This is called Unlimited Liability. Advantages: * Not many legal restrictions on forming a business * Allows for a more personal service to the customer * Easier to maintain control, make decisions and implement changes quickly * No need to share profits * Financial information is kept private. Disadvantages * Risk of unlimited liability * Business growth is limited by the amount of capital one person can raise * Long hours and difficult in finding time off from holidays of illness * No one to share the responsibilities of the business with, which can be quite stressful and lonely Terms and Conditions When a company starts out, it is important that it clearly sets out the business traders. ...“THE CONCEPT OF RELEVANCE IN THE LAW OF EVIDENCE IS NOT AS STRAIGHTFORWAD AS IT APPEARS TO BE.” DISCUSS It is difficult to spell out a straightforward definition of the concept of relevance (Tapper, p71). In the R v Nethercott case, it was held that any two facts to which the concept of relevance is applied are so related to each other that according to the common course of events, one either taken by itself or in connection with other facts, proves or renders probable the past, present or future existence or non-existence of the other. According to Lord Simon in DPP v Kilbourne, “Evidence is relevant if it is logically probative of some matter which requires proof… It is sufficient to say … that relevant (that is, logically probative or disprobative) evidence is evidence which makes the matter which requires proof more or less probable” (Allen, p8). Essentially, relevant evidence is that which makes the matter requiring proof more or less probable. In this sense, relevance is arguably an absolute concept, as proof of one fact either makes the existence of another more probable, or it does not. Notwithstanding, relevance is often regarded as variable, just as evidence can be regarded as more or less relevant. Zuckerman describes relevance as “having a contextual and dynamic nature”, and the relevance of one fact to another can be judged on its own or in connection with other facts (Zuckerman, p46). This seems to relate more to the cogency of the evidence, given its relevance...

...projections (below) you will know what budget you have set yourself. You will need two figures: a. Capital Outlay; Are you purchasing the premises? Also, purchase or not, what expense will you incur converting them to the school you want. b. Ongoing expense – rent/mortgage repayment. Consider the following issues: - Costs. Apart from wages this is likely to be your biggest cost. - Access for students (public transport availability, parking, etc) - Other tenants in the building. Will your sudden surges of students arriving and leaving create problems for you? - Natural light for your classrooms. - Legal requirements; health & safety, fire, emergency exits and so forth. Discover what insurance will cost, particularly public liability insurance. - Potential income. How many classrooms can you operate, and how many classes will go through each classroom in a day? At what point will your premises limit your potential growth? - What level of outfit are you going to apply to your premises, given that you want to impress your students with a professional set up on the one hand, but not blow your limited budget on the other. 4. ...Bridging Your Coverage Gaps A Personal Excess Liability Policy (PELP) from MetLife Auto & Home provides coverage that helps bridge the gap between the amount of any legal judgment against you and the liability coverage of your existing policies. This valuable policy offers added liability protection you may need if someone is injured on your property or hurt in an accident involving your auto, boat, recreational vehicle or snowmobile. The coverage even protects against other liability claims* that may not be covered by your existing polices, including: false arrest, slander and defamation of character How a Personal Excess Liability Policy Works As the name implies, a Personal Excess Liability Policy provides an added layer of protection on top of your existing auto and homeowner insurance policies. Further, with a PELP, you’re protected with the full coverage amount of your policy, plus the standard liability coverage amount from your existing auto or home policy. You get the $1 million protection in addition to the liability coverage provided by your auto or home policy. Let’s say you have: $1 million of personal excess liability coverage. $300,000 of auto or homeowner liability If you were sued for $1 million, your basic auto or homeowner policy would cover the first $300,000 of the lawsuit costs, then your PELP policy would cover the additional $700,000. Without this additional liability coverage, your current and future assets and income...

...TENDENCY AND COINCIDENCE EVIDENCE IN CRIMINAL CASES (Parts of this paper are a repetition of a paper I prepared for the Legal Aid conference last year and which was published in Bar News Criminal Law Special Edition.) Ian Barker QC 1. I have practised law from a time beyond which the memory of man runneth not. At least, that is how it feels. During those years I managed, I think, to develop a slippery hold on fundamentals of the law of evidence, from the myriad cases on the subject. I was recently heartened to read something written by Sir James Stephen in about 1886 in the Introduction to his Digest of the Law of Evidence1. Speaking of the difficulty in finding concise guidance to the law of evidence he said: No such work, so far as I know, exists; for all the existing books on the Law of Evidence are written on the usual model of English law-books, which, as a general rule, aim at being collections more or less complete of all the authorities upon a given subject to which a judge would listen in an argument in court. Such works often become, under the hands of successive editors, the repositories of an extraordinary amount of research, but they seem to me to have the effect of making the attainment by direct study of a real knowledge of the law, or of any branch of it as a whole, almost impossible. The enormous mass of detail and illustration which they contain, and the habit into which their writers naturally fall, of introducing into them everything which has any...

...dangerous. You might be careful in obeying traffic laws, but you never know when someone else will not and be the cause of an accident that involves you. These are reasons why it is important to have auto insurance. Auto insurance protects you against financial loss if you have an accident. It is a contract between you and the insurance company. You agree to pay the premium and the insurance company agrees to pay your losses as defined in your policy. Auto insurance provides property, liability and medical coverage: * Property coverage pays for damage to or theft of your car. * Liability coverage pays for your legal responsibility to others for bodily injury or property damage. * Medical coverage pays for the cost of treating injuries, rehabilitation and sometimes lost wages and funeral expenses. An auto insurance policy is comprised of six different kinds of coverage. Most states require you to buy some, but not all, of these coverages. If you're financing a car, your lender may also have requirements. Most auto policies are for six months to a year. Your insurance company should notify you by mail when it’s time to renew the policy and to pay your premium. Coverages Your auto policy may include six coverages. Each coverage is priced separately. 1. Bodily Injury Liability This coverage applies to injuries that you, the designated driver or policyholder, cause to someone else. You and family members listed on the policy are also covered when driving someone else’s car...
