The appellant appealed. * The High Court allowed the appeal as the EQA expressly applies to the whole of Malaysia by virtue of Section 1 (1) EQA. * The case of Kajing Tubek is specifically applicable in cases of the construction of dams in the state of Sarawak.

* Pendakwa Raya v NCK Aluminium Extrusion Sdn Bhd * The respondent had been convicted under Section 25(1) of the EQA * The respondent submitted that it was a first offence and that the level of harmful material found was minimum. * Furthermore, the respondent stated that appropriate action had been taken to remedy the situation. * The trial judge then imposed a fine of five thousand ringgit and observed that the respondent had made an effort to abide the law. * The appellant filed an appeal and state that the trial judge failed to take into account the effect of the offence on the environment. * The High Court held that the respondent’s attitude of ignoring Sec 25(1) until enforcement upon them were taken, did not support the trial judge opinion that the respondent had overcame their problem by taking appropriate action. * The High Court allowed the appeal, set aside the sentence and substitute it with a heavier sentence.

The main character, the Grinch, is of the lower economic class and resists bourgeoisie. He does not celebrate Christmas, and purely hates the positive spirit that comes with it. The Grinch thought to himself that he will stop Christmas from coming if he steals all the items that were bought in preparation for Christmas. The poem is directed towards an audience of young children whose families celebrate Christmas. If a child whose family did not celebrate Christmas due to religion or finances, the child would not understand the poem and the feeling the author is trying to convey. The title of the poem also twiddles the idea of materialism because the Grinch who stole Christmas actually didn’t steal Christmas; he stole all the presents and food that was meant for Christmas day.
