Nadzriah Ahmad 1.0 INTRODUCTION Malaysia acceded to the Convention on the Rights of the Child (hereinafter referred to as the CRC) on the 17th February 1995 in order to uphold the legal rights of the children in Malaysia.[1] Subsequently, upon ratification, Malaysia is under an obligation to implement the provisions in the CRC in order to protect the legal rights of the children (Committee on the CRC, General Comment 10, 2007). [2] In particular, with regards to the children in conflict with the law, CRC obliges State Parties to undertake in giving protection to children in conflict with the law at every stage of the juvenile justice system, in line with the requirements of Articles 37 and 40 of the CRC in order to uphold the principle of the best interest of the child (Committee on the CRC, General Comment 10, 2007).
