...Wal-Mart Lack of compassion Tip of the iceberg can describe the story below. Wal-Mart is company No. 1 in the world. It has the most revenue over any other company ($421 Billion). But its riches equal its controversies. This story is probably the most apt at describing the unethical treatment of its workers, because of the sheer senselessness of it. In 2000, a collision with a semi-trailer left 52-year-old Deborah Shank with permanent brain damage and in a wheelchair. Her husband and three sons were fortunate for a $700,000 accident settlement from the trucking company. After legal costs and other expenses, the remaining $417,000 was put in a special trust to care for Mrs. Shank. However, six years later the providers of Mrs. Shank’s health plan, Wal-Mart, sued the Shanks for the $470,000 it had spent on her medical care. Wal-Mart was fully entitled to the money; in the fine print of Mrs. Shank’s employment contract it said that money won in damages after an accident belonged to Wal-Mart. A federal judge had to rule in favor of Wal-Mart, and the family of Mrs. Shank had to rely on Medicaid and social-security payments for her round-the-clock care. Wal-Mart may be reversing the decision after public outcry. However this case pinpoints Wal-Mart’s often criticized treatment of employees as a commodity and its sometimes inhuman business ethics. 9 Trafigura Dumping Toxic waste on the Ivory Coast and gagging the media Earlier in the year, there was media frenzy in the...

...Situational Analysis: According to the United States Air Force Capital Flyer, in 1997, the Office of management and budget requested a cost comparison or A-76 study, over a three-year period that would affect 700 military and civilian positions within the Federal Government and military entities. The A-76 study reviewed the supply and maintenance operations to determine the effectiveness of maintaining these positions as military and Department of Defense (DOD) civilian entities or privatizing the positions through outsourcing. Contrary to popular belief an A-76 study is not contracting. Its purpose is to create cost savings for the DOD through a competitive sourcing program. “The A-76 circular mandates that the government procure commercially available goods and services from the private sector when it makes economic sense to do so”. (A-76 Cost Comparison Overview, p.1, 2002). The cultural makeup of the organization is active duty and federal employees. The A-76 was implemented before our retirement, we would like to revisit the process and research the outcome and its affect on the organization and its members. This research will uncover some of the problems associated with A-76 studies/processes outside of cost effectiveness. This study will provide the effects outside of cost savings, it will demonstrate the negative affects it has on federal/military personnel jobs, civilian pay, training and the morale of the organization. Premise: The outsourcing/A-76 study...

...EEOC Paper SOC/315 Monday, August 29, 2011 Cynthia Manns EEOC Paper The U.S. Equal Employment Opportunity Commission (EEOC) is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee because of the person’s race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. It is also illegal to discriminate against a person because the person complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit (EEOC, 2011). The lawsuit I chose to write about is DynCorp International which is based in Alexandria, VA. They are being sued for sexual harassment. Sexual harassment is a form of sex discrimination. Sexual harassment is unwelcomed verbal, physical, or visual conduct of a sexual nature that is pervasive or severe and creates a hostile work environment or affects working conditions. In this case a male employee was subjected to a hostile work environment. He was being harassed by another male employee. The employee also dealt with retaliation from the company. After filing a formal complaint with his company’s Human Resource Department, he was later moved to a different site which was also a lower paying position. I don’t believe this lawsuit promotes social change because this incident involves a man being discriminated against by another man. In my opinion this...

... ISSUES The protester in question contended that these TORPs were outside the scope of the ID/IQ contracts because the requested services did not directly support counter-narcoterrorism efforts and were of a generalized counter-insurgency nature. The U.S. Army countered that the underlying ID/IQ contracts were written vaguely and broadly to the point to include such services. The Army also argued that the counter-insurgency efforts in which the Afghan Ministry of Interior and the Afghan National Police engaged constituted counter-narcoterrorism efforts because the insurgency in Afghanistan is more-or-less funded by drug-trafficking activities. HOLDING OF THE COURT The court upheld the protest, citing the supporting argument of DynCorp and that the scope...

...the Delaware Chancery Court held that in circumstances involving two sophisticated parties, Delaware law permits explicit contract disclaimers to bar fraud claims.28 The often cited case ABRY Partners v. F & W Acquisition re-examined this issue a few years later and provided a detailed analysis. In ABRY, the buyer sought to rescind the stock purchase agreement under which it bought a portfolio company from another entity.29 According to the court, the stock purchase agreement between the parties contained the purchaser’s promise that “it was not relying upon representations and warranties not contained within the [a]greement’s four corners and that no such extra-contractual representations had been made.”30 The court, citing Danann and DynCorp., stated that it honors “contracts that define those representations of fact that formed the reality upon which the parties premised their decision to bargain.”31 The court stated, however, that it will not give effect to “so-called merger or integration provisions that do not clearly state that the parties disclaim reliance upon extra-contractual...

...Final Exam (Part 2) 8 Oct 2012 Researching a Career Path I chose the Protective Security Specialist (PSS) as my career path choice. I chose the PSS path due to the fact that it was one specific area of my past experience that was lacking and it has positions all over the world through the Worldwide Protective Services (WPS) Program (formally known as the Worldwide Personal Protective Services (WPPS) Program). My initial research began with people I worked with on a Static Security project in a high threat area. I soon found out that there were a few large companies, and projects, that would serve as a starting point. Aegis, DynCorp, Global, Triple Canopy, and US Training Center were the major players in the State Department’s Bureau of Diplomatic Security Program. I spoke with work colleagues that have worked for one, or numerous, of the aforementioned companies. I was mostly interested in the areas of company vision, work beliefs, and compensation plans along with the individuals’ point of view. I then began an internet search of my top 3 picks (Global, Triple Canopy, and US Training Center). I researched news articles of specific incidents, public views, and awarded contracts. Public forum sites, such as SOCNet, provided a valuable resource on how different companies were viewed & operated by, and at, the lower levels. My final task was the research of each of the company’s specific website; focusing on mission statement, focus, and plans for the future. Networking...
