Additionally, the sentencing judge said that Smith’s sentence was based on his record that included seven prior felonies and three misdemeanors. The judge found Smith’s sentence to be the appropriate punishment and as a way to not only protect society but to deter others from committing the same crimes. Smith was already serving another sentence, and this case was to run concurrent. Prior to Smith’s sentencing the People v. McFarlin held that a sentencing judge could take into account an adult offender’s juvenile record but could not consider the record as evidence against the offender in any other proceeding but juvenile court. At this time McFarlin did not provide for the expunction of juvenile records. Due to lack of this provision after Smith was sentenced legislature passed subsection 18e of the Juveniles and Juvenile Division Chapter of the probate court, which stipulates that juvenile court judges may not set aside a conviction of a juvenile offense, which if committed by an adult would be considered a felony with a maximum punishment of life in prison or an adjudication for a traffic related offense involving a motor vehicle that may be a felony or misdemeanor.
