Lømmelpakken

Lømmelpakken blev vedtaget af Venstre, De Konservative og Dansk Folkeparti efter et skarpt opgør i folketingssalen. Lømmelpakken giver politiet nye redskaber over for demonstranter og andre, der er samlet i større grupper. Lømmelpakken medfører at politiet kan lave præventive anholdelser på 12 timer i forhold til 6 timer tidligere. Samtidig blev bødestraffene femdoblet og det blev muligt at fængsle demonstranter i op til 40 dage, hvis et påbud om at forlade en demonstration ignoreres.

Problemformulering: Hvorfor fik Danmark en ”lømmelpakke” og hvordan kan beslutningsprocessen karakteriseres?

Tidslinje over beslutningsprocessen:

19. oktober 2009: Brian Mikkelsen (daværende justitsminister) sender lovforslag til offentlig høring hos både organisationer og berørte myndigheder.
29. oktober 2009: Lovforslaget fremsættes i folketinget.
4. november 2009: 1. behandling → behandling i retsudvalget.
18. november 2009: Ændringsforslag
19. november 2009: 2. behandling i folketinget
26. november 2009: 3. behandling og vedtagelse med 58 for (V, DF og K) og 50 mod (S, SF, R, EL, LA)
3. december 2009: Lømmelpakken trådte i kraft.

Fasemodellen
Meningsdannelse:
Lømmelpakken blev vedtaget, da der var bekymring for det kommende klimatopmøde, og derfor skulle denne pakke forebygge og forhindre uroligheder ved Klimatopmødet.
VK regeringen havde en interesse i at vise handlekraft og vise, at de har en stærk retsstat der tager fat. Dette støtter Konservative stærkt op om, og dette afspejles også i deres ideologi.
Lømmelpakken blev officielt lanceret i artiklen “Klimaaktivister står til bødesmæk” af Peter Christensen (Jyllands-Posten d. 15.09.2009). Denne artikel starter debatten om lømmelpakken, og er dermed også med til at skabe en meningsdannelse ikke kun i partierne, men også hos de danske borgere.

Dagsordensfastsættelse:

Problemstrøm: Frygt for uro i forbindelse med klimatopmødet.

Politisk strøm: Regeringen var interesserede i at vise, at de var handlekraftige.

Løsningsstrøm: Stramninger af straffeloven i forbindelse med især præventive anholdelser.

Policy-window (beslutningsmulighed): Både medieomtale og en kollision af de ovenstående strømme. Derudover er der en kommende begivenhed, der gør, at denne lovgivning kan fastsættes.

Aktiv beslutningsdagsorden: Stramninger af straffeloven ift. bødestraf, fængselsstraf og præventive anholdelser

Beslutningsfasen:
Beslutningsprocessen kan beskrives som garbage can modellen. Denne model kan bruges til at forstå hvordan beslutninger tages ved at de uafhængige strømme mødes og bidrager til en fælles beslutning. I denne model er der ikke tale om en længerevarende og gennemtænkt process, som er kendetegnende for andre beslutningsmodeller. Det nævnes ofte i sammenhæng med denne model at mediernes omtale og opmærksomhed påvirker processen. Lømmelpakken blev vedtaget i en tid hvor vold og hærværk var et hyppigt emne i medierne. Det var et emne hvordan demonstrationer og demonstranter skulle påvirke klimatopmødet. Samtidig havde der tidligere på året været fredelige demonstrationer i forbindelse med afviste asylansøgere, der opholdte sig i Brorsonskirken i København. Her demonstrerede danskere for at politiet ikke skulle sende dem hjem. I forbindelse med denne sag der høstede stor medieopmærksomhed var politiets beføjelser ligeledes et emne. Tidligere på året havde der desuden været optøjer i forbindelse med bandekrigen på især Nørrebro i København.

Implementering:
Implementering er udførelsen af en idé/plan. Det er ordet for den proces, som beslutningen går igennem fra vedtagelsen til gennemførelsen. Så i modsætning til beslutningsfasen, er det ikke tanken bag det, men udførelsen af beslutningen i praksis.
Mange danskere, hele 55%, mener at lømmelpakken skal bibeholdes, fordi de mener at der vil blive brug for den igen. "Befolkningen er overbevist om, at det var lømmelpakken, der gjorde, at klimatopmødet forløb så roligt, som det gjorde.” udtaler SF’ retsordfører Karina Lorentzen i atrtiklen “Vi er vilde med lømmelpakken”. Folk ved at klimatopmødet forløb roligt takket være lømmelpakken, men andre mener at den skal afskaffes igen, da klimatopmødet blev brugt som årsag til, at den blev indført. Juraprofessor Eva Smith, tror ikke at dem der mener at vi skal beholde lømmelpakken, ved hvad de siger ja til, og hun håber ikke at man vil beholde den. Som modsvar til det siger retsordfører i de konservative Tom Behnke, at det jo kun er lømlerne, der har grund til at være bange for lømmelpakken.

Effekt og feedback:
Lovforslaget har gennem processen mødt megen kritik, men også efter lømmelpakken blev indført og set i praksis ses en skarp kritik. Flere peger på, at der er alvorlige fejl i lovgivningen, og at der både sættes spørgsmålstegn ved politiets praksis ved klimatopmødet, men også politikernes metode til at udarbejde loven. Ifølge Amnesty er “Det helt ude af proportioner. Med så mange præventive anholdelser bekræfter det, at lømmelpakken ikke fungerer, og den bør gås grundigt efter i sømmene” (Dagbladet Politiken, 13-12-2009)
Dog er lømmelpakken også mødt med ros, og DF siger bl.a., at “der er ingen tvivl om, at det er lømmelpakken, der har gjort, at politiet har kunnet slå så kontant til over for de professionelle ballademagere. Havde vi ikke fået vedtaget lømmelpakken, så var Amager blevet lagt øde af disse autonome krigere, siger Dennis Flydtkjær og roser politiet for en storartet og yderst veltilrettelagt fremfærd i forbindelse med demonstrationen.”

Aktører:
Forslag fremsat af Brian Mikkelsen (venstremand)

Venstre går ind for en lømmelpakke.
Radikale og Konservative bakker op omkring venstres forslag, som mener, at man giver politiet nogle gode redskaber at arbejde med og tror på, at det vil virke.

SF og socialdemokraterne starter med at være imod loven, men ender med at gå sammen med radikale og støtte forslaget om hårde straffer for gadeuorden, dog stadig med nogle betænkeligheder fra SF. Til slut stemte de imod forslaget.

Danske advokater (Advokatrådets strafferetsudvalg) advarer imod loven, og siger at man er ved at lave samme fejl som man lavede med knivloven. Med dette menes at lovændringen vil ramme andre end egentlig tiltænkt.

Radikale er kun positive over for lømmelpakken til at starte med, men begynder at blive skeptiske over for den. Det samme gælder for SF og Socialdemokraterne. Selvom de på et tidspunkt bakker op omkring den begynder de at se mere skeptisk.

Den danske afdeling af Amnesty Internationals mener at ytringsfriheden og forsamlingsfriheden trues af lømmelpakken. Desuden mener organisationen for menneskerettigheder at loven vil kunne få almindelige mennesker til at lade vær med at demonstrere.

Retssikkerhedsmæssige problematikker ved Lømmelpakken rejst i høringssvarene

Domstolsstyrelsen fremhæver at man burde stramme §119 stk. 3 så man kan frihedsstraf også i førstegangstilfælde, hvis man ligger hindring i forhold til politiets arbejde.
Justitsministeriet mener at selvom man ikke direkte er en del af en demonstration der involvere grov forstyrrelse af ro og orden på offentlig sted, kan man godt straffes, fordi man er i forlængelse af demonstrationen. Justitsministeriet udtaler i deres høringsvar at lov §119 stk.3,2 pt., kan anvendes selvom den pågældende ikke er deltager i urolighederne og dermed ikke kan straffes for overtrædelse af straffelovens §119, stk. 3.
