...voter the ability to choose whom they wish to appoint into the office of a legal official, giving power based solely on the people and the votes that they cast. In the Sutter area we have several positions that come into the effect of preserving and nourishing our basic human rights, while also taking care of the environment and the ecosystem. The elected officials in the Sutter area are picked primarily through the votes of the local people that live in the district. For this interview, I decided to interview District Attorney Ms.Amanda Hopper, whom was elected in her position. The district attorney of each county makes large decisions on the innocence of a person, offer plea bargains to reduce sentences for crimes, but they may also conduct their own trials with a specially picked group of peers watching. This fascinated me as Ms.Hooper helps the county on the behalf of balancing difficult choices to assure that she helps keep the streets of the city free from people that could be harmful. While the District Attorney is displayed in many shows as being a useless side person that is harsh and has a ‘what I say goes’ attitude, Amanda works closely with other members in her office and people in the court system....

...In the small town of Tidewater, an Assistant District Attorney was found guilty of child molestation and sexual exploitation of children. These counts are already looked at as a disgrace by society, but even more so when involving a person of law. These acts hurt both the life of the child, the community, and even that of the Assistant District Attorney. In this particular case, the Assistant District Attorney was sentenced to five years in prison and ten years on probation. Some may believe this to not be a fair sentence in terms of justice for the child. One of the most popular topics of our social contract is the right of the state to issue punishment. Part of this right also includes correction. The goal is to punish the wrong doer, correct his behavior, and send him back into society as a productive member. In this case, the Assistant District Attorney is first punished by having his freedom taken away from him. The goal of this is to protect the freedom of others, especially the victim and their family. This is known as the “ethics of care”, which is centered...

...Ethics for Prosecutors and Defense Attorneys Phillip C. Moore U.S. Courts Professor Shenia C. Kirkland, Esq. January 29, 2013 Ethics has been defined in many ways, but one true definition remains elusive when attempting to obtain a clear and concise meaning of ethics. For this paper, ethics will be defined as rules of conduct in regard to specific actions as administered by a particular group of people; i.e. medical or Christian ethics (Webster, 2012). The purpose of this paper is to address two cases in which the prosecutor and defense attorney violated the Attorney Professional Code of Conduct. This paper will summarize the facts of the case and detail the duties of either the prosecutor or defense attorney; determine which duties were breached and what should have happened to bring them in compliance; and will deduce both the personal and professional ramifications of their actions. The first case to be discussed will be one that the Innocence Project appealed on behalf of Ralph Armstrong in Dane County Wisconsin. Ralph was convicted of the rape and murder of college student Charise Kamps in 1981. For the duration of his twenty eight year incarceration, Ralph maintained he was innocent. An internet search of the trial proceedings and how the jury reached their verdict of guilty in the original trial proved to be a dead end. However, the Innocence Project website and several news agencies provided the information on how the prosecutorial misconduct...

Appellee's Petition for Rehearing Denied February 2, 1983. GLICKSTEIN, Judge. The State appeals from an order granting appellee's sworn motion to dismiss and an unsworn motion to dismiss based upon alleged prosecutorial misconduct.1 We find the order erroneous; therefore, we reverse and remand. The amended information alleged that beginning on or about December 26, 1979, and continuing thereafter through on or about January 17, 1980, appellee and five others conspired to traffic in cocaine and cannabis. The sworn motion to dismiss conceded that the depositions of two of the undercover officers and one of the coconspirators reflect that appellee, a lawyer, discussed arrangements for the sale of sixty kilograms of cocaine to the officers for $3,000,000 and 20,000 pounds of marijuana for $500,000 in several meetings over a period of weeks. However, the sworn motion contends dismissal was compelled because of two reasons. First, it relies...
