Ernesto Miranda was arrested by Phoenix Police Officer Carroll Cooley and Detective Wilfred Young on March 13, 1963, for the kidnapping and rape of 18 year old Lois Ann Jameson. Jameson was abducted on her way home from work. She was forced into a car, driven to a secluded area where she was sexually assaulted and robbed. Her attacker then dropped her off near her home. Miranda fit the description given to police as well as owning a vehicle similar to the one described by the victim. Miranda was interrogated for two hours by the arresting officers, he gave both a verbal and then a written confession. The court upheld the conviction and ruled that his rights were not violated and that the confession was voluntary and could legally be presented to the jury. Miranda then appealed to the United Stated Supreme Court. Phoenix lawyers John Flynn and John Frank agreed to handle his appeal free of charge. The U.S. Supreme Court heard the case on Feb. 28th, March 1st and 2nd of 1966. The court returned with a ruling on June 13th, 1966. The court ruled in a 5-4 vote to overturn the conviction of Ernesto Miranda. The court held that “there can be no doubt that the Fifth Amendment privilege is available outside of criminal court proceedings and serves to protect persons in all settings in which their freedom of actions is curtailed in any significant way…” The court also ruled that “prosecution may not use statements stemming from custodial interrogations of the defendant unless it demonstrates the use of procedural safeguards effective to secure the privilege against self-incrimination” (United States Courts”,
