...Case Study Analysis Property Issues Learning Team A Law/531 8/25/2014 Craige Harrison IRAC Issue: The issue brought before the Texas Court of Appeals is that the Tarhan’s bought property form the Mettlen’s and the Mettlens claimed that they retained the mineral intrests in the property. The Trahans believe that the interests were, or should have been, part of the transaction. The Trahans filed lawsuit in December of 2010 for the mineral intests more than 4 years later. The Mettlens filed a motion for summary judgment claiming that the lawsuit was time-barred by the applicable four year statute of limitation. The court found that the satute of limitations barred the Trahans lawsuit and judgment to the Mettlens. So the question is: is the four year limitation period applicable to the Trahans cause of action was tolled or otherwise rendered inapplicable by the facts and circumstances of the case and for how long. Rule: Discovery Rule for Fraudulent Concealment Analysis: The contract states that just after the description of the property the mineral, oil and gas and liquid that may be produced are products of the grantors. That there was no evidence of the Merrlens attempting to hinder the Trahans from reading the deed or that they attempted to hinder the Trahans Conclusion: It was found that the warranty deed conveying title to the Trahans contains a clear and unambiguous reservation of mineral rights. The discovery rule for fraudulent concealment tolls the running...

Assumptions and Missing Information 3. Problem Definition 4. Development of Alternatives 5. Evaluation of Alternatives and Recommendation to Management 6. Appendix – Used for exhibits such as pro-forma income statements and other detailed analyses. The Case Analysis Framework The case analysis framework presented here is a synthesis of the frameworks used by your professor and other marketing professors who use case analysis in their courses. It will provide a solid structure to organize the diverse information presented in a case. As you work your way through this framework, or a similar approach to case analysis, we offer the following hints to increase your probability of success: 1. No one can analyze a case after reading it only one time, or even worse, doing the analysis during the first reading of the case. You should read through the case once just to get an understanding of the nature of the case. During the second reading, you can begin to structure and classify the issues as they appear. A truly comprehensive case analysis will probably require at least three readings. 2. Don’t get trapped into thinking the “answer” to the case is hidden somewhere in the case text. There is never a single answer to a case just as there is never a single marketing strategy that is...

...August 2013 Case Examination General Comments on Performance Cape Lane Port Authority (CLPA) Case Background and Required Element The August 2013 Case Examination focuses on a Canadian Crown Corporation, Cape Lane Port Authority (CLPA), charged with operating the industrial and commercial port at Cape Lane, British Columbia (BC). In May 2013, senior management met with the Board of Directors at a planning retreat to address declining sales and profit. Management assured the federal government that actions would be taken to avoid a loss for the 2014 fiscal year, and set a 5% net profit margin target to be met, within three years, as a corporate goal. This target was approved by both the Board members and the federal ministers, to whom they report. The following alternatives were identified for consideration: 1. Invest in renovations in order to proceed with the Bitumen Shipping Project. 2. Divest the Cruise Ship Terminal. 3. Operate a Passenger Ferry. Additionally, the following minor alternatives were identified: 1. Allow a local entrepreneur to build a reception centre in the cruise ship terminal and pay a royalty of 8% of revenue to CLPA. 2. Build a fitness facility in order to reduce sick time. As Kyle Wast, CMA, prepare a report for CLPA’s executive team advising them on the opportunities discussed and addressing any other organizational issues and concerns requiring their attention. Include details of your analysis, support for your recommendations, an action plan to...

Scrutinize them thoroughly. Some exhibits, such as financial statements or organization charts, may appear fairly standard. Still look for anything odd or unusual about them. Other exhibits are unique to the case and provide a summary or illustration of key data. Make sure that you understand the purpose of each exhibit. Part 2: Analyze the Case A generic approach to case analysis includes the following steps: A) define the issue; B) analyze the case data with focus on causes and effects as well as constraints and opportunities; C) generate alternatives; D) select decision criteria; E) assess alternatives; F) select the preferred alternative; and G) develop an action and implementation plan. Note that some parts of this model will not apply to every case and some aspects will receive more emphasis than others at different times during the course. Specific analytical approaches, techniques and tools may be applied depending on the course, type of case and your instructor's particular requirements. It may be appropriate to re-visit regularly any particular analytical model, framework or concept suggested by your instructor or outlined in the course syllabus. Individual Preparation 41 Step A. ...A Guide to Case Analysis Hult International Business School Professor Jim Prost San Francisco Campus The purpose of this guide is to help you maximize your learning when using case studies. It outlines some key issues that will help you learn from the case analysis method. In most graduate courses, students use cases from actual companies to practice strategic analysis and to gain some experience in the task of creating and implementing strategy. A case describes, in a factual manner, the events and organizational circumstances surrounding a particular managerial problem. It’s as if the reader is inside the organization (at the time the case was written) and has most, if not all, relevant information, facts, and circumstances. The student’s role in case analysis is to diagnose and evaluate the situation described in the case. You then develop recommendations, supporting arguments, and the appropriate action steps that should be taken to rectify the problem presented in the case. After reading this guide, you will be able to: * Understand what a case study is * Appreciate the benefits of using case studies in the learning of strategic management and how their use can help develop your managerial skills * Use the key steps in analyzing case studies * Apply theoretical concepts and frameworks to the case material The case approach to strategic analysis is an exercise in “learning by doing.” Because cases provide you with detailed information about...

...Guide to Case Analysis A case presents a situation involving a managerial problem or issue that requires a decision. Typically, cases describe a variety of conditions and circumstances facing an organization at a particular time. This description often includes information regarding the organization's goals and objectives, its financial condition, the attitudes and beliefs of managers and employees, market conditions, competitors' activities, and various environmental forces that may affect the organization's present or proposed marketing strategy. Your responsibility is to carefully sift through the information provided in order to identify the opportunity, problem, or decision facing the organization; to carefully identify and evaluate alternative courses of action; and to propose a solution or decision based on your analysis. This guide provides an overview of the case method. It begins with a discussion of the role that cases play in the teaching/learning process. This is followed by a series of guidelines for case analysis. After carefully reading this material, you should be prepared to tackle your first case analysis. Even if you have had previous experience with cases, this guide will provide a useful review. Why Cases? • The case method differs substantially from other teaching/learning approaches such as lectures and discussion. Lecture- and discussion-oriented classes provide students with information about concepts, practices, and theories. In contrast...

...CASE ANALYSIS METHODOLOGY 1 The Process Overview of the Process The best way to deal with cases is to read through the case material (or the relevant documentation that has been collected) several times, doing slightly different tasks on each additional pass. In the first reading go through the information quickly and keep an open mind. Avoid locking in on any particular facts until you really have the outline of the case data in your mind. During your second reading start underlining and making notations on the various parts of the case. Do not try to fill in a framework just yet. The third step is to isolate key variables and make a few numerical calculations. Once you have done this, take a few minutes to sit back and think. Then fit the analysis together using the framework provided below. Now you will have an organized and thoughtful approach to the marketing problem. After you have mastered the facts and other information, isolate the major problem to be solved. Identify the key problems faced by the manager in a strategic sense. Do not forget the context of the organization and its situation. The problem must be solved within this context. Proceed with the analysis of the major points or areas. For the purpose of this course, the analysis is the most important part of the report. At this time in your career and in this course, the reasoning behind how you arrived at the recommended course of action carries more weight than the actual decision. The analysis consists, at...

HOW TO PREPARE A CASE STUDY There is no single right way to prepare a case study, but this note may help you develop your own methods for preparation that will be effective in understanding the issues presented in the case and preparing for class discussion of those issues. In general, I have found the following approach helpful in analyzing a case study for class discussion. 1. Read the case as quickly as you can as if it were a story. Ask yourself, "What is this case generally about and what types of issues are being discussed?" Examine the introductory and concluding sections especially for hints regarding the key issues addressed in the case. 2. Review the case again, looking carefully for key facts and underlining key information as you go. Ask yourself, "What are the basic problems this manager or company needs to resolve?" and "What data do we have available to analyze the issues raised in the case?" Try to put yourself in the position of the manager and develop a sense of involvement in his or her position. Do not use lack of information...
