicity. This suggest the sense of humility and awe Wordsworth feels if the presence of nature and the monosyllables express the grandeur and weight of that feeling. The pattern in the phonology within the poem also suggests awe but soon shows excitement. The beginning of the poem contains long-vowelled syllables such as ‘heart’ and ‘behold’, portraying wonder and bewilderment, where as ‘was it’ ‘is it’...
