John Shepherd was an employee of AutoZone and his Doctor stated he should not mop the floors due an injury. With Dr. Katchen’s documentation and along with Mr. Shepherd’s request not to mop the floors AutoZone still made him mop daily. When Mr. Shepherd performed the duties it caused him more pain than he had before. The legal issue here is that Auto Zone did not comply with Dr. Katchen’s recommendation and this is against the Americans with Disability Act. They did not comply with the Doctor and did not hear Mr. Shepherds requests regarding mopping and his pain increased. The court decided that Mr. Shepherd was in the right and AutoZone broke the Americans with Disability Act in more than one way. He was awarded punitive damages, compensatory damages, and back pay.…show more content… The court awarded Mr. Shepherd compensatory damages because AutoZone made him mop against Doctors orders resulting in severe pain. The pain was so intense his wife had to help him take a shower and dress him. She did not have to do this for him before AutoZone made him mop. Additionally, AutoZone did not have their ADA policy in their employee manual for employees to read and research if the employees had questions or concerns. A policy statement would not have been a fix for this situation either. AutoZone failed in several areas and not putting all their procedures for this situation in the manual was one of them. Basically, Mr.Shepherd’s request for accommodations was left unresolved due to the failure of AutoZone’s establishment procedures and
