Should Contractual Sex Be Legalized?

Prostitution is known as the world's oldest profession dating back to biblical times. Prostitution allows women and men the opportunity to earn a living without and acquired skills other than those of the sexual nature. The Greek viewed the naked body as a masterpiece, so why do American's legislator's for sex for monetary consumption as immoral and degrading? Perhaps they are using their personal religious beliefs to persuade others, or is it the concern for public health and safety. The Constitution grants American citizens the freedom of speech, religion, and trade. Can laws governing restricted prostitution be considered unconstitutional? There was a loophole in their legislation that allowed people to have sex for money as long as it was in the privacy of their own home, not soliciting in a public area. In 2003 a district court judge realized this error when they had to drop the charges against a woman because the acts of indoor prostitution did not violate any laws. Not until 2009, when legislators realized their error, were there statutes implemented to prohibit prostitution. During this period, according to The Washington Post states, "The statewide numbers for gonorrhea among women declined by 39 percent, and the number of rapes reported to police in the state declined by 31 percent." After World War I, Woodrow Wilson, President at the time, declared a temporary prohibition to save grain for food. This ban resulted in the illegal production of alcohol and acts of violence. With the high cost to maintain jails and pay the police, the government was running out funds. The United States was facing times of economic crisis known as, The Great depression. It was known that the high demand for alcohol might actually help economically. A man by the name of Franklin D. Roosevelt was running for office, promoting the appeal of prohibition. The author’s view is one that is for the legalization of prostitution and she argues that “sex workers are a valuable members to the community who deserve legal rights, not punishment”, she also claims that “sex workers contribute a great deal to their families and their communities” (Leigh, 2012). I disagree with this article for many reasons. Prostitution is a violation of human rights for numerous reasons.
