Classrooms are filled with diverse populations, including those that are learning English as a second language. Learning a new language and having to adapt to a new culture can prove to be detrimental for a student’s academic progress. English language learners struggle in the classroom and are in need of teachers that will work relentlessly in helping them be academically successful. To regulate bilingual/ESL education, there have been various state and federal decisions made. The Elementary and Secondary Education Act was passed on the heels of the Civil Rights Act of 1964. The purpose of ESEA was focused mainly on eradicating poverty, providing equal education services to all students, and implementing high standards for students and teachers. The ESEA also provided funds for state established educational programs and low income students ("Elementary and secondary,"). Although the ESEA benefited many deserving students in bad economic areas, it did not specifically benefit English language learners. Making matters worse, ESEA was reauthorized as The No Child Left Behind in 2002. NCLB required states to align their standards/requirements with the federal NCLB standards/requirements. ...THE EFFECT OF AFFECT ON FOREIGN LANGUAGE LEARNING: A REVIEW OF THE ANXIETY RESEARCH Thomas Scovel University of Pittsburgh Although studies of the relationship between affective factors and language learning proficiency abound in the literature, the evidence to support such a relationship is difficult to interpret. Much of the problem resides in the fact that a wide range of variables are lumped together under the rubric “affect.” An attempt is made to ameliorate this situation by defining affective variables in terms of traditional psychological theory and classifying them as a subset of those variables intrinsic to the learner. The conflicting evidence dealing with one important affective variable, anxiety, is then examined, and it is shown that ambiguous experimental results can be resolved if the distinction between facilitating and debilitating anxiety is drawn. Further classificatory distinctions are discussed from the abundant experimentation undertaken by applied psychologists, and an attempt is made to consider the implications of some of this research for adult language learning-for some of the new methodologies in EFL as well as for future research opportunities. In this paper I will focus on Texas and how these policies including the rights of the students, funding issues, and language barriers have impacted the way in which these school districts have had to change the policies set forth to ensure every child receives a quality public education. In Texas, prior to 1982 the law did not allow school districts to use state funds to educate undocumented immigrant children; districts were even allowed to deny enrollment to these children. (Combs, Susan, 2006) However, in the case of Plyler v. Doe in 1982 the U.S. Supreme Court ruled that Texas law was in violation of the equal protection provision of the 14th Amendment. (Combs, Susan, 2006) As a result of this and many other court cases, states can no longer deny access to public education to undocumented students nor can they attempt to identify undocumented children for fear of discrimination.
