The police followed the suspect into an apartment complex and lost contact with him. As the police entered the complex, they detected the odor of marijuana coming from an apartment and mistakenly believed that suspect entered the apartment. After the police knocked on the door and announced their presence, they heard noises coming from inside their apartment to which they believed to be the suspect destroying evidence. The destruction of evidence is an exigent circumstance that justifies a warrantless entry. The officers announced their intentions prior to entering the apartment and discovering King with others smoking marijuana. The suspect that they were pursuing was not inside the apartment. Second defendant was charged with drug- and weapon-related crimes, and the United States District Court for the District of Massachusetts, Stearns, J., 612 F.Supp.2d 104,[->1] denied his motion to suppress evidence found during warrantless search of data stored on his cell phone, and defendant appealed. We argue that couples can use internet communications not only to marry when separated by great distance but also to choose which state’s laws will authorize their marriage. In particular, same sex couples could marry under the laws of a state that permit such unions, regardless of where they exchange vows. States inadvertently have created geographic monopolies, requiring each marriage receiving the benefits of their licensing laws to be performed within their borders. This Article’s model builds upon established precedents, such as proxy marriage and choice of law for multijurisdictional and internet contracts. Using the power of internet communications, our proposal allows states to compete over marriage’s procedures and substance.
