...Certainty in the law is a concept for which the Administration of Justice strives. Judicial precedent promotes certainty in case law while Statutory Interpretation promotes certainty in legislation. Discuss these statements with reference to the principles and rules of Judicial Precedent and Statutory Interpretation. Illustrate your answer by reference to cases. Individuals have different perceptions, and businesses operate in a market-based system, where production is fuelled by profit maximization. Conflict will inevitably arise. Law helps societies maintain social order, which enables individuals to interact, and provides a framework within which businesses operate (Kelly, Holmes and Hayward). The law impacts different aspects of our lives. There are rules to govern property, health, and a range of human activities. Vernon Rich describes laws as “written expressions of the enactment or decree of legitimate governmental authority, which formally define standards of behaviour and provide for punishment by the government for those who disobey” (63). Since the consequences of disobeying laws can be severe, judges and legislators strive for certainty in case law and legislation, to ensure the most just ruling. Although critics argue that judicial precedent and statutory interpretation have limitations, they undoubtedly promote certainty in case law and legislation. Case law, or common law, is law enacted by judges based on decisions made in the cases they...

...1. Introduction Brands are more than just names and symbols. Brand represents consumers’ perceptions and feelings about a product and its performance-everything that the product or service means to consumers. The real value of a strong brand is its power to capture consumer preference and loyalty. In a cluttered, competitive market place, the brand elements that make up the brand will have to do more and more of the selling job. In a time- compressed marketing world the fact that brand name can be noticed and its meaning registered or activated in memory within just a few seconds is a tremendous asset and provide a firm with a strong competitive advantage. Mutual Trust Bank Ltd. is the leading multinational bank in this country. To maintain its leading position in the Bangladesh, Mutual Trust Bank Ltd. is always keen to develop long-term beneficial relationship with trustworthy clients. The ability of Mutual Trust Bank Ltd. to establish itself as a successful bank and the creation of a strong brand image is because of the high quality service it provides to its customers. ‘Brand is the "name, term, design, symbol, or any other feature that identifies one seller's product distinct from those of other sellers" A modern example of a brand is Coca Cola which belongs to the Coca-Cola Company’. ‘Brand image is the current view of the customers about a brand. It can be defined as a unique bundle of associations within the minds of target customers. It signifies what the brand presently...

...Law and its application for settlement of disputes (highlights on ADR) Lecture |Largely ADR | |Two categories | Informal & indigenous mode of ADR formal or court-annexed ADR (As old as the society itself) (Since the decades of 17th in USA) USA-since 1970s, public talk- against civil justice system because of excessive delay, expense, inflexibility and technicality In a speech in 1976, Warren Burger (CJ) of USA discussed with the problem of delay, high costs unnecessarily expenses and diminish the velue of the judgment. CJ made several suggestions –reform, including giving a greater role to ADR. He urged for “divert litigation to other channels”, particularly the channel of Arbitration. ‘Multi-door Courthouse’ Burger Harvard (law professor) Frank E.A Sander proposed that court be transformed into “dispute resolution centers”, in which ‘the grievance would first be channeled through a screening clerk who would then direct him to the process most appropriate to his types of cases. The ‘dispute resolution centers’ would have a separate room for screening, mediation, arbitration, fact finding, malpractice, a civil court and an ombudsman. ADR history in Bangladesh (To be traced two different view points) 1. History of informal (shalish) and quasi-formal (village court) ADR: Informal ADR is as old as the society itself. Shalish is a non-state justice system and a reformed version of shalish is being...

...Introduction: Foreign Aid any capital inflow or other assistance given to a country which would not generally have been provided by natural market forces. In Bangladesh, foreign aid serves to bridge the gap between savings and investments and make up the deficits in the balance of payments. Foreign aid is a major means of financing the country's economic development. Economic literature generally classifies foreign aid into four main types. First, the long-term loans are usually repayable by the recipient country in foreign currency over ten or twenty years. Secondly, the soft loans repayable in local currency or in foreign currency but over a much longer period and with very low interest rates. The softest are the straight grants often given to the less developed countries. Sale of surplus products to a country in return for payment in the country's local currency is the third type and finally, the technical assistance given to the developing countries comprises the fourth type of foreign aid. Foreign aid is more like an investment in a risky market situation. The relative weighting of advantages and disadvantages depends on the planning behind the foreign aid and how well-orchestrated it is. Economic advantages: stimulated economic development in the receiver's country (better infrastructure, more education etc.) leads to economic growth. It can also create jobs as increased investment leads to more employment; this means less needs to be spent on unemployment benefits...
