Article Rebuttal

The paper will have the contents of an article I decided to do for reasons that will be revealed in the conclusion. The topic is from the New York Daily News Gay Marriage the title is “Five arguments against gay marriage: Society must brace for corrosive change.” The author talks about many areas of concerns throughout the article. One is religious freedom “A recent Newsday editorial said opponents “will be seen by future generations in much the same light as those who opposed school desegregation. Devout Catholics, Orthodox Jews and, ironically, the 70% of African-Americans who oppose gay marriage will become the new Ku Klux Klan?” I do not agree with this, I have not seen a traditional marriage yet or and I do not believe one exist either. Families today have an enormous amount of pain involved with their marriages like seeking other sexual services for one, amongst many other violation of the marriage law and some of them are considered “unnatural”.
The second argument is the Rights of Children. In the article the author says “More children living in gay homes means more children living lives absent a relationship with at least one biological parent. This will result in some emotional pain and confusion”. A study published in Pediatrics on June 7, 2010 found that children of lesbian mothers were rated higher than children of heterosexual parents in social and academic competence and had fewer social problems. And a July 2010 study found that children of gay fathers were "as well-adjusted as those adopted by heterosexual parents.” (Pro & Con Arguments: "Should gay marriage be legal?" 2011).
Here are some facts found from the Pro & Con Arguments: “Should gay marriage be legal?” Society has seen high divorce rates increase aggressively throughout the

Rhetorical Analysis On Blame Yourself

...The first article that I began to consider was Blame the Echo Chamber on Facebook. But Blame Yourself, too by Kartik Hosanagar. Within the evidence section of this paper the author established his authority to be speaking on this paper by his reference to research studies that he participated in regarding this algorithmically personalized content. By referencing these research studies Mr. Hosanagar is attempting to appeal to his audience’s ethos by proving he is a credible source to be speaking on this topic. Once he begins discussing the topic of the paper he makes a point to distinguish the difference between how an iTunes algorithm for generating personalized content is different from what Facebook does to appeal to our political curiosity. I believe this deliberate point to distinguish the difference between these...

...rebut the student’s viewpoint. I will use Google for all of my searches, it is my preferred search engine because I feel secure in the algorithm the system uses to identify web sites, and it will aid my search for credible sources. Because I am choosing to research three different points for the response I will alter the search terms appropriately. For the information in support of the other student’s opinion I plan to use the search phrase “benefits of social media in job searches,” for the neutral, informative response I plan to use the phrase “use of social media in job searches,” and for the rebuttal response I am choosing to use the search phrase “dangers in the use of social media in job searches.” I will evaluate the validity of the information and credibility of the source through three different factors: citations used by the article, credibility of the sponsor behind the article, and if the information provided is current. The first source to discuss would be in support of social media in job searching. The source is a slideshow developed for the careers section of U.S....

Global Warming and Climate Change

...Article Rebuttal: Global Warming and Climate Change Jeffrey Rohde BCOM/275 April 1, 2012 Edward D’Avola Global Warming and Climate Change A controversial and heavily debated topic in the media today is global warming and climate change. Countless articles have been written about the impact of global warming on the climate changes. A majority of the global warming claims are based on either human factors or natural cycles. I came upon a recent article by Nina Chestney titled “Global warming close to becoming irreversible”. The article claims the global warming is a result of “the world's temperature looks set to rise by six degrees Celsius by 2100 if greenhouse gas emissions are allowed to rise uncontrollably” (Chestney, 2012). The temperature increase is the result of human activities. The purpose of this essay is to challenge the claims made by the author of the article. The rebuttal will be made by analyzing the credibility and validity of the author and their claims. The author’s credibility on the subject can be debated because of the lack of references listed. The points presented are, in a relative sense, true, but highly generalized. The author claims “the world's temperature looks set to rise by six degrees Celsius by 2100 if greenhouse gas emissions are allowed to rise uncontrollably”(Chestney, 2012). The author fails support the claim with data. The article discusses several negative impacts on the global climate: loss...

...Article Rebuttal Kenneth Sawyer BCOM/275 February 14, 2012 Heidi Roberts Article Rebuttal The laws on abortion when dealing with women where pregnancy is a result of rape or incest can be detrimental to these victims overall well being. They should be allowed to make the appropriate choice according to their circumstances. There are different factors that may contribute to the final decision of an abortion. New abortion laws have caused many concerns especially toward victims of rape and incest. It is stated that eighteen states require that doctors make sonograms available to pregnant women; and in nine other states it is required to have some form of verbal counseling or written materials. In addition, Texas laws require that a sonogram be conducted within two hours of the planned abortion, that the fetus heart beat be made audible if possible, doctors must provide a state dictated list of other options, and patient must wait twenty four hours after her first visit to obtain an abortion. (Editorial: Abortion bill is unwarranted state Intrusion on Women’s Right to Choose) (Texas Can Enforce New Abortion Law USA Today.com) In my opinion, each of these required steps can have positive outcomes on numerous abortions that take place throughout states saving many lives and preventing negative outcomes that women face after making such a decision. It is stated that the laws being passed aid...

Law and Speaking

...students’ first-year legal research and writing course or as part of a moot court competition. While appellate courts do not grant oral argument as often as they used to,2 oral advocacy remains a critical skill for law students to learn and cultivate, no matter which facet of law practice they enter upon graduation.3 Unfortunately, the prospect of learning this critical skill through an oral argument assignment can be disquieting to students. The main reason for this unease is simple: most law students have little to no oral advocacy experience. Students may, however, ease their anxiety and ultimately deliver an excellent oral argument if they fully understand the purposes of the argument and if they thoroughly prepare for the argument. This article is targeted at oral argument novices. It discusses how you, as a beginner to appellate oral argument, may effectively prepare and deliver an argument, particularly if you are Clinical Associate Professor of Law, Indiana University School of Law – Indianapolis; J.D., Summa cum laude, 1993, Valparaiso University School of Law. Three Strikes Law

...Article Rebuttal Unraveling the “Three Strikes law and making it unconstitutional is the primary focus of the Criminal Defense Clinic at Stanford Law School. Its founder Michael Romano States in his article “Striking Back: Using Death Penalty Cases to Fight Disproportionate Sentences Imposed Under California’s Three Strike Law” (2010), his clinic believes the “Three Strikes Law” is unconstitutional and unfair punishment. Our argument we will make the case stating he is using fallacies to strengthen his argument. In California there are no class systems for felonies. Whether or not the felony is violent or not violent, California imposes a harsh sentence. We will give an overview of what “The Three Strikes” law are, the “Death Penalty” and our rebuttal. California's Three Strikes Law "is a sentencing scheme that adds significant time to the prison sentences of certain repeat offenders convicted of serious or violent felonies." California Criminal Defense Lawyers,(2013). This law "three strikes law" also known as the Three Strike Law, was enacted in California in the 1990s to allow harsher punishments for those that committed felonies more than once and to provide for relief of the crimes themselves. A felony is defined "as a crime that has a greater punishment imposed by statute than that imposed on a misdemeanor" The Felony Law & Legal Definition (2013). Research Proposal

...Yvonne Prutilpac English 102-056 Charity Ginerich Research Proposal The topic that I would like to research for the final research paper is the issue of ethics in regards to registering a pet to be a service animal. I am arguing that it is morally acceptable to get your pet registered as a service animal even when there are no known disabilities of the owner. I have some experience with this topic because I have a dog that I recently got registered as a service animal. I have no disabilities but was still able to get him registered by law. This is a very easy task to do and anyone is capable to do so. There are two obvious sides to this argument. One side is that it is morally acceptable for any animal to be able to get certified as a service dog; while the other is that it is wrong and could be disrespectful to get a pet registered when there is no disability. The common ground to this issue is that an animal should be registered as a service animal as long as it is well behaved and causes no harm to people or animals around it. “The term ‘service animals’ describes animals who render assistance of some sort to people with disabilities (Malamud). What if we all have disabilities of some sort? Because I am arguing that it is morally acceptable to get a pet service trained without having a disability, I hope to get my readers to realize that this could benefit people in many ways. Many animals provide services to people every single day even when they are not registered...

Civil Litigation

...Civil Litigation Process Litigation is the process of bringing, maintaining and defending a lawsuit. This process is very difficult, time-consuming, and costly. In addition, the entire process must comply with complex rules and regulations. The pretrial litigation process is divided into a pretrial and trial process. The pretrial litigation process can also be divided into several major steps. These steps include: pleadings, discovery, dismissals and pretrial judgments, and settlement conference. The entire process begins when a party brings a dispute against another party to a court system. The party bringing the dispute or compliant is the plaintiff. The party on the receiving end of the complaint or lawsuit is referred to as the defendant. The paperwork filed with the court to initiate and respond to a lawsuit is called the pleadings. Major parts of the pleadings include the complaint, the answer, the cross-complaint, and the reply. For the plaintiff to initiate a lawsuit, a complaint must be filed with the proper court system. The complaint is a document served to the defendant to initiate the lawsuit. This document must name the parties to the lawsuit, allege the ultimate facts and law violated, and contain a “prayer for relief” for a remedy to be awarded by the court. The length of the complaint will usually depend on the complexity of the case being heard. Once the process of filing a complaint is finished the court will issue a summons, a court order...

...consuming and costly process. Alternative Dispute Resolution (ADR) is a response to the expenses of lawsuits and a popular means for resolve of cases prior to trial. ADR offers a less expensive way to resolve contract and commercial disputes while minimizing the business risks associated with traditional litigation. The litigation process is time consuming because of the different phases of the process. The first phase is the pretrial litigation process that involves pleadings, discovery, dismissals and pretrial judgments, and settlement conferences (Cheeseman, 2010). The trial phase involves jury selection, opening statements, the Plaintiff’s case, the Defendant’s case, rebuttal, closing arguments, jury instructions, jury deliberation, and entry of judgment. The appeal phase can begin once the court enters a final judgment. A trial is a more formal and a more slow process, more costly for parties involved, and judgments are enforceable by the court system. Litigation can be very time consuming and expensive for the defendant and plaintiff. Alternative Dispute Resolution (ADR) offers a less formal and intimidating environment for the parties involved, a quicker method, and less expensive resolution for the organization. ADR involves an impartial third party to facilitate negotiations and resolutions prior to litigation. ADR is a process attended or participated in for negotiating a resolution of a civil proceeding, resolving or narrowing issues in dispute through mediation, neutral...
