1. Pat and Chris Goodson have lost their son John Goodson due to a train to car accident on May 10th, 2006. I am going to testify against the General Palmer Railroad Company showing that there was not enough of an effort done by the train conductor, Lee Thompson, to warn John that he was approaching the intersection. The accident that occurred on the Ralston Road railroad tracks could have been prevented if more precautions were taken in order to prevent such an accident from happening.
2. I want to know if there was anything else that could have been done to prevent this accident from ever occurring. Was the train horn and light clean enough for the standard to not have an obstruction to noise and sight? Were the proper procedures followed by the train conductor when he had approached the ¼ mile mark? Was the train clearly visible from the point of view or was the view obstructed due to dust, plants, weeds, etc.?
3. What I do know from the information I was given, is that John’s truck was ahead of the train, because the conductor saw the truck before John saw the train. I know based on the information given by Lee…show more content… I assume that Lee was acting out of negligence as well as General Palmer by not making enough of an effort to make the 8.6 crossing safer. Lee should have followed his role as the train conductor by blowing the whistle at the ¼ miles mark like he should’ve and followed through with the proper whistle blowing method. I don’t believe that the area where the tracks are located are cleared away far enough from the tracks to make sure that the train is clearly visible. There is also a very tight bend that is right before the tracks, not very much of a straightaway. What needs to be done is the cutting down of the trees to clear out the area to see the train easier, as well as an expansion of the road to make sure that the road is straight where the street hits the tracks, and there needs to be gates installed to add extra protection to the
