...26, 2001, was the Project Data Controller of its Content Build Up (CBU) Department. The CBU Department of respondent collates and cleanses all the paper data gathered from the LGU-client which are then encoded and fed into the designed operating system. As the most senior member of the department, Anabel was its officer-in-charge. From 2002 to 2003, she administered the CBU functions of respondent's projects in Imus, Cavite and Mabini, Batangas.[1] Petitioner Renato Consolacion (Consolacion), a supervising data controller in respondent's Imus project, directly reported to Anabel.[2] By letter of March 20, 2003, the municipal assessor of Mabini, Batangas informed the manager of respondent that its real property tax administration database was not "100% complete," contrary to the report of respondent's supervising data controller Evangeline Repiano (Evangeline).[3] Melvin Tandoc (Tandoc), respondent's Technology Manager, thus sent Anabel a memorandum of March 27, 2003 reading: This is the first written complaint of such nature that we have received from our client. However, other complaints of the same nature have been conveyed to our TTS and/or Marketing Departments orally by Nasugbu, Batangas; Mariveles, Bataan; and Lucena City personnel. After several months of working in Imus, Cavite, [a] confidential assistant informed me that the assigned SDC, Renato Consolacion, allegedly gave specific oral instructions to some of our Data Controllers and subsequently...

...founding, the website Amazon.com has attracted criticism and controversy from multiple sources, where the ethics of certain business practices and policies have been drawn into question. Amazon has faced numerous allegations of anti-competitive or monopolistic behavior, both in and out of court. This includes documented instances of price differentiation, enforcement of controversial patents against competitors, attempts to prevent discounted direct selling by publishers, and a declared intention to cease working with third-party print on demand services in favour of its own. Questions have been raised concerning the company's legal compliance. In 2002, Amazon faced a challenge to the legitimacy of their Canadian operations, although that case was subsequently dropped. A 2009 ruling in Japan found that the company, which had tried to avoid paying corporate tax in the country, was in fact liable to pay. Controversy over taxation has arisen on multiple occasions: It was reported in 2012 that Amazon is under investigation in the UK, while in the US the company has attracted criticism for only collecting sales tax from customers in five states. Compounding these problems, there have been reports of poor treatment of workers, with allegations of summary dismissals for health problems and anti-unionization tactics including mass layoffs. Some controversies have centered around content. The bookstore has carried titles such as The Pedophile's Guide to Love and Pleasure and cock-fighting...

...The Confessions of Online Shopaholics Introduction We all know that we are in the midst of a social, business, and cultural revolution. Our generation today is often termed as “technology savvy”, especially now that the internet has new revolutionary trends. Nowadays, businesses are not just using databases but also the internet. Since 1995, electronic commerce (e-commerce) has grown in the United States from a standing start to $310 billion retail, travel, and media business and a 3.3 trillion worth total of business-to-business databases, bringing about enormous changes in business firms, markets and consumer behavior quickly. Economies and business firms around the globe got affected rapidly. Today, e-commerce has become the platform for new, unique services and capabilities that are not found in the physical world. In 2011, e-commerce is entering a new period of explosive entrepreneurial activity focusing on social networks, and the mobile digital platform created by smartphones and netbooks (Laudon, 2012). As stated by Rayport (2002), “We are in a revolution that is enabled and accelerated by technological change and at the center of this change is the internet, and, more specifically, economies” (p 2). Whenever we read the morning papers, we observe interesting stories on companies helping the growth of the internet and so the day goes-with constant stimuli related to the internet, e-commerce and the new economy- as we work, shop, dine, or drive through our...

...Article 39.3 of the TRIPS Agreement: Its Genesis and the Present Context Biswajit Dhar 1. The Problem In the long series of disputes that the implementation of the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) in developing countries has seen, the controversy around protecting test data as provided for under Article 39.3 has few parallels in terms of enduring impact that it could have. This Article provides that “Members, when requiring, as a condition of approving the marketing of pharmaceutical or of agricultural chemical products which utilize new chemical entities, the submission of undisclosed test or other data, the origination of which involves a considerable effort, shall protect such data against unfair commercial use. In addition, Members shall protect such data against disclosure, except where necessary to protect the public, or unless steps are taken to ensure that the data are protected against unfair commercial use.” While Article 39.3 is clearly intended to ensure that “undisclosed test data” was not misappropriated, the pharmaceutical industry associations in the United States and the European Union, representing the larger companies, have argued that Article 39.3 should be interpreted in a manner that provides statutory protection spanning a period of time to data submitted for obtaining marketing approval, among others. In a submission made in 1999, the Pharmaceutical Research and Manufacturers of America (PhRMA) had argued...

...here)—but also big headaches A special report on managing information Feb 25th 2010 WHEN the Sloan Digital Sky Survey started work in 2000, its telescope in New Mexico collected more data in its first few weeks than had been amassed in the entire history of astronomy. Now, a decade later, its archive contains a whopping 140 terabytes of information. A successor, the Large Synoptic Survey Telescope, due to come on stream in Chile in 2016, will acquire that quantity of data every five days. Such astronomical amounts of information can be found closer to Earth too. Wal-Mart, a retail giant, handles more than 1m customer transactions every hour, feeding databases estimated at more than 2.5 petabytes—the equivalent of 167 times the books in America’s Library of Congress. Facebook, a social-networking website, is home to 40 billion photos. And decoding the human genome involves analysing 3 billion base pairs—which took ten years the first time it was done, in 2003, but can now be achieved in one week. All these examples tell the same story: that the world contains an unimaginably vast amount of digital information which is getting ever vaster ever more rapidly. This makes it possible to do many things that previously could not be done: spot business trends, prevent diseases, combat crime and so on. Managed well, the data can be used to unlock new sources of economic value, provide fresh insights into science and hold governments to account. In this special report ▪...
