Driving under the influence is driving with a BAC (blood alcohol concentration) level of .08 or higher. Driving while intoxicated may injure the person who is driving or anyone else who is on the road at the same time. In my opinion the laws on driving under influence should be changed. The reason I chose this topic is because many people are getting injured or even killed because of collisions caused by intoxicated drivers nowadays.

I believe the laws on blood alcohol concentration should be changed, making the illegal level .04 instead of .08.

Driving Under the Influence

...Driving under the Influence Abstract Driving Under the Influence (DUI) has been and is increasingly becoming more of a problem on the leading cause of vehicular deaths. This research paper will cover multiple areas of this issue such as National Statistics on DUI’s, The second most cause of DUI’s aside alcohol, How big the problem is getting, Who is most at risk, Particularly how it effects individuals in the military, both criminally and long term and last, The program M.A.D.D. (Mothers Against Drunk Driving) and how this programs helps the community. As I mentioned before, the issue of DUI’s is becoming more of an issue every day and it is not getting any better. There is this misconception that individuals can only be considered driving under the influence when consuming alcohol but this is not the case no more. The second most inhibitor of driving under the influence is Marijuana. It seems like the more time goes by, the more states make it legal to smoke. This drug can be obtained easier then alcohol as when that time comes when there is, as long as the money is right, it can be brought by pretty much anyone. National Statistics on DUI’s The annual numbers of DUI’s is pretty hard to swallow and the following numbers are just with alcohol, not marijuana. * The average number of people arrested annually for drunk driving are 1,500,000 * The average number of people who die annually in drunk driving accidents are 10,075 DUI’s Arrest by age group...

Driving Under The Influence On Drunk Driving

...Driving Under the Influence What if there were no laws? Imagine a world with no rules the freedom to do whatever we please. Sounds good right? Now imagine having to bury your daughter who was killed by a drunk driver to find out his blood alcohol content was way above the legal blood alcohol content limit of 0.8 and he thought it was okay to drive home. According to Statics reported in 2003 for every half hour at least one death occurs relating to drunk driving. A new law proposed by the National Transpiration Safety Board Lowering the legal limit from 0.08% to 0.05% in hopes to reducing drivers getting behind the wheel intoxicated and impaired. I believe reducing the blood alcohol content to 0.05% would reduce the number of fatalities or even people getting behind the wheel. This would equal two drinks for an average man that weighs about...

Driving Under the Influence

...Name: Instructor: Course: Date: Introduction DUI is an acronym for Driving under the Influence. In spite of the minimum permissible drinking age being 21, many adolescents in the United States of America drink alcoholic drinks. Most of these adolescents abuse alcoholic drinks by consuming alcohol frequent times or binge drinking. Binge drinking is taking more than five drinks in a row (Wilson, p63). Only a very small section of these adolescents can meet the Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition (DSM-IV) gauges for alcohol dependence and independence (1, 2). The advancement of consuming alcohol from its use to abusing and its addiction is linked with both psychological and psycho-social influences. This paper will seek to examine the adverse effects of Driving under the Influence and how it can be curbed to prevent any further consequences. The overall short-run and long-run effects that come from juvenile alcohol drinking and dependence are astounding in every aspect of their assortment and scale, affecting not only the adolescents but also the people around them and community as an entirety. Adolescence is a passage in one's life to maturity that is categorized by vigorous bodily fitness and little occurrence of disease. However, what is most astounding is that the overall sickness and death rates surge by almost 200 percent in the middle of one's early adolescent and early adulthood years. This intense increase is mostly attributed to the rise...

Dui and Religion

...Driving under the influence and religion Erin O’Brien Criminal Law Prof. Toni Starcher Drunk driver, Brent Birch struck pedestrian, Leah Russell with his car causing severe life-threatening injuries; he was on probation from a prior DUI case at the time. Ms. Russell lived long enough to refuse blood transfusions at the hospital citing a religious conflict; she was a Jehovah’s Witness. Ultimately, she succumbed to her injuries at the hospital a short time later. Jehovah’s Witnesses see blood transfusions as one of many barriers that could keep them out of heaven when they pass away. Because of this fact, many Jehovah’s Witnesses carry a card in their wallet that states this fact and that they fully understand their decision could have irreprehensible consequences to their potential quality of life. They do this so medical professionals do not deem their decision to be one made under extreme duress and under the influence of extreme pain (C. Miyoshi, personal communication, December 13, 2013). This case was a driving under the influence case that was complicated by the fact that Ms. Russell’s religious beliefs kept her from medical treatment that could have possibly saved her life. During the trial of Mr. Birch, prosecution witnesses testified that the blood transfusions might have saved her, but that they couldn’t be sure, though. If convicted of his charge of second-degree murder, according to the California Penal Code section 190, Mr. Birch would face 15 years...

...responding to basic physical movements. These tests have shown to be alcohol sensitive, therefore, those who are impaired will have trouble with these divided attention tasks. While the tests are being done, the officers take note of clues that are signals of impairment. However, before these tests are given, there is generally probable cause as to why the officer feels the need to investigate. The video in consideration for this paper is Top 3 Sobriety Tests- number 2. This is a short recording of an officer performing a field test on a woman whom he had pulled over in suspicion of driving under the influence. It is obvious by the woman’s driving that something is going with her due to the fact that she is swerving all over the road and this is what gets the officer’s attention. This is a probable cause for suspicion of driving under the influence (Traffic Resource Center, n.d.). He pulls behind her and turns his lights on, but she does not even notice him for a bit before she finally pulls over. When he approaches the vehicle, the woman...

(D1) Evaluate the Influence of Government on Factors That Contribute to the Current Patterns of Health and Illness in the Uk

...(D1) Evaluate the influence of government on factors that contribute to the current patterns of health and illness in the UK – Over the course of the last 50 years in the UK the government (England, Wales, Northern Ireland and Scotland) have made a great effort in order to improve the overall health of the general population in the UK. This has been achieved through the use of making the general population more aware of the dangers to their health and what they are along with they can do in order to improve it, thereby making better informed decisions in regards to their health when it comes to things such as diet, road safety (driving), exercise, smoking and education. The greatest influence that the government has had on the population in general on patterns of health over the last 50 years has been to increase the awareness on the negative effects smoking can have on a person’s health. The ill effects of smoking were originally discovered in 1961 and from that point onwards the government have worked continuously in order to stop people from smoking in order to prevent individuals from dying. The first government initiative was put into place in 1971 which led to manufactures agreeing to display on their packaging compulsory anti-smoking adverts, such as “smoking kills”. This new initiative made a significant impact on raising people’s awareness in the UK about the damaging effects smoking can cause to their health. Adverts promoting smoking were officially band...

According to the MADD group, fifty to seventy-five percent of drunk drivers whose licenses are suspended continue to drive. According to the Mothers Against Drunk Driving advocacy group, About three in every ten Americans will be involved in an alcohol-related crash at some time in their lives. On average someone is killed by a drunk driver every forty minutes. In two-thousand seven alone, an estimated twelve thousand nine hundred and ninety-eight people died in drunk driving related crashes (MADD). ...is James Lee Roman. I was charged for driving under the influence of alcohol on April 14, 2011. The DUI offense stems from my unfortunate decision to drive myself home after a birthday party. With my senses impaired, I eventually misjudged a turn and hit a tree straight-on. The incident caused my left leg to be fractured in several places, shards of glass also pierced my face. My injuries are extensive and the hours of physical therapy still come in very long, painful strides, but the lesson I learned here was invaluable. I truly realized that I was very fortunate that I did not injure anyone else, to have caused the same kind of damaged and pain on someone or even horribly death. I learned all of these things the hard way, the weeks I spent at the hospital and seeing my mother in tears of which such heartbreak cannot be undone. But I stand to correct myself and my ways. I would like to submit myself to an alcohol treatment program as soon as possible or on any rehabilitative program the court deems proper. I would like to plead for leniency your honor, please allow me the opportunity to turn my life around, I believe the possibility of imprisonment is a huge factor for change alone. Still, I would like to be responsible for my actions and accept the consequences of my offense. Inside me, I believe is an indvidual who wants to be useful and productive to the community. Prior this, I have no criminal or any record of offense, my driving record is also very much clean. I have...

Dram Shop Law

...When it comes to alcohol and alcohol related crimes especially death from drinking and driving, it is a touchy subject. However, when a crime is committed, justice has to be served and someone has to pay the price. The last person anyone would think to blame is the persons or party that provided the alcohol that lead to the crime that has been committed. I think the Dram shop laws is good when it comes to hitting the source to stop the crime but it also affects businesses and our economy, especially when it come to tax money. The real question is can we suffer as a society and economically to deter and prevent alcohol related crime and death. In my opinion, this theory/law will not work due to the fact that alcohol is not only widely used on a daily basis, but also because it will be extremely challenging and expensive to enforce the law. On top of all that, there will be a black market just for alcohol and/or people will start manufacturing their own and selling it at their own expense, just how marijuana is produced and sold illegally. If anything, the laws should be strict and less forgiving. We should not focus on the bars and social events that disrepute alcohol but focus more on what happens out on the streets and what or how we can do to prevent crimes and drinking and driving on a daily basis. If this problem became more advertised and spoken about, i feel like it would be less of a problem and we would have more of an solution on our hands. Its widely known and talked...

What I Would Have Liked to Known Before My First Experience with Drugs and Alcohol

...| What I would have liked to have known before my first experience with drugs and alcohol. | | | By: unknown | 1/25/2012 | | What would I have liked to know before the first time I did drugs or alcohol? Well the first time i really drank to get drunk i was in 8th grade. I had no idea what the difference was between vodka or tequila, and i also didn’t know that some alcohol doesn’t mix well with others. So I got into a drinking competition with a female that I had been friends with for a while. She bet that she could drink more than me so we kept going back and forth taking shots of different alcohol. I don’t recall too much from that night because I blacked out and ended up puking after I had passed out on a couch. But I do remember the last thing I drank was a shot of tequila and I couldn’t stand the taste. Just from that I wanted to throw up and while throwing up that was all I could take. Ever since I can’t stand to be around the smell. That night I had no idea that you can die from drinking too much or that alcohol poising is a real thing. I had no idea what BAC was or that there are many diff factors to drinking. I wish I would have known that it can be unsafe to drink until you can’t drink anymore. I also wish I would have known that if you puke than you are the one to clean it up, I had no idea what a hangover was. Cleaning up puke with a hangover is not a fun time. Other than that I don’t think there is too much more I would have cared to know before...

I found this information to be interesting because are demographic has a high tendency to drive while being under the influence of alcohol. I’m more interested in the effects of drunk driving on teens and adults because it is something that affects anybody who drives an automobile now a days. There is something you should know about driving under the influence. One of out every three Americans on the road has been involved in an alcohol related car crash sometime in their life time. Those are really bad odds looking at the fact that most Americans are on the road for at one hour per day. I’m very interest to learn more about the effects of driving under the influence on teenagers and adults. Most people who drive under the influence don’t actually realize the harm they can actually cause until the minute after the accident has happened. Most drunk driving incidents can be avoided with just a simple phone call. What drunk drivers don’t seem to understand is they are endangering not just their own life but everyone on the roads with them. For example, “In 2013, a total of 1,149 children fourteen and younger were killed in motor vehicle traffic crashes. Of those 1,149 fatalities, 200 (17%) occurred in alcohol-impaired driving crashes. Out of those 200 deaths...

Impaired Driving Research Paper

...topic of impaired driving for our project. By definition, impaired driving is the use of a motor vehicle while under the influence of drugs or alcohol. The driver’s ability to operate their vehicle is impaired by the substance, which puts others on the road and near it in danger. Not only is impaired driving dangerous and irresponsible, it is a criminal offense that is punishable by law. Fines for driving under the influence, (or DUI,) can go up to $10,000 in Pennsylvania. Other punishments include license suspension, jail time, and attending mandatory classes about highway safety. Under Act 24, the blood alcohol concentration level of 0.08% is considered illegal when driving. If a driver is pulled over and is found to have a blood alcohol concentration which is 0.08% or above, it is a DUI offense. In Pennsylvania, there are three levels of DUI offenses: “General Impairment, High BAC, and Highest BAC.” (“DUI Legislation”). As the blood alcohol levels increase, so do the repercussions for the crime. In addition, prior DUI offenses affect the penalties of a new offense, increasing their severity....
