The facts suggest that arbitrator did went beyond the consider of the infraction which the arbitrator was not entitled to do to order Romney to reinstate employees. Ryan could still argue that the arbitrator didn’t exceed their power as the order concerning reinstatement was natural and implicit extension of the power to arbitrate this dispute. Ryan Funeral Home Case Study

...RYAN FUNERAL HOME CASE INTRODUCTION On a warm Chicago evening in August 2005, Regina Ryan leaned back in an overstuffed armchair in her brightly lit apartment above Ryan Funeral Home. Seventy-five years old and a widow, Regina smiled as she looked at the sons and daughters gathered before her: Maureen, Patrick, Sean, Brendan, Conner, and Siobhan. Finally she spoke: “Your father was proud to own his own funeral home. He built this from nothing to what it is today. By serving local families so well, the name Ryan Funeral Home has come to mean compassion, integrity, and quality to those in this area. Reputation is everything in the funeral business. “He’s gone now, and I must decide what’s to become of all this. I always thought it would be a simple decision: pass the business to the next generation.” “It’s not so simple. The funeral industry has changed dramatically from what it was when we started out. It’s much harder to make a living than it once was. Nonetheless, I know that the reason your father started this business was because he wanted something to pass on to his children. This was to be his legacy.” As her mother spoke, Maureen thought about how important the future of Ryan Funeral Home was to her personally. She was the only one of the six children who had become a funeral director, and she has worked alongside her father for eleven years. Maureen often met with families to make funeral arrangements when her father was busy elsewhere...

...the Asian, the Spanish, the Persian, the rich, the poor and even the cops and criminals. Everyone is both a victim and guilty of racism. People’s impulses have been an issue within this movie. A negative impulse have been instinctive and their positive one could be and have been dangerous. This movie shows that everyone feels prejudice against other cultures, groups or races and somewhat resents them for it. The actions and feelings displayed and touched on throughout the movie are simply just the consequences. The first demonstration displayed in the film of racism or an act of racism came when a wife of an attorney, played by Sandra Bullock assumed that the two men walking towards her were to going to rob her. Though that became the case, she made an assumption based on color or ethnic background. I don’t believe that she should have based on the area that they were all in and the restaurant that they came out of. This displayed subjective reality. Subjective reality is when what you perceive to be true actually does come true. So Sandra Bullock’s character plays that part when she sees the two men as a threat, she grips her purse causing her subjective reality to become true. An LAPD officer, played by Matt Dillon displays an act of racism as well based on pulling over, harassing and assaulting a husband and wife of color, just because he had...

Gun Control

...Arguments on Gun Control Arguments on Gun Control Introduction Gun control is law and policy which has been developed for the purpose of restricting the import, production, shipment, possession, use and sale of the firearms. There are variations in the laws and policies of gun control around the globe. There are strict gun control policies in United Kingdom. On the other hand, the gun control policies in United States are modest. Many people claim that the gun control policies are very effective and there should be strict control on the implementation of these policies. On the other hand, a group of people thinks that the gun control policies are not so effective and there should be no strict policies on the firearms. Thus, the both sides provide their arguments on the issue of gun control. The main aim of this paper is to persuade against the policies of gun control. The paper is comprised of both the arguments in favor and against of the gun control policies. Discussion It is so easy to understand that without guns or rifles, killing of criminals would have been much more difficult to consummate, which is sometimes hard to explain how it is possible that guns are legal in the largest and most powerful democracy in the world. But it is undeniable that easy access to firearms greatly facilitates this sinister task (Amo, 1989). The criminals have committed one of the latest killings with firearms that shook Americans, 14 Dead Colombine students in 1999...

If a student should use the ideas of an outside source he or she must properly cite every resource used; fail to do so is plagiarism. Plagiarism is a serious issue and seems to be getting out of hand since the technology boom. The internet has paved the way for cheating students; making writing assignments as easy as clicking a mouse. Some students in today’s world are finding it easier than ever to cheat. With websites that specialize in selling term papers to lazy students; how can teachers ensure that their students deserve the grade? High speed technology has been wonderful for our economy and way of life; however, it has also put academic honesty to the ultimate test. Before Computers Plagiarism is a crime that has been committed continually ever since the written word; the Middle Ages and Renaissance saw the continuous use of others ideas without proper recognition. Romans stealing from the Greeks, and the thousand times over, re-written versions of all the biblical books being inexactly transferred from a millennia of ancient scribes and medieval scripts. During the time of the Renaissance, thoughts and ideas were used quite regularly without due acknowledgement. Authorship did not...

Nordstrom Case Analysis

...MORALES, Marc Russel M. BSBA-MM II-C MM100 – Fundamentals of Marketing Management MABEZA, RYAN MARVIN Nordstrom’s Case Analysis Companies are everywhere. Competition in a global business world are in left and right scenarios. So companies must find the right ingredient for them to be successful. Creating loyal customers is at the heart of every business. Improving efficiency in connecting to customers, building customer satisfaction, customer value and loyalty leads to improved and better business results. Marketing experts Don Peppers and Martha Rogers say, “The only value your company will ever create is the value that comes from customers—the ones you have now and the ones you will have in the future. Businesses succeed by getting, keeping, and growing customers. Customers are the only reason you build factories, hire employees, schedule meetings, lay fiber-optic lines, or engage in any business activity. Without customers, you don’t have a business.” Companies must establish and maintain a high customer value for their products and services because consumers use customer value to make buying decisions. You make buying decisions in day-to-day life experiences. For example in buying for a bottled water drink. Should you buy the wilkins worth P15 or the evian water worth P65? In every buying decision, a consumer asks the same question: 'is what I am going to receive worth what I have to give up in order to get it?' The gain the consumer receives for the benefit is...

No subsequent modifications were made. Tax professionals are frequently called on to guide fiduciaries through income tax complications resulting from the death of a taxpayer. While a tax preparer should never try to replace the estate attorney, there are services she can provide. This chapter gives an overview of what might be expected. When a taxpayer dies, the court appoints someone (a fiduciary) to handle the taxpayer’s estate. This fiduciary’s title can be executor, executrix, administrator, administratrix, or personal representative. The fiduciary has a responsibility to the decedent’s estate. Primarily, the fiduciary has the responsibility to follow the guidelines of the will and handle the assets of the estate for the best interests of the beneficiaries. Consequently, it is important for the fiduciary to have a basic understanding of various issues that arise when a taxpayer dies. The fiduciary completes a Form 56, Notice Concerning...

Dangerous Minds

...gang violence and segregated schools and neighborhoods as well as trying to acclimate herself to whole different culture. Most of the teachers and the school authorities care nothing about these students and their problems, and are simply passing them along without teaching them anything. Miss Johnson does come to care about them regardless of their race and ethnicities. Miss Johnson ends up using highly unconventional teaching methods as well as showing great concern about their personal lives. Although she had wanted to quit and give up on the first day, in the end she becomes so involved in trying to teach these students who have been marginalized and thrown away by society that they plead with her to stay. In absolutely every case, the quality of education available to poor and minority students is demonstrably poorer by any measure than that of their white peers in the suburbs, as researchers like Jonathan Kozol have pointed out many times. This is not caused by genetic or cultural deprivation but by the fact that the U.S. has always been and remains a highly segregated and unequal society based on race and social class. In Savage Inequalities, Jonathan Kozol offered an absolutely horrendous description of public schools and the social structure in inner city "ghettos" that at times reduced him to tears and rage. Chicago, Detroit, East St. Louis, Camden, Jew Jersey all have crumbling public school systems serving mostly black and Hispanic students funded at...

Prosecution of Bullies

...after a day when she was allegedly harassed in the library, in the hallways and on her way home from school--a canned drink thrown at her, and the words "You Irish slut, you Irish whore". Phoebe Prince went home, picked out a scarf her sister had given her for Christmas and hung herself in a stairwell. Her sister found her. The mean girls? They logged on and mocked her death.” (Gibbs, 2012) She is only one in many victims that could have been saved. “By words alone perpetrators of bullycide kill their victims without laying a hand on them.” (Wallace 2011) These girls should have been held responsible for their actions, yet they were not. Everyday many adolescents are being bullied to extreme measures, pushed to the verge of death, in most cases, by suicide. And just like the young Phoebe, nothing was done to help them. Is this the life we want our children to suffer through? Clearly no, but what’s the answer. Surely there has to be a way to stop this abominable act. It is clear that those who partake in bullying should be prosecuted for their incredulous actions. Bullying is a major contributing factor in actions of suicide and self-harm. Many studies show “Bullying victimization was significantly and positively associated with self-harm and suicidal ideation.”( Hay, Meldrum 2010) Victims of bullying are harming themselves to the point where they are hospitalized and are forced to miss school. This all because some people feel the need...

Rock and Roll Has Lost the Ability to Effect Meaningful Societal Change

...genres of today can still prod listeners to champion for social change, the rock music market has fragmented so dramatically that rock and roll has lost the ability to impact mass sections of the population and has therefore, lost its unique voice and ability to effect real social change in US society. The turbulence of the 1960’s, due to the escalation of the conflict in Vietnam to a full out war, the assassination of both President John F. Kennedy and Martin Luther King Jr. and the push for civil rights for all people made for fertile ground for songwriters to encourage change for the better through their music. (Hibbard and Kaleialoha, p 122) Lyricists and composers worked in tandem to write songs to both inform the public and, in some cases, incite the public to take action against what was happening in, around and to the world. Songs such as “Blowin in the Wind, written by Bob Dylan in 1962 and “Ball of Confusion (that’s what the world is today)”, written by Norman Whitfield and Barrett Strong in 1970 for the Temptations spoke to the listener about war and the stress of living during the confusion of the late 1960’s and 1970’s. A survey of Top-40 rock stations in Los Angeles, the second largest radio market in the United States shows that in the 1960’s there were 3 major stations that appealed to teenagers and young...

...Allstate Insurance Company     the process of goal setting, for any organization, is vital for success in today’s highly competitive global work environment.   Hellriegel and Slocum, (2011, pg. 192) state the process of goal setting involves specifying desired outcomes that individuals, teams, departments, and organizations will strive to meet. Effective goal setting is a valuable motivational tool which can be used to inspire higher achievement from the employees within an organization.   A goal functions as a motivator due to the fact it allows people to compare their present performance with that required to achieve their goal.   Goals must be reasonable and challenging, yet feasible, to ensure people will believe they can achieve their goals. Using the model for goal setting, evaluate Allstate’s goal setting process to determine whether or not Allstate has an effective goal-setting program.     The challenge to Allstate has become “How do you take this workforce of differences and bring them together in a more powerful way so that it can impact business results?” (Hellriegel & Slocum, Jr., 2011, pg. 194)   Allstate’s goal setting process makes certain they stay focused on affirmative action and diversity in the workplace.   Allstate has taken four specific steps to achieve this goal.
