In 1787 from May to September many representatives from each state came to Philadelphia to address the problems of the weak central government that existed under the Articles of Confederation. Under the new federal system three branches were made, the executive branch, the legislative branch, and the judicial branch. After the necessary number of state ratifications, the Constitution came into effect in 1789 and has served as the basis of the United States Government ever since.

He was present for the duration and signed the Constitution. was a moderate nationalist, and attended all the sessions playing an influential role for each. One of his most is remembering roles is as the Chairman of the Committee of the Whole. In addition, he sat on the Committee of Detail. Representing the interests in Massachusetts, he pushed for a central government strong enough to protect interstate commerce, promote international trade, and regulate the use of paper money. He favored long presidential and senatorial terms, and he also wanted to give Congress broad powers. However, he urged the appointment of federal judges by the executive. Finally, he wanted a consolidation of military authority through control of the militia by the central government. One of his fellow attendees William Pierce stated that "Mr. Gorham is … high in reputation, and much in the esteem of his countrymen, he is eloquent and easy in public debate, but has nothing fashionable or eloquent in his style." In conclusion, as a delegate to the Massachusetts ratifying convention, he stood behind the Constitution and defended it
