Mr. Hocker continued to suffer immensely after the accident, initial surgery and subsequent rehabilitation. Mr. Hocker has suffered not only physically, but emotionally as well, which caused tremendous stress to his marital relationship.

Prior to the accident, Mr. Hocker purchased a disability insurance policy (the “Policy”) from your company, Common Insurance Company (“Company”) in New Amsterdam.

Lee Weiser, Company’s employee, called Mr. Hocker often, went over Mr. Hocker’s apartment in Monroe City and wanted to buy the policy, and threatened him because he would not accept $40,000.00 to buy out the policy. He complained to Common Insurance about Mr. Weiser’s actions.

Finally, Company cuff off payments to Mr. Hocker with no reasonable warning. Mr. Weiser told Mr. Hocker that he would no longer be paid any money from the Common Insurance Company, that he had already been paid $250,000.00. Mr. Hocker called almost every day to find out what happened to the payments. He got constant harassment or badgering to try to get something that owed him. Company’s agent told Mr. Hocker that if he got Social Security disability, he would still be guaranteed to get $2,000.00 a month from Common Insurance Company; however, he did not receive payment from Company.

Mr. Hocker received summaries from agents that came to visit him; and he felt something inaccurate in those summaries. In the reports, indicated that he had notified Company and asked for them to buy the contract, which was false. Mr. Hocker had no knowledge that insurance companies bought their contracts back. He did not ask for settlement where he would get $100,000.00 for four years of benefits. He did not offer to settle with Common Insurance
