...Minimum Wage: A Historical Perspective and its’ Future On June 18th, 2004, Senator Kerry announced his minimum wage plan, saying, “I’m running for President to build a stronger economy that lifts up families and expands opportunity for hardworking Americans. Today, there are workers, many of them women, struggling to get by on the minimum wage. That is wrong. We can do better. And together, we are going to change it. I want to build an America where working families can get ahead, where a family working fulltime does not have to raise their children in poverty.” (Burkhauser 1) Classical economists have proven for years that floors and ceilings on prices are bad for economies. So why do politicians, who call themselves progressive, continue to beat the drum of creating a living wage? The reason; to get more votes. A wage floor is strictly a political issue disguised as a social problem needed to help the poor. Raising the minimum wage has taken on a fever pitch in Congress this year, regardless of the fact that there is not a widely accepted empirical economic study suggesting it is the correct policy to assist the working poor. This paper consists of research conducted by the author from both the government activist and laissez-faire positions. Black’s Law Dictionary defines customary law as “customs that are accepted as legal requirements or obligatory rules of conduct, practices and beliefs that are so vital and intrinsic a part of a social and economic system that they are treated as if they are laws. Tobin and Taylor add to this the recognition that such legal regimes are dynamics and constantly evolving and often at all provide a still broader definition of customary law, stating that: “Customary Laws include customary worldviews, principles or values, and codes of conduct, and established practices. They are enforced by community institutions, and can have sanction attached. They are divided from natural resource use – some practices and beliefs acquire the force of law. They are locally recognized, orally held, adaptable and evolving.” Historically, the relative influence of each of natural law, customary law and positive laws has fluctuated throughout time and space. The strong emphasis on positive law in the field of international law during the 18th century led to a decline in the persuasion of natural law and the customary law in the western world. NAIK 1.One of the major educational controversies today refers to the role of the Government of India in education. Prima facie education is a State subject. Entry 11 of the List II of the Seventh Schedule to the Constitution lays down that “education including universities, subject to the provisions of Entries 63, 64, 65 and 66 of List I and Entry 25 of List III” should be a State subject. But there are some other provisions in the Constitution itself which contradict the almost absolute delegation of authority suggested by this entry in the State list; and what is even more significant, the Central Government has since shown an unprecedented activity and interest in the field of education ever since the attainment of independence. In 1947, it appointed a University Commission and has since been engaged in evolving common policies in Higher education such as the introduction of the three-year degree course. This was followed by a Secondary Education Commission which tried to introduce a number of uniform trends in a field where the Centre has had hardly any constitutional authority. No Commission was appointed in the field of Primary education. But the scheme of Basic education was declared to have gone beyond the stage of experimentation and was also adopted as the national pattern at the Elementary stage. But for three generations, from my grandfather, they have been Prime Ministers in several Kathiawad States. Uttamchand Gandhi, alias Ota Gandhi, my grandfather, must have been a man of principle. State intrigues compelled him to leave Porbandar, where he was Diwan, and to seek refuge in Junagadh. There he saluted the Nawab with the left hand.
