Consumer Behavior Paper Marketing is all about consumer behavior; how to evaluate it, how to measure it, how to identify it, how to forecast it, how to influence it, and finally how to analyze it. Marketing’s purpose is to provide products and services that consumers want at a profitable price. According to Hawkins, Mothersbaugh, and Best (2007), the definition of consumer behavior is, “Consumer behavior is the study of individuals, groups, or organizations and the processes they use to select, secure, use, and dispose of products, services, experiences, or ideas to satisfy needs and the impacts that these processes have on the consumer and society” (p. 6). Who controls the market, the consumer or the organizations that supply the products and services? In most situations, the market is controlled by the consumer. The consumer in a free market system is the person who purchases the products and services available in the market place. If the consumers do not want a particular product or service, then the market place will stop supplying it. A classic example of this relationship between consumer behavior and the market place is the on-going saga of the Chevrolet Volt. The Volt is the General Motors (GM) product touted to be the car of the future. It is marketed by GM as an “Extended range electric vehicle”. Calling it an electric vehicle almost borders on being a ruse. The implication is if you drive a volt, you are reducing the amount of pollution you are generating from the use of fossil fuels as well as helping to significantly reduce our consumption of foreign oil. In reality, the Volt is still a hybrid car requiring an internal combustion, fossil fuel burning engine for the vast majority of its’ power. Its’ electric range is only 25-50 miles before

...to the food industry. It will also highlight Kudler Fine Foods and show different strategies to assist in avoiding legal issues with product liability. Finally, the paper will highlight database tools researched specifically to help avoid product liability legal issues. The food industry is highly competitive and the high regulations could cause severe profit margin decreased in companies who do not legally represent themselves appropriately. Claims against companies in the food industry There are several areas where companies need to watch out for. The world is changing into this environmental friendly monster, which is outstanding, and it is affecting the food industry in the claims companies have to deal with. State consumer protection acts are other avenues where lawsuits can develop. “Food and beverage companies often face litigation in more than one jurisdiction, with more than one plaintiff, represented by separate sets of plaintiffs’ counsel” (http://www.sidley.com/productsliabilitylitigationfoodindustry/). In some cases, settling these lawsuits out of court is the best approach because of the negative publicity it could cause, but it’s just another example if the importance in having proper legal representation in the food industry...
