THE CRIMINAL ACTS IN THIS SCENARIO ARE AS FOLLOWS:
Criminal conspiracy / Conspiracy to commit a crime: is defined as an agreement between two or more people to commit a crime or to perpetrate an illegal act. Conspiracy crimes that are federal can include conspiracy to engage in criminal activity such as money laundering, conspiracy to violate federal laws, or conspiracy to manufacture drugs or weapons. http://criminal-law.freeadvice.com/criminal-law/criminal- terms. Jane committed this crime when she agreed to accept the five hundred dollars, in exchange for the key. Thinking that Jack was going to commit some sort of crime or / “steal some of her valuables”. For this reason I do think that the woman should be convicted easily of this crime. although the mitigating factor I found should help her during the sentencing phase, and my even provide an adequate defense. Identity Theft: is the crime of obtaining the personal identifying information of another person and using that information to obtain property or information to which he is not entitled, and doing so without the permission of the person whose personal identifying information is used. This is a very rapidly growing area of white collar crime, is international in scope, and is often done with sophisticated computer hacking techniques, but can also be accomplished by simply surfing trash cans. Shredders are good protection against identity theft. Penalties vary from state to state, but many identity theft offenses are felonies which carry state prison http://criminal-law.freeadvice.com/criminal-law/white_collar_crimes/identity_theft.htm
Forgery: A person commits the crime of forgery when, with the intent to defraud, s/he executes, alters or publishes a writing without the owner's knowledge or consent. A person also commits forgery if s/he fraudulently makes a writing and holds it out to be the work of another. The list of what constitutes a "writing" is long, and can include money, coins, credit cards, checks, bank drafts, stock certificates, bonds, wills and deeds. http://criminal-law.freeadvice.com/criminal-law/white_collar_crimes/forgery.htm
Jacks band of criminals who make and cash checks, and make use of other falsified documents are guilty of this even though the crime of larceny was committed when he stole the checks and credit cards, what he does with the spoils is the crime of forgery and identity theft. I don’t see any reason not to charge him with all three.

Burglary: defined as breaking and entering into the dwelling of another at nighttime with the intent to commit a felony. http://criminallaw.freeadvice.com/criminallaw/violent_crimes/burglary.htm
In this case the charge of burglary is given due to the fact that the man that jack hired to kill Jane did break into Jane’s home clearly with the intent to commit a felony. Breaking into a home with the intent to commit a felony is the definition of burglary, and for that reason I feel charging the dead man with burglary should at least help in the woman’s defense.
Larceny: is typically a nonviolent theft involving the wrongful taking and carrying away of someone else’s personal property. While the actions constituting larceny are illegal in all 50 states, the name of the specific criminal charges differs between states. Larceny is also commonly called theft I, theft II, or theft III. And can best be described as the wrongful taking, and carrying away, of the personal property of another person; without his or her consent, with the intent to steal it. http://criminal-law.freeadvice.com/criminal-law/white_collar_crimes/larceny.htm i think that a conviction if sought after for the lesser crime of larceny would be easily obtained. The nonviolent taking of personal property and the carrying away of that property clearly takes place, and a conviction would be easy to get.
Voluntary manslaughter: occurs when one person kills another after adequate provocation, that is, there has been action that was sufficient to incite an ordinary person to sudden and intense passion such that he loses self-control. Although the person may have intended to kill the victim in a voluntary manslaughter situation, it is not voluntary manslaughter if the killing was pre-meditated. http://criminal-law.freeadvice.com/criminal-law/violent_crimes/voluntary_manslaughter.htm
I mentioned the mitigating factors I felt existed in this case in the mitigating or aggravating factors section of this paper. Even though I think the woman is guilty of the crime of Voluntary manslaughter I don’t feel a conviction will be so easily obtained due to the mitigating factor mentioned in mitigating and aggravating factors section.
Attempted Murder: have the specific intent to kill that attempted murder is the failed or aborted attempt to murder another person. Just like other crimes, attempted murder consists of both an action and an intention. In attempted murder, a person must take a direct step towards the killing and must person. One of the direct steps defined by the web site criminaldefenselawyer.com is Breaking-in. For example, unlawfully sneaking into a home, property, or other place where the victim is or thought to be. http://www.criminaldefenselawyer.com/resources/criminal-defense/crime-penalties/charged-attempted-murder.htm
You cannot accidentally commit attempted murder. To be convicted of attempted murder, a prosecutor must show that the accused specifically intended to commit the crime. The prosecutor must not only show that the accused intended to kill, but that the intent was to kill the specific victim. A valid defense for the accused in this case would possibly be Renunciation or withdrawal. Some states allow for a “renunciation” defense, sometimes known as withdrawal. This defense provides that even though the accused committed at least one direct step, the accused later decided not to commit the murder. Unlike showing that the prosecution failed to adequately prove one of the elements, the accused must prove that the crime was abandoned because the defendant intentionally stopped any and all efforts to continue it or took steps to prevent the murder from occurring. http://www.criminaldefenselawyer.com/resources/criminal-defense/crime-penalties/charged-attempted-murder.htm

Mitigating or Aggravating Factors

I. You could make a case for Jane having mitigating factors due to the fact that she is “slow” and my not have fully understood the existent of her actions, or that her action were indeed wrong. II. The fact that the victim in the voluntary manslaughter case was there not to commit just any felony but murder. This could be a mitigating factor for the defendant.

Final English Paper

...This year, in my English 1302 class, I have learned writing skills that I will utilize for the rest of my college career. Communication through text is a critical skill of modern day society and should rightfully take place as required curricula. I have grown through my efforts as a writer and my increasingly practical knowledge of essay construction, source integration as well as an understanding of the importance of this course. In my post-diagnostic examination, I received 56 out of 74. This was four questions less than my pre-diagnostic examination in which I received 60 out of 74. I feel I have grown as a writer further than just correcting the last minute grammatical and spelling errors in order to complete my final drafts. Instead, I have also blossomed in the skill of communication through my writing. I have learned the required structure of an essay, and how to construct a literature review as well as a researched argument. I still require practice in some areas of grammatical structure, such as comma splicing, as this was a recurring problem and an area of weakness for me. I have learned that a properly formed essay requires an introduction, body paragraphs and a conclusion. In the introduction, the thesis should be clear and is normally located at the end of the introduction. I learned the introduction requires an exigency describing why my topic is significant. In the body paragraphs, topic sentences are crucial. They should point back to the thesis and explain...

Team Work Production Model

...Production function is extremely relevant to students at Cornell University who are often subjected to work on group projects, or study together, or collaborate in any way large or small on differing topics. For the purpose of this paper I will apply the model to a group project in another PAM class. The assignment was to write a 20-page policy paper with four other students over the course of a semester and to formulate a plan that provided solvency to the problem and utilized original research. The group immediately divided the 20-page paper in an egalitarian manner doling out 5 pages each on subtopics however each section of 5 pages was dependent on the section preceding it. The division of labor created a new budget constraint one that reduced work and increased leisure. However as all members of the group realized the same increase in leisure each member had a greater opportunity cost in doing the work early and as such was incentivized to consume more leisure. This problem compounded overtime resulting in a complete system collapse. In the end everyone was made worse off as the semester drew towards a close because in the end each individual had failed to do his or her part and the final product was a slap-dash attempt to finish the project. The final...

...Final Project: The Role and Life of a Mental Health Counselor Books, television, and movies are full of stories revealing the day-to-day realities of various professions. These stories provide a behind-the-scenes look at the often unknown stress, joy, and effort involved in being a doctor, law enforcement agent, or even a chef. What do you think the day-to-day life of a mental health counselor is like? What constitutes a typical day for a mental health counselor, or is there no such thing? For the Final Project in this course, you uncover the hidden realities of the daily life of a mental health counselor. The Final Project requires you to interview (in person) a licensed mental health counselor who works with a population in a setting that interests you. For example, if you are interested in working as an in-home counselor with children diagnosed with mood disorders, interview someone who does this work. You then apply the information from this course, as well as in an interview you conduct, to your understanding of what it means to be a mental health counselor. *Please note that it is NOT acceptable to interview a psychiatrist, psychologist, social worker, addictions specialist, school counselor, or other mental health provider for this assignment. Although the Final Project includes interview material, this is not the only component of this assignment. Please make sure to review the full project description below. The Final Project is a 7- to 10-page paper that...

Final Paper

...instructor, choose a topic for your final 7-10 page research paper that addresses a topic other than that of your Oral Presentation. While your paper may be on any topic related to course materials; it must synthesize material addressed throughout the semester. For example, if you decide to write about visual culture of hip hop, you should probably refer to Tricia Rose's arguments about "preferred transcripts" suggested by music videos and Todd Boyd's conception of "hyperreal" cinematic imagery. FINAL PAPER INSTRUCTIONS: Your paper should also incorporate research that extends beyond the boundaries of materials on our syllabus. You should also be sure to construct an argument and offer a critique of assumptions surrounding your argument. The most successful papers will allow the "messiness" of researching popular culture to foreground contradictions implicit in your arguments. For example, if you want to argue that misogyny is less of a concern in 2006 than it was in 1995 because many of the gangsta rap groups responsible for "bitch-ho" rhetoric have disbanded, you would probably want to underscore the pervasive lack of feminist female representation in any hip hop idiom in 2002. In other words, less gangsta rap has not meant more positive heterosocial conditions for the production of hip hop. This is a research paper, and it will be graded according to standards of college-level humanities writing. Your paper must be typewritten, double-spaced,...
