...To: Bob Belmont From: Jim Shorts Date: September 12, 2013 Subject: Memphis Reality Audit Engagement Mr. Belmont, Memphis Reality needs an audit for a large amount of financing in some of their estate investments. Justin Case, the owner of Memphis Reality and also a local nonprofit organization, told me that the company has never been audited. The firm is quite successful and has a solid reputation in the community. However, after closer examination of Justin Case’s history, I have my doubts. I contacted Case’s tax accountant, Jo King, to verify his previous financial history. Mr. King mentioned that Case was questioned by the IRS about a substantial capital loss 10 years ago. The loss came from a sale of a tract of land to a trust. Case allegedly lost all documentation and had no way of finding out the principals of the trust. Further investigation revealed that the land was recorded in the name of Case’s daughter, and that Case himself was listed as a trustee. The IRS rejected the loss and Case was assessed a civil fraud penalty. This illegal activity seems to reflect nothing of Case’s behavior now. As I mentioned before, internet searches of Case, Case’s banker and attorney, and the Dun & Bradstreet report speak very highly of him. Being on the board of directors for Case’s nonprofit organization, I have taken a considerable liking to this investigation. Nevertheless, we must uphold our professional skepticism. Why has Memphis Reality never been audited? Why should T&A...

...world. Individuals can make ethical decision only if they understand the potential effects of their decision. Ethical decision making is an intricate process where individuals must consider impact of decisions or actions resulting from the decisions made on individuals or institution. The basis of ethical decision-making encompasses balance and choice (Levin & Mather, 2012). Law is one of the professions that demands practitioners to make ethical decisions to avoid messing up their clients and third parties. They are required to employ American Bar Association (ABA) Model Rules of Profession Conduct throughout their professional undertakings. In the paradigm case, Justin King is involved in an accident and this has resulted to lawsuit. The circumstances surrounding the incident call for due diligence from both defendant (Justin) and his legal team. As such, there are various issues affecting this situation. The first issue is whether the ethical duty of confidentiality applies to Justin’s situation. Various laws and regulations govern a lawyer’s conduct. As indicated earlier, ABA Model of Rules of Professional Conduct is a set of principles that governs the conduct of lawyers in their endeavors. To narrow it down, rule 1.6(a) of the ABA Model Rules of Professional Responsibility states, “A lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent, the disclosure is impliedly authorized in order to carry out the...

...Barbara Perez Unit 4 Assignment: Research Affirmative Defenses PA110 Civil Litigation July 27, 2014 Professor: Julie Dennis There are quite a few defenses that could be used when reviewing the Justin King case, however, I believe the most obvious would be assumption of risk. The defendant can claim that if the Mr. King would have worn a helmet it would have caused him fewer injuries to his head. Although wearing a helmet is not required in the state of Illinois, Mr. King chose to assume the risk of the outcome. The helmet may have provided more protection against the accident. I was able to research some cases on Westlaw where assumption of risk was used as a defense and I came across McKinley v. Casson. In this particular case, a motorcyclist brought personal injury action against the driver for damages that he had sustained when his motorbike rear-ended the driver's vehicle. “The Superior Court, New Castle County, 2012 WL 1408498, after denying driver summary judgment, entered judgment on a jury verdict in favor of driver. Both parties appealed” (McKinley v. Casson, 2013). The Supreme Court held that the evidence regarding motorcyclist's failure to wear a helmet was unallowable in personal injury action against the driver; because motorcyclist was under no obligation to wear a helmet; his failure to wear one wasn’t applicable as a matter of comparative negligence. Jury Instruction on Assumption of the Risk: “In light of our holding that no evidence should have been...

...The ancient accounts written portraying Alexander of Macedon during his lifetime and after his death have been subsequently lost, except for fragments from various writers. The original account of Alexander’s expeditions into Asia was written by Callisthenes, who accompanied Alexander on his journeys. Callisthenes was a nephew of Aristotle who travelled with the King as his official historian. He began as a trusted colleague but Alexander eventually had him executed because it was rumoured that he was committing an act of treason against him. It is possible that during this time, there was an anti-Macedonian bias formed in the works of many notable writers. Historians must also be aware of what is known as the “Alexander romance”, this is...

...There are many traditions proving the existence of Zoroastrianism during Arsacids era that we go on to explain: Isidorus of Charax, the Greek writer of the first century A.D., says: “Arsaces, the first Parthian Emperor, declared his monarchy in Asaak and protected an eternal fire there”. Fire means a sign of Zoroastrianism in the land of Arsacids (D'jakonov 1965, 129); and as well as other narrations from the third book of Dēnkard , the first Avestā was written in two versions when DariusIII was king; although Alexander destroyed this Avestā,Vologases I ordered to gather and edit it again (Maškūr 1990/91, 325). Marriage of Phraates with his mother, Musa, was another sign proving existence of Zoroastrianism in the Arsacid time, obviously...

...60 years are McDonald’s and Burger King. McDonald’s was founded in San Bernardino, California by Dick and Mac McDonald and was then reestablished by Ray Kroc in 1955(Nation’s Restaurant News, 2005, p. 2). Burger King was founded in Miami, Florida by James W. McLamore and Dave Edgerton in 1954(Carlino, 1996, para. 2). Both restaurants both sell a lot of the same things to include burgers, fries and shakes, but culturally they are different. McDonald’s mass marketing strategies have turned on family values, cleanliness, friendly service and, more recently health (B&T Magazine, 2012, p. 4). McDonald's vision statement is Quality, Service, Convenience, and Value. These are Ray Kroc’s “Guided Values” and are in embodied in the business ethics of each store (Salva-Ramirez, Winter 95/96, para. 4). The most culturally relevant icon McDonald’s has is its fun-loving clown, Ronald McDonald. He first appeared on television in 1963 and walked in the Macy’s Parade in 1963. Ronald is seen as a good role model for children because constantly smiling and promotes an active lifestyle. Burger King takes a different direction with its marketing promoting the taste of its products. James W. McLamore believed in that” if you served great tasting food, they will come” (Carlino, 1996, para. 8). For those reasons, the company has never shied away from sticking with flame broiled burgers and the slogans like “Taste the King” and “Have it your way”. “Taste the King” is committed to the idea of having...

...D1: Evaluate the influence different stakeholders exert in one organisation Stakeholders are groups or individuals that are affected by the operations of a business and have an interest in the objectives of the business. Every stakeholder holds a different opinion and therefore tries to influence the business in the most beneficial way to themselves and their aims; however stakeholder conflict may arise when the aims and objectives of some stakeholder groups compromise the aims and objectives of other stakeholders groups. Employees: Employees are a primary stakeholder within Sainsbury’s whose financial situation is correlated directly with the performance of a business. Employee’s interests must be adhered to as best possible as they can influence Sainsbury’s in three main ways. They can influence staff turnover, (how long employees tend to stay) if they are unsatisfied or feel they are insecure employees may opt to work for a rival competitor such as Tesco if they feel they will have better pay or job security. Employees must possess the correct skills Employees can also influence Sainsbury’s through industrial action, where they may strike in a protest; if the employees aren’t present on a day-to-day basis this may have a devastating effect on sales that day which can be detrimental for the future. Employees have a large influence over service quality; service quality is a comparison of expectations with performance. A business such as Sainsbury’s with high service quality...

...Professor David Mook September 15, 2014 Is Law Enforcement Racist? Racism, stereotypes, racial profiling, discrimination, no matter what you call it it’s all the same thing, and it has been around for years. Lately racial discrimination has been greatly decreased, yet not completely eradicated. One would think that the last place there wouldn’t be a single shred of any discrimination in law enforcement, however, there is and the fact that there is racial discrimination makes for some very controversial cases; such as the case of the shooting of Michael Brown, the brutal beating of Rodney King, and the wrongful beating of Abner Louima. All of these incidents happened because of an unfair percentage that police are to show more brutality to a minority group than to whites and there are plenty of facts that support this such as the amount of white officers over colored ones, and the biases and stereotypes that are to blame for “racism” in law enforcement. The case of Michael Brown in Fergusson, Missouri a predominantly black society, with a predominantly white police force, there are multiple stories that both tell stories of what people saw. One account states that the teenager Michael Brown had his hands in the air and was surrendering whilst unarmed; the officer opened fire and killed him. However, what the authorities say is the exact opposite in which Michael Brown actually attempted to attack the officer in his car and tried to take the gun. "Get the f*** on the sidewalk...
