...WHAT IS ADMINISTRATIVE LAW? Broadly, AL might be defined as the legal control of govern’t More narrowly, AL consists of those legal principles at define the authority and structure of administrative agencies, specify the procedures agencies must follow, determine the validity of administrative decisions and define the role of reviewing courts and other organs of govern’t in relation to a.a. Each particular field of regulation has its corresponding substantive and procedural law. AL as such deals with the general principles and rules that cut across the particular substantive fields and apply t a.a. generally. These principles include 3 basic bodies of law: (1) constitutional law; (2) statutory law, including above all the APA; (3) a form of federal com mon law, embodied in judicial decisions that do not have a clear constitutional or statutory source. REGULATION Aa are engaged in regulation. Regulatory agencies develop and enforce prohibitions or obligations with which private firms and/or individuals must comply (some agencies aren’t regulatory, but benefactor: they’re engaged in disbursing govern’t benefits). PROBLEMS THOUGHT TO CALL FOR (ADMINISTRATIVE) REGULATION One can imagine a govern’t without agencies, but no govern’t can avoid “regulation”. The common law is in fact a regulatory system, although outside the definition set out above: it depends on the creation and enforcement , by law, of a set of rights, notably those creating private property and enforceable...

...public safety issue. Distracted driving is a major cause of motor vehicle accidents in both novice drivers and experienced drivers (Klauer, Guo, Simons-Morton, Ouimet, Lee & Dingus, 2013). • In North Dakota, current distracted driving law went into effect 8/2011, text messaging (only) prohibited for all drivers (HB 1195 and HB 1256) and under age 18, there is a ban of use of any electronic communication devices while driving, cellular and hands free (Hands free info, 2014). • In ND, violation of these laws are primary offenses, meaning that you can be pulled over for that offense alone. The current penalty is a fine of $100. In 2009, Rep. Lawrence Klemin, R-Bismarck, saw his legislation to ban text messaging for drivers defeated in the House on a 60-34 vote. The law would have included a fine of up to $100 fine and a 2-point license penalty for first offenders. Subsequent violations would have brought a 4-point penalty. The bill was modeled after Minnesota law, however people thought that this penalty was too harsh (Hands free info, 2014). • In Bismarck, ND during a 2 day sweep by the police department, 31 tickets were given for violation of the texting while driving law. • In the US in 2012, more than 3300 people were killed in crashes involving distracted drivers and more than 421,000 were injured due to distracted drivers. Of these distracted drivers, cell phones are often the leading distraction of identified distraction causes (Chase, 2014) • Crash risk increases...

...weathering downturns. Most of these involve taking the long view and planning accordingly. Library Journal had an article in the Aug. 15, 2008, issue headlined “Future-Proof Your Library” [http://tinyurl.com/562xsd]. The article comprised some of the big ideas in the profession — great content, but I winced at the headline. Information professionals are not “future-phobic.” The future isn’t something we need protection from — it is what we plan for. Maybe I’d prefer a title like “How to Make Your Library Future-Philic.” This article will look at how both libraries or information centers and independent info pros can weather lean times. Note that I am not looking at situations in which libraries have to close or severely cut staff; my intention is to provide some general guidelines on how to address the pressures of an economic slowdown on a library or independent info pro business. ...Brilliance Auto, China Auto manufacturing industry is not a very profitable industry, with its profit margin averaging at 4.9%; it is 9 times less profitable than the top of the list at 38.30%. Interestingly there is one company in this industry that is reaching 58.81% net profit margin: Brilliance Auto, China. (Exhibit 1) (Exhibit 2) Auto manufacturing industry has a high entry barrier. The capital requirement is huge for setting up plants, R&D and marketing. Although economies of scale do exist, it is very hard to achieve because it requires more capital compares to other manufacturing industries due to the size and price of the machinery. Government restrictions about environmental are also strict. The power of suppliers is relatively high: the suppliers industry is highly concentrated, there are very limited amount of companies that can produce the steel, aluminum required for car chassis, rubbers for tires etc. The power of buyers is medium, although they face a high switching cost, the fact that car models and features are so similar make customers tend to be very price sensitive within a same class of vehicles. Motorcycles, public transportations, etc. are substitutes for cars. Many people that living in big cities tend to choose motorcycles or subway to avoid traffic jam. The rivalry is high in this industry, as cars are divided into different classes, and all major manufacturers provide most of these classes with not too differentiated features. I think the reason...
